{"id":108739,"date":"2020-11-10T05:43:19","date_gmt":"2020-11-10T02:43:19","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/heating-rules-for-outdoor-dining-putting-burden-on-nyc-restaurants\/"},"modified":"2020-11-10T05:43:19","modified_gmt":"2020-11-10T02:43:19","slug":"heating-rules-for-outdoor-dining-putting-burden-on-nyc-restaurants","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/heating-rules-for-outdoor-dining-putting-burden-on-nyc-restaurants\/","title":{"rendered":"#Heating rules for outdoor dining putting burden on NYC restaurants"},"content":{"rendered":"<p>&#8220;<strong>#Heating rules for outdoor dining putting burden on NYC restaurants<\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2020\/11\/outdoor-dining-4.jpg?quality=90&amp;strip=all\" \/><\/p>\n<div>\n                        Big <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>le restaurateurs say they have been left out in the cold by Mayor de\u2009Blasio as they scramble to keep outdoor dining alive this winter.<\/p>\n<p>When the mayor announced on Sept. 25 that the city\u2019s outdoor dining regulations could continue past Oct. 31, struggling restaurateurs rushed out to buy assortments of heaters to keep their patrons toasty.<\/p>\n<p>But the city, working with the FDNY, didn\u2019t release its rules for outdoor heating until a month later, on Oct. 14.<\/p>\n<p>And they turned out to be so burdensome in some cases that heaters previously believed to be OK, including propane units, are now useless, restaurateurs said.<\/p>\n<p>Marcus Ware, executive chef of The Milling Room on the Upper West Side, was among those who rushed out to buy propane heaters after learning that outdoor dining would become a permanent part of the city\u2019s coronavirus response. He had planned to pair them with electric heaters to help reduce the burden on The Milling Room\u2019s electric system.<\/p>\n<p>Now, the heaters, which cost Ware about $1,000 total, are sitting inside unused because the FDNY won\u2019t let him use them near people, which is the only reason to buy them in the first place.<\/p>\n<p>\u201cI never imagined they would consider a human being a combustible,\u201d Ware said. \u201cThe city gave us permission to use the propane heaters. But then the Fire Department said the heaters couldn\u2019t be too close to diners. It\u2019s just crazy, and everyone is in the same boat.\u201d<\/p>\n<p>The FDNY\u2019s rules say that propane heaters must be stationed at least five feet away from any \u201ccombustible material.\u201d Sources say the Fire Department has been telling eatery owners this includes clothing, which caught some owners off guard.<\/p>\n<p>\u201cInspectors are telling restaurants they can\u2019t have customers sit within five feet of the heaters because of their clothes,\u201d said Andrew Rigie, executive director of the New York Hospitality Alliance.<\/p>\n<p>\u201cSo are people supposed to eat naked \u2014 or sit so far from the heaters that they don\u2019t keep them warm?<\/p>\n<p>\u201cEssentially, the city is technically allowing the heaters, but then the Fire Department is making it impossible to actually use them after restaurants spend the money and time on getting them,\u201d Rigie added.<\/p>\n<p>Sources say the confusion could have been avoided if the mayor had come out with comprehensive rules for outdoor dining in a more timely fashion. Instead, he didn\u2019t OK permanent outdoor dining until Sept. 25. And then it took a month for the rules to follow, despite City Hall\u2019s promise that official guidance for \u201capproved installation and use of heating elements\u201d would be released before the end of September.<\/p>\n<p>\u201cDe Blasio didn\u2019t move fast enough,\u201d said restaurant consultant Donny Evans. \u201cThe regulations should have been drawn up in August.\u201d<\/p>\n<p>The conflict couldn\u2019t come at a worse time. More than 10,000 restaurants have outdoor dining, 10 times the number that operated outdoors prior the pandemic.<\/p>\n<p>And with patrons afraid to be maskless indoors, eatery owners are dependent on outdoor dining for their very survival.<\/p>\n<p>Mitch Schwartz, a spokesman for the mayor, acknowledges there are kinks in the program that still need to be worked out.<\/p>\n<p>\u201cThe city is working with the industry on distance requirements, and we\u2019ll closely consult with our fire-safety experts on adjustments as needed,\u201d Schwartz told Side Dish via e-mail.<\/p>\n<p>\u201cThis is a brand- new program, one without precedent in this city, and we\u2019ll be nimble enough to make sure it\u2019s working effectively for businesses, staff and diners.\u201d<\/p>\n<p>Restaurateurs say time is running out \u2014 as it\u2019s well into November and the FDNY has been impounding some propane tanks.<\/p>\n<p>One Chelsea restaurateur said that when the FDNY confiscated his propane tanks, \u201cthey apologized and said they don\u2019t even understand the rules.\u201d They also explained that rules around propane heaters date back 20 years to 9\/11 \u201cbecause they can be tricked out and turned into bombs.\u201d<\/p>\n<p>The reason they are not allowed in the street, the restaurant owner said officials told him, is because \u201cif a car accidentally crashes, the heaters can explode.\u201d<\/p>\n<p>And while rules like that make sense, he also thinks the confusion could have been avoided if the mayor had acted sooner.<\/p>\n<p>\u201cBy the time the city came out with their rules, it was too late,\u201d the eatery operator said.<\/p>\n<p>\u201cPeople needed to do something to continue business.
