The internet will give you a lot of answers, but we talked to a lawyer to get a more definitive answer.<\/p>\n<p><span class=\"nutshell\">Emulators are legal to download and use, however, sharing copyrighted ROMs online is illegal. There is no legal precedent for ripping and downloading ROMs for games you own, though an argument could be made for fair use.<\/span><\/p>\n<p>To find out, we asked\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/law.arizona.edu\/derek-bambauer\">Derek E. Bambauer<\/a>, who teaches Internet law and intellectual property at the University of Arizona\u2019s College of Law. Unfortunately, we discovered that no definitive answer truly exists, since these arguments have yet to be tested in court. But we can at least bust some myths that are floating around out there. Here\u2019s what you need to know about the legality of emulators and ROMs in the United States.<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"Emulators_Are_Almost_Certainly_Legal\"><\/span>Emulators Are Almost Certainly Legal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-262769\" src=\"https:\/\/www.howtogeek.com\/wp-content\/uploads\/2016\/07\/xsnes-horray.jpg.pagespeed.gp+jp+jw+pj+ws+js+rj+rp+rw+ri+cp+md.ic.hcibwu-3Yn.jpg\" alt=\"\" width=\"650\" height=\"308\" onload=\"pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\" onerror=\"this.onerror=null;pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\"\/><\/p>\n<p>Let\u2019s start with the easy stuff. Despite what you may have heard, there\u2019s not a lot of question as to whether\u00a0emulators themselves are legal. An emulator is\u00a0just a piece of software meant to <em>emulate<\/em> a game system\u2014but most don\u2019t contain any proprietary code. (There are exceptions, of course, such as the BIOS files that are required by certain emulators to play games.)<\/p>\n<p>But emulators aren\u2019t useful without game files\u2014or ROMs\u2014and ROMs are almost always an unauthorized copy of of a video game that\u2019s protected by copyright. In the United States, copyright protects works for 75 years, meaning no major console titles will be public domain for decades.<\/p>\n<p>But even ROMs exist in a bit of a grey area, according to Bambauer.<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"The_Possible_Exception_for_ROMs_Fair_Use\"><\/span>The Possible Exception for ROMs: Fair Use<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To begin: downloading a copy of a game you don\u2019t own is not legal. It\u2019s no different from downloading a movie or TV show that you don\u2019t own.\u00a0\u201cLet\u2019s assume I have an old Super Nintendo, and I love Super Mario World, so I download a ROM and play it,\u201d said Bambauer. \u201cThat\u2019s a violation of copyright.\u201d<\/p>\n<p>That\u2019s fairly clear cut, right? And it more or less aligns with the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nintendo.com\/corp\/legal.jsp#helping\">language regarding ROMs on Nintendo\u2019s website<\/a>, where the company argues that downloading any ROM, whether you own the game\u00a0or not, is illegal.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-262770\" src=\"https:\/\/www.howtogeek.com\/wp-content\/uploads\/2016\/07\/xNES-collection-games.jpg.pagespeed.gp+jp+jw+pj+ws+js+rj+rp+rw+ri+cp+md.ic.R4mRn6cidV.jpg\" alt=\"\" width=\"650\" height=\"300\" onload=\"pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\" onerror=\"this.onerror=null;pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\"\/><\/p>\n<p>But is there a legal defense? Possibly, if you already own a Super Mario World cartridge. Then, according to Bambauer, you might be covered by fair use.<\/p>\n<p>\u201cFair use is a fuzzy standard, not a rule,\u201d Bambauer explained. He says he could imagine a few possible defensible scenarios.\u00a0\u201cIf I own a copy of Super Mario World, I can play it whenever I want,\u201d he notes, \u201cbut what I\u2019d really like to do is play it on my phone or my laptop.\u201d\u00a0In this case, downloading a ROM could be legally defensible.<\/p>\n<p>\u201cYou\u2019re not giving the game to anybody else, you\u2019re just playing a game you already own on your phone,\u201d said Bambauer. \u201cThe argument would be there\u2019s no market harm here; that it\u2019s not substituting for a purchase.\u201d<\/p>\n<p>Now, this isn\u2019t black and white; just a potential legal argument. And Bambauer is quick to admit it\u2019s not a perfect one.<\/p>\n<p>\u201cThis is by no means a slam dunk argument,\u201d said Bambauer, \u201cBut it\u2019s by no means a silly one.\u201d After all, Nintendo could argue that by emulating the game on your phone, instead of buying their official port of a game, they\u2019re losing money.<\/p>\n<p>But,\u00a0while there is no precedent specific to gaming, there is\u00a0in other markets.\u00a0\u201cIn the music industry, everyone accepts that space shifting is legal,\u201d Bambauer notes. You can see where this gets complicated.<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"What_If_You_Rip_Your_Own_ROMs\"><\/span>What If You Rip Your Own ROMs?