“#Ariel Pink Abuse Allegations Surface in Court Case<\/strong>”<\/p>\n

Ariel Pink has lost his bid for civil harassment restraining orders against his ex-girlfriend Charlotte Ercoli Coe, court documents obtained by Pitchfork show. On January 6, Los Angeles County Superior Court Commissioner Laura Cohen ordered Pink\u2019s request \u201chereby stricken and dismissed,\u201d and ruled that Coe is entitled to \u201creasonable attorneys\u2019 fees and costs,\u201d in an amount yet to be determined, according to the documents.<\/p>\n

The order cited California\u2019s \u201canti-SLAPP\u201d statute<\/a>, which aims to discourage frivolous lawsuits being used as an intimidation tactic. The court held that Coe, a video director<\/a> and solo musician<\/a> who is also Pink\u2019s former bandmate, had \u201cmade a threshold showing\u201d that her behaviors, which Pink had deemed harassment, were \u201cConstitutionally-protected activities.\u201d<\/p>\n

Coincidentally, the ruling occurred on the same day that Pink attended a pro-Trump rally at the White House Ellipse. (Pink has said he was not part of the mob that stormed the Capitol in a deadly riot later the same day.)<\/p>\n

Pink\u2019s lawyer Thomas Mortimer told Pitchfork in an email response to a request for comments: \u201cThe pending matter is now on appeal and the subject of a separate lawsuit in the Los Angeles Superior Court. It is [Pink\u2019s] position that the speech and communications at the heart of the case are not protected and [are] defamatory.\u201d No indication of an appeal or separate lawsuit currently appears in online court records. When asked by Pitchfork for more information, Mortimer wrote, \u201cAs I indicated they are pending.\u201d<\/p>\n

Jordan Susman, a lawyer representing Coe in the case, declined to comment to Pitchfork.<\/p>\n

Pink, whose birth name is Ariel Rosenberg, filed for restraining orders against Coe on August 10, 2020. In his petition, Pink claimed that Coe harassed him by \u201cfalsely claiming he was a sexual \u2018predator\u2019 and falsely claiming to mutual friends and to [Pink] that he committed sexual offenses almost three years ago for which she has threatened to report [Pink] to police authorities.\u201d Pink claimed that Coe had \u201cdirectly threatened\u201d him and \u201cattempted to blackmail him with false allegations of sexual misconduct to his record label and financial supporters, to the media<\/a>, including Pitchfork and Variety<\/em>, and to the general<\/a> public.\u201d<\/p>\n

The most recent incident of alleged harassment, according to Pink\u2019s restraining orders petition, occurred from \u201cJuly 29, 2020 up through present.\u201d It involved a letter that Coe sent to Pink\u2019s then\u2013record label, Mexican Summer, \u201cwith the intent of having [Pink] dismissed from the label,\u201d according to the language in the petition.<\/p>\n

In his petition, Pink asked for a court order that Coe not \u201ccontact media outlets\u201d about her allegedly false claims against him, or post about the claims on social media. Pink also requested that Coe be ordered to pay $4,100 for his lawyer\u2019s fees and court costs.<\/p>\n

Coe filed a motion to strike Pink\u2019s restraining orders request on anti-SLAPP grounds on October 14. In a declaration in support of the anti-SLAPP motion, Coe made a number of allegations, asserting that she was prepared to testify about them if called as a witness.<\/p>\n

First, Coe claimed that Pink \u201cphysically attacked\u201d her on stage during an October 2017 concert in San Francisco. \u201cI did not consent to the attack,\u201d Coe\u2019s declaration reads. Coe had tweeted<\/a> about the incident at the time, saying that the two were \u201cjust having fun.\u201d In the declaration, Coe alleged that Pink \u201cphysically and mentally abused [her] during [their] relationship, including the 2017 incident at the San Francisco concert.\u201d She asserted that her tweet was made \u201cunder pressure from\u201d Pink. Here, she characterized the behavior as \u201cbattery.\u201d (Pink previously addressed complaints about the San Francisco incident, writing, \u201cmy behavior onstage was gross and I can\u2019t defend it.\u201d)<\/p>\n<\/div>\n

\u201cI began dating [Pink] in 2015, when I was 19 and [Pink] was 38,\u201d the declaration by Coe continued. \u201cIt was a tumultuous relationship, characterized by a power imbalance: [Pink] was 19 years older than me; [Pink] was famous, and I was not; [Pink] was established in the music business, while I was just beginning my music career.\u201d<\/p>\n

