“#DHS chief says DACA ruling \u2018usurps\u2019 executive branch\u2019s authority<\/strong>”<\/p>\n

\n Acting Homeland Security Secretary Chad Wolf on Thursday criticized the Supreme Court\u2019s decision on the Obama-era Deferred Action for Childhood Arrivals (DACA) program, accusing the high court of failing to deliver certainty to recipients of the program, and of usurping the authority of the executive branch.<\/p>\n

The court ruled Thursday in a 5-4 decision that Trump\u2019s push to end the program, which gave protection from deportation to illegal immigrants who came to the country as children,\u00ad was in violation of the Administrative Procedure Act (APA) \u2014 which sets out rulemaking procedures for federal agencies.<\/p>\n

\u201cDACA recipients deserve closure and finality surrounding their status here in the US. Unfortunately, today\u2019s Supreme Court decision fails to provide that certainty,\u201d Wolf said in a statement.<\/p>\n

\u201cThe DACA program was created out of thin air and implemented illegally. The American people deserve to have the Nation\u2019s laws faithfully executed as written by their representatives in Congress \u2014 not based on the arbitrary decisions of a past Administration,\u201d he said. \u201cThis ruling usurps the clear authority of the Executive Branch to end unlawful programs.\u201d<\/p>\n

Acting Deputy Secretary Ken Cuccinelli, who had earlier called the decision a \u201cdouble-standard\u201d and \u201coutrageous,\u201d said in a statement that the decision was \u201can affront to the rule of law and gives Presidents power to extend discretionary policies into future Administrations.\u201d<\/p>\n

\u201cNo Justice will say that the DACA program is lawful, and that should be enough reason to end it,\u201d\u2019 he said.<\/p>\n

While the ruling was cheered by Democrats and immigration activists, the DHS reaction was part of a broader push back on the ruling by the Trump administration.<\/p>\n

President Trump reacted to the ruling by calling for new justices on the court and warning that he wants to \u201cstart this process all over again.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
