\n A New York man says he and other consumers have been duped into believing that Tecate beer is Mexican when it\u2019s actually made by Dutch company Heineken in Holland, new court papers show.<\/p>\n

Miguel Schelmetty says the beer is masquerading as Mexican \u201cthrough the brand name, the traditional Meso-American typeface, the mythical Aztec eagle emblazoned on the product and the statements \u2018Original\u2019 and \u2018Cerveza,’\u201d on the labeling, according to his Manhattan Federal lawsuit from Friday.<\/p>\n

Also, Tecate\u2019s website says \u201cHecha En Tecata Baja California Mexico\u201d and \u201cBorn and brewed in the land we are proud to share our name with: Tecate,\u201d the suit points out.<\/p>\n

Meanwhile, the company only discloses its true origins \u201cin small font on the back of the boxes on the lower left where it states \u2018Product of Holland’\u201d and \u201c\u2018Brewed and canned by HBBV Amsterdam, Holland \u2026 Imported by Cervezas Mexicanas, White Plains, NY,’\u201d the court documents note.<\/p>\n

Schelmetty claims this is deceptive advertisement.<\/p>\n

And had Schelmetty and other consumers known Tecate is actually made in Holland \u201cthey would not have bought the product or would have paid less for them,\u201d the court papers say.<\/p>\n

Tecate sells for \u201ca premium\u201d at around $11.99 for a 12-pack \u2014 which is \u201chigher than the price of the product if it were represented in a non-misleading way,\u201d the suit alleges.<\/p>\n

\u201cDefendant sold more of the Product and at higher prices than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers,\u201d the court documents charge.<\/p>\n

Schelmetty is asking a judge to allow his suit to be filed as a class action so that other consumers can also seek damages. He is suing for unspecified damages.<\/p>\n

Heineken did not immedia<\/a>tely return a request for comment.\n <\/p><\/div>\n