Also in the October 14 declaration, Coe alleged that Pink \u201cbullied [her] into [having] unprotected sex with him,\u201d and that he \u201cinfected [her] with herpes after [the two] had unprotected sex.\u201d Coe claimed that, in 2018, she discovered that Pink had \u201cillegally distributed naked pictures\u201d of her \u201cto some of his fans.\u201d She further alleged that while she was in a relationship with Pink, she received messages from a girl who claimed to be under the age of 18 asserting that Pink had flirted with her. Coe claimed in the declaration, too, that after she and Pink broke up in 2018, his alleged \u201cabuse continued,\u201d including harassment at her home and constant texting.<\/p>\n

\u201cFeeling empowered by the #MeToo movement, in July 2020, I finally found the strength to call out [Pink]\u2019s abuse,\u201d Coe\u2019s declaration reads. \u201cOn Twitter, I explained that I was afraid to speak out for so long, but I felt compelled to tell my followers that [Pink] is, in fact, an abuser.\u201d<\/p>\n

In the declaration, Coe also acknowledged writing to Mexican Summer. She claimed she had learned the label \u201cwas adopting a zero tolerance policy toward abuse and harassment.\u201d (In July 2020, Mexican Summer pulled Los Angeles band Part Time\u2019s music, citing abuse allegations.) An email attached as an exhibit along with Coe\u2019s declaration, and included with Pink\u2019s initial petition, appears to show Coe writing on July 29, 2020, to Keith Abrahamsson, Mexican Summer\u2019s co-founder. \u201cI haven\u2019t been able to speak up because me and my family so badly want him to just leave us alone but I think he puts other people at risk,\u201d the email reads. \u201cHe is 10000% a predator.\u201d In the email, Coe also claimed that Pink offered her $10,000 to never mention \u201cpornographic images and video\u201d of her that Pink allegedly shared with fans. \u201cEarly on in our relationship I had to call someone to ask if he had raped me because I was so upset by him not listening to me saying no to unprotected sex but tricked me in to it for a matter of seconds anyway,\u201d she wrote. (Abrahamsson declined to comment to Pitchfork.)<\/p>\n

In a separate October 14 declaration in support of the anti-SLAPP motion, Coe\u2019s aunt, Robin Coe Hutshing, included what she alleged was a copy of a text message she received from Pink on July 9, 2018. \u201ci fucked up with charlie on dozens of fronts and deserve what i got as a consequence,\u201d the message reads, allegedly referring to Coe. \u201ci gave her herpes (kills me more than anythng [sic<\/em>]) and that alone would have been grounds enough for a break up. i flirted w people online, thinking it harmless, and that it wouldn\u2019t get back to her- i even sent private nude pics of charlie like a fucking idiot, convincing myself that it wasn\u2019t inappropriate because i was \u2018bragging\u2019 about how hot my gf was.\u201d<\/p>\n

Ariel Pink denied the bulk of Coe\u2019s allegations in a November 2 opposition to the motion to strike his request for restraining orders on anti-SLAPP grounds. He asked for the motion to be denied, arguing in part that \u201c[Coe\u2019s] claims that [he] is a sexual predator, physically abusive, and a pedophile are intentionally false, misleading and defamatory,\u201d and, therefore, \u201care not protected free speech nor covered by the Anti-SLAPP statute.\u201d Among other specific denials, Pink contended that he \u201cnever hid or in any way concealed\u201d his herpes diagnosis from Coe during their relationship, maintained that he never in \u201cany way attempted to manipulate [Coe] into having unprotected sex with the knowledge that he had the disease before his diagnosis,\u201d claimed that she was \u201cclothed\u201d in the images he shared of her, and alleged that he shared the images with only one person, \u201ca friend who was a fan.\u201d In a separate filing, Pink also disputed the alleged text message to Robin Coe Hutshing.<\/p>\n

Pink asked the court to stop Coe\u2019s \u201cwrongful conduct that continues to threaten and harm [him] during these very difficult times.\u201d While the court did not weigh in on the underlying truth or falsehood of Pink\u2019s or Coe\u2019s abuse allegations, with last week\u2019s order it formally rejected Pink\u2019s request for restraining orders against Coe. The ruling was \u201cwithout prejudice,\u201d which means that Pink could potentially refile.<\/p>\n

On January 8, after Pink confirmed his participation in last week\u2019s pro-Trump rally, Mexican Summer announced that the label had \u201cdecided to end [its] working relationship\u201d with the artist \u201cmoving forward.\u201d<\/p>\n
