“#US attorney Bianca Forde sues cops for wrongful arrest in NYC<\/strong>”<\/p>\n

\n A federal prosecutor was wrongfully arrested when cops slapp<\/a>ed the cuffs on her for advising her boyfriend of his legal rights during a drunk-driving stop, a new lawsuit alleges.<\/p>\n

Assistant US attorney Bianca Forde was arrested on Nov. 30 when her boyfriend Joseph Paul got pulled over for suspected drunk driving in Midtown Manhattan and was asked to take a breathalyzer test, according to a Manhattan civil suit filed against officers Fidel Hernandez, Christophe Williams and Weigand, whose first name was not included in the suit.<\/p>\n

Forde, the passenger, allegedly said at the time \u201cI\u2019m a US attorney. I\u2019m his attorney \u2014 he doesn\u2019t have to blow.\u201d<\/p>\n

Paul did anyhow and passed the breathalyzer test and wasn\u2019t arrested.<\/p>\n

Forde \u2014 who works in the criminal division of the US attorney\u2019s office in Washington D.C. \u2014 was charged with obstructing governmental administration, resisting arrest and failure to obey police officers.<\/p>\n

The charges against her were dismissed and the case was sealed on April 6, according to her suit.<\/p>\n

Now, the 35-year-old prosecutor is claiming it was \u201can unlawful stop\u201d to begin with and the three officers from the incident \u201cdenied [Forde] the right to a fair trial by forwarding false information to the District Attorney\u2019s Office, and to the media<\/a>,\u201d the Manhattan Supreme Court lawsuit from Wednesday says.<\/p>\n

The car didn\u2019t \u201ccommit a traffic violation \u2026 or give police officers a reasonable and objective basis to stop the car,\u201d the court papers say.<\/p>\n

The cops, \u201cincorrectly, and unlawfully, claimed the driver of the vehicle was intoxicated,\u201d and Paul had no prior arrests for DWI, the suit says.<\/p>\n

And Forde, \u201cwho is a lawyer, was giving legal advice to the driver\u201d when \u201cwithout any provocation or legal justification, the defendant police officers forcibly grabbed plaintiff and unlawfully handcuffed her,\u201d the court documents allege.<\/p>\n

\u201cAt no point in time did plaintiff resist arrest in any way,\u201d the court papers claim.<\/p>\n

Cops at the time said that Forde jumped out of the car despite multiple warnings telling her to stay inside and they claimed she flailed her arms when they tried to put handcuffs on her.<\/p>\n

Since the incident Forde was passed over for a promotion \u201cbased solely on this arrest, from the false charges brought by the defendant officers,\u201d the court documents say.<\/p>\n

Forde was also forced to spend $10,000 to hire a criminal-defense lawyer to fight the charges and has had to seek mental-health treatment \u201cto cope with her emotional and mental trauma,\u201d the suit says.<\/p>\n

Her lawyer declined to comment.<\/p>\n

Hernandez referred inquiries to the NYPD, and the other two could not be reached for comment.<\/p>\n

It was not immediately clear if they had a lawyer.<\/p>\n

A spokesperson with the city Law Department said \u201cWe\u2019ll review the case to determine whether it has merit.\u201d<\/p>\n

The NYPD did not immediately return a request for comment.<\/p>\n
