{"id":104150,"date":"2020-11-03T18:53:06","date_gmt":"2020-11-03T15:53:06","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/high-end-art-sales-could-be-used-to-avoid-sanctions-feds-warn\/"},"modified":"2020-11-03T18:53:06","modified_gmt":"2020-11-03T15:53:06","slug":"high-end-art-sales-could-be-used-to-avoid-sanctions-feds-warn","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/high-end-art-sales-could-be-used-to-avoid-sanctions-feds-warn\/","title":{"rendered":"#High-end art sales could be used to avoid sanctions, feds warn"},"content":{"rendered":"<p>&#8220;<strong>#High-end art sales could be used to avoid sanctions, feds warn<\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2020\/11\/art-sales-avoid-sanctions-e1604418166672.jpg?quality=90&amp;strip=all\" \/><\/p>\n<div>\n                        Blacklisted foreigners such as terrorists and drug traffickers could buy expensive artworks to get around sanctions meant to shut them out of the American financial system, the feds say.<\/p>\n<p>US Treasury officials spelled out their concerns in an <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/home.treasury.gov\/system\/files\/126\/ofac_art_advisory_10302020.pdf\">advisory<\/a> warning high-end art galleries, collectors, brokers and auction firms to watch out for such shady buyers \u2014 or else face possible penalties.<\/p>\n<p>The art market is particularly vulnerable to sanctions violations because it affords buyers and sellers a high degree of anonymity with little transparency, according to the Treasury\u2019s Office of Foreign Assets Control, or OFAC, which enforces sanctions rules.<\/p>\n<p>Inter<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>ries and shell companies are often used to buy, sell or hold expensive artworks and to make and receive payments, which allow bad actors \u201cto obscure their true identities from other market participants, and help to hide prohibited conduct from law enforcement and regulators,\u201d the office said in its Friday advisory.<\/p>\n<p>\u201cThe mobility, concealability, and subjective value of artwork further exacerbate its vulnerability to sanctions evasion,\u201d the document reads.<\/p>\n<p>The OFAC said there\u2019s a risk the art market could be abused by people on its \u201cList of Specially Designated Nationals and Blocked Persons,\u201d which <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/home.treasury.gov\/policy-issues\/financial-sanctions\/specially-designated-nationals-and-blocked-persons-list-sdn-human-readable-lists\">includes<\/a> narcotics traffickers and terrorists who are banned from doing business with Americans.<\/p>\n<p>As one example, the office cited the case of Nazem Said Ahmad, a Lebanese diamond dealer and art collector whom the Treasury has sanctioned for allegedly financing Hezbollah. The feds say Ahmad stored some of his personal cash in valuable artworks \u201cin a preemptive attempt to mitigate the effects of US sanctions.\u201d Ahmad\u2019s daughter denied the allegations when the sanctions were announced last year, <a rel=\"nofollow noopener noreferrer\" target=\"_blank\" href=\"https:\/\/www.nytimes.com\/2019\/12\/13\/arts\/design\/art-collector-sanctions-hezbollah.html\">according to The New York Times<\/a>.<\/p>\n<p>The OFAC warned art dealers to mitigate their exposure to sanctions violations as they could face civil penalties for dealing with blacklisted individuals.
