“#Ex-Sardi’s server sues NYC restaurant for sexual harassment<\/strong>”<\/p>\n

A former Sardi\u2019s server is suing the iconic Manhattan restaurant, charging she was sexually harassed during her eight-month stint there and fired in retaliation when she complained, a federal court suit alleges.<\/p>\n

The plaintiff, Yesenia Diaz, now 29, started working at the 44th Street eatery in the heart of the Times Square district in January 2017, Manhattan federal court documents state. <\/p>\n

The legendary Broadway haunt, best known for nine decades of framed celebrity caricatures adorning its walls, was the hangout of Marilyn Monroe, Elizabeth Taylor, Richard Burton, Arthur Miller and Barbra Streisand.<\/p>\n

Leonard Lyons, the fabled Post columnist, is said to have table-hopped every night, collecting anecdotes. Robert Preston held court at the bar after performances of \u201cThe Music Man.\u201d<\/p>\n

But it was hell for Diaz, whose troubles allegedly began two months after being hired when general<\/a> manager Sean Ricketts \u201ctouched [her] lower waist and shoulders,\u201d the suit alleges.<\/p>\n

Ricketts \u201chad a habit\u201d of doing this while whispering in her ear, the suit says. Ricketts \u201cclearly saw\u201d Diaz \u201cwas uncomfortable with his advances,\u201d yet continued to let his hands roam for months, the suit alleges.<\/p>\n

Diaz said she \u201crealized that her job was on the line if she did not acquiesce to his demands\u201d for too-close conversations, the complaint says.<\/p>\n

In May, emboldened male coworkers began to torment her, according to the suit and Diaz\u2019s attorney, Christopher J. Berlingieri.<\/p>\n

\u201cThe male employees took checks off her tables to make her think she was \u2018losing it\u2019 and sabotage her job, they mocked her and made catcalls when she walked up the stairs and even burned her work shirt uniform,\u201d Berlingieri told The Post. \u201cMy client complained about all this to management and nothing was done.\u201d <\/p>\n

The suit alleges one senior male server touched Diaz\u2019s buttocks in May but when she complained to Ricketts, the general manager did nothing. When the male server, \u201cMoe,\u201d realized Diaz complained to Ricketts, he called her a \u201cstupid bitch,\u201d the suit charges.<\/p>\n

Diaz also complained about the sexual harassment to Sardi\u2019s kitchen manager, \u201cOrlando,\u201d according to court papers.<\/p>\n

On Aug. 25, 2017, Sardi\u2019s \u201cretaliated\u201d by firing Diaz, the suit says.<\/p>\n

The suit seeks uspecified damages for mental distress, anxiety, flashbacks, \u201caches, pains and sleepless nights,\u201d <\/p>\n

\u201cThis sort of thing shouldn\u2019t happ<\/a>en at any restaurant, let alone at Sardi\u2019s,\u201d Diaz\u2019s attorney Berlingieri told The Post. \u201cThis happened in the pre-#MeToo era, in a time where this sort of conduct by management unfortunately may have been acceptable.\u201d<\/p>\n

Diaz said through her attorney: \u201cI don\u2019t want them to get away with what they did to me at Sardi\u2019s, it\u2019s not right.\u00a0\u201c<\/p>\n

The defendants did not return messages.\n <\/p><\/div>\n