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-265031\" src=\"https:\/\/www.howtogeek.com\/wp-content\/uploads\/2016\/07\/xr2-carts-controllers.jpg.pagespeed.gp+jp+jw+pj+ws+js+rj+rp+rw+ri+cp+md.ic.jGIVFjfXIZ.jpg\" alt=\"\" width=\"650\" height=\"356\" onload=\"pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\" onerror=\"this.onerror=null;pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\"\/><\/p>\n<p>A common argument online is that extracting a ROM from a cartridge you own is perfectly legal, but downloading ROMs from the web is a crime.\u00a0Devices like the $60 <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.retrode.com\/\">Retrode<\/a>\u00a0let anyone extract a Super Nintendo or Sega Genesis game over USB, and state their legality over downloads as a key selling point.\u00a0After all, ripping\u00a0a CD you own with iTunes or other software is broadly considered legal, at least in the United States.<\/p>\n<p>So is ripping a ROM you own any different than downloading one? Probably not, says Bambauer: \u201cIn both cases what you\u2019re doing is creating an additional copy.\u201d<\/p>\n<p>Now, Bambauer could imagine constructing an argument about how one is different than the other, and he admits the optics are different. But he doesn\u2019t think the two situations are all that distinct, legally speaking.<\/p>\n<p>\u201cI think if the argument is, if I were a skilled engineer, I could extract this and have a copy,\u201d said Bambauer. \u201cIf we assume, for a moment, that if I did that it would be fair use, then it shouldn\u2019t be different.\u201d<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"Sharing_ROMs_Is_Unambiguously_Illegal\"><\/span>Sharing ROMs Is Unambiguously Illegal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-262773\" src=\"https:\/\/www.howtogeek.com\/wp-content\/uploads\/2016\/07\/xcart-box-nes-games-1.jpg.pagespeed.gp+jp+jw+pj+ws+js+rj+rp+rw+ri+cp+md.ic.f_HhWpcABt.jpg\" alt=\"cart-box-nes-games\" width=\"650\" height=\"369\" onload=\"pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\" onerror=\"this.onerror=null;pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\"\/><\/p>\n<p>This fair use argument is potentially very wide reaching, but there are limits.\u00a0\u201cThe trouble comes when it\u2019s no longer just me having a copy, it\u2019s giving other people a copy,\u201d said Bambauer.<\/p>\n<p>Consider the entertainment industry. The RIAA and MPAA have found more luck going after the sites and people sharing music, rather than the downloaders. For ROMs it largely works the same way, which is why sites that share games are so frequently shut down.<\/p>\n<p>\u201cOnce you\u2019re distributing a ROM, most of the people downloading it probably don\u2019t have legal copies of the game,\u201d said Bambauer. \u201cThen it is market harm, because Nintendo should be able to sell to those people.\u201d<\/p>\n<p>Because of this, it might be a good idea, even if you own a game, to avoid downloading ROMs from peer-to-peer networks, where you\u2019re sharing a copy of the game as you download it.<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"What_If_a_Game_Isnt_Currently_On_the_Market\"><\/span>What If a\u00a0Game Isn\u2019t Currently On the Market?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-262772\" src=\"https:\/\/www.howtogeek.com\/wp-content\/uploads\/2016\/07\/xnes-system.jpg.pagespeed.gp+jp+jw+pj+ws+js+rj+rp+rw+ri+cp+md.ic._XUjd-WMPw.jpg\" alt=\"\" width=\"650\" height=\"370\" onload=\"pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\" onerror=\"this.onerror=null;pagespeed.lazyLoadImages.loadIfVisibleAndMaybeBeacon(this);\"\/><\/p>\n<p>Many people argue online that if a game isn\u2019t currently available on the market, downloading a ROM is legal. After all: there can\u2019t be market harm if a game is not currently for sale in digital form.<\/p>\n<p>That argument might not be airtight, according to Bambauer.<\/p>\n<p>\u201cOn the one hand, there\u2019s no amount of money that will let me get a legal copy of this game,\u201d said Bambauer. \u201cOn the other side of the argument, there\u2019s what Disney does.\u201d\u00a0Disney\u2019s strategy is to\u00a0put classic\u00a0<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">movies<\/a> \u201cin the vault\u201d for extended periods. Instead of leaving films constantly on the market, they\u00a0periodically re-release them, which builds up demand and\u00a0increases sales when that release actually comes.<\/p>\n<p>Video game companies could argue they\u2019re doing the same thing with currently unreleased games, and that ROMs are driving down the potential market value.\u00a0\u201cIt\u2019s a close case,\u201d says Bambauer, \u201cand hasn\u2019t been tested a lot.\u201d But they could make that argument.<\/p>\n<p>At the same time, he notes, a game not currently being on the market could potentially be a useful part of a defense, particularly if you\u2019re downloading a game you already own.<\/p>\n<p>\u201cI couldn\u2019t buy a copy anyway, and I already own a copy,\u201d said Bambauer, again hypothetically. \u201cSo it\u2019s kind of like owning a CD, and ripping it on my own.\u201d<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"All_of_This_Is_Mostly_Hypothetical\"><\/span>All of This Is Mostly Hypothetical<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>You\u2019re probably starting to see a pattern here. ROMs are such a grey area because there are potential legal defenses on both sides\u2014but no one\u2019s truly tested these arguments before.
