{"id":102041,"date":"2020-10-30T20:18:35","date_gmt":"2020-10-30T17:18:35","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/president-trumps-diversity-training-order-faces-lawsuit\/"},"modified":"2020-10-30T20:18:35","modified_gmt":"2020-10-30T17:18:35","slug":"president-trumps-diversity-training-order-faces-lawsuit","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/president-trumps-diversity-training-order-faces-lawsuit\/","title":{"rendered":"#President Trump\u2019s diversity training order faces lawsuit"},"content":{"rendered":"<p>&#8220;<strong>#President Trump\u2019s diversity training order faces lawsuit<\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2020\/10\/trump-diversity-feature.jpg?quality=90&amp;strip=all\" \/><\/p>\n<div>\n                        NEW YORK \u2014 Three civil rights groups filed a lawsuit Thursday challenging President Trump\u2019s executive order that prohibits federal agencies, contractors and grant recipients from offering certain diversity training that the president deems \u201canti-American.\u201d<\/p>\n<p>The NAACP Legal Defense Fund filed the complaint in federal court in Washington, DC, along with the National Urban League and the National Fair Housing Alliance. The lawsuit argued that Trump\u2019s order violates free speech rights and strangles workplace attempts to address systemic race and sex discrimination.<\/p>\n<p>The National Urban League and the National Fair Housing Alliance both have federal contracts and plan to <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly for future ones.<\/p>\n<p>The executive order \u201cunconstitutionally forces Plaintiffs to choose between censoring speech on these important issues or forfeiting any opportunity to enter into a federal contract,\u201d the groups argued in the complaint.<\/p>\n<p>Trump\u2019s executive order, signed last month, called out workplace trainings that explore deep-seated racism and privilege that the administration says could make white workers feel \u201cdiscomfort\u201d or guilt. The president ordered the Labor Department to set up a hotline to investigate complaints about training sessions that Trump has called \u201canti-American\u201d and \u201cblame-focused.\u201d<\/p>\n<p>Trump has said he is targeting training based on \u201ccritical race theory,\u201d the idea that racism has permeated American history and institutions. At the first presidential debate, Trump said such training is \u201cteaching people to hate our country.\u201d<\/p>\n<p>The directive uses a 55-year-old presidential order spurred by the civil rights movement that sought to ban discriminatory practices at companies that contract with the federal government. Critics say Trump\u2019s order twists President Lyndon B. Johnson\u2019s 1965 initiative into a vehicle for white grievances.<\/p>\n<p>\u201cThe executive order smacks of a totalitarian endorsement of white supremacy,\u201d Marc Morial, president and CEO of the National Urban League, said at a virtual press conference.<\/p>\n<p>Morial called the order a \u201cdirect attack on our mission.\u201d According to the lawsuit, the National Urban League has a federal contract that includes developing diversity and inclusion training programs for the Department of Labor\u2019s apprenticeship programs.<\/p>\n<p>The Department of Labor says the order does not ban \u201cunconscious bias\u201d training that discusses \u201cpre-conceptions, opinions, or stereotypes\u201d that people might have about others. But it prohibits training that implies anyone is racist or sexist \u201cby virtue of his or her race, sex, and\/or national origin.\u201d<\/p>\n<p>In a statement, the Labor Department said it \u201cis confident it will prevail in this lawsuit.\u201d<\/p>\n<p>\u201cThe elimination of race and sex stereotyping and scapegoating in employment is a key civil rights priority of the Trump Administration,\u201d the department said.<\/p>\n<p>The lawsuit, however, said the wording of the order is overly broad and is already having a chilling effect on diversity training. Some organizations have asked that words including \u201csystemic racism\u201d and \u201cwhite privilege\u201d be banned from training, the complaint said. It also cited the University of Iowa\u2019s decision to suspend its diversity efforts for fear of losing government funding.<\/p>\n<p>Michelle Lee, co-founder and CEO of Awaken, which provides diversity and inclusion workshops, said one of her clients \u2014 a private company with a government contract \u2014 reached out shortly after the order was issued to ask if she could omit \u201cwhite privilege\u201d from a speech she planned to give to its employees. Lee said she pushed back, saying she did not believe that language would violate the order, and the company relented.<\/p>\n<p>\u201cI did give the speech and I was extra spicy. Not only did talk about white privilege but I extended that further to talk about white supremacy culture,\u201d Lee said.<\/p>\n<p>She said another client, a nonprofit that relies on government grants, has asked if Awaken planned to reformulate its training. But Lee said no professional diversity trainer would imply that any group has unconscious bias without proper context.<\/p>\n<p>\u201cOf course we are not going to stand up and say, \u2018You people are inherently racist,\u2019\u201d Lee said.<\/p>\n<p>Within the government, the Justice Department has suspended all diversity and inclusion training. The government has also canceled training programs at the State Department, the Environmental Protection Agency and the Department of Veterans Affairs.<\/p>\n<p>The National Fair Housing Association, which currently has a contract with Department of Housing and Urban Development, said in the lawsuit that it routinely conducts internal training and discussions to address \u201csystemic racism, unconscious bias, and racial inequities.\u201d Those include a recent \u201cinformal conversation\u201d with employees concerning \u201cperceptions of white people and other demographic groups in connection with the killing of George Floyd.\u201d<\/p>\n<p>The Labor Department is also using the 1965 presidential order to target companies, including Microsoft and Wells Fargo, over public commitments to expand or bolster black and Hispanic representation in leadership roles.
