Under the test, workers can be considered independent contractors only if they control their work; if their duties fall outside the scope of a company\u2019s normal business; and if they have an independent business doing that work. <\/p>\n<div class=\"paywall\">\n       AB 5 led to Proposition 22 as Uber<br \/>\n        UBER,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/211348248\/composite\" class=\"negative\">-4.19%<\/bg-quote><span>,<\/span><br \/>\n       Lyft<br \/>\n        LYFT,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/208999293\/composite\" class=\"negative\">-2.08%<\/bg-quote><br \/>\n       and others sought to exempt themselves from having to treat their drivers and delivery workers as employees. Prop. 22 was passed by 58% of California voters in November, but not before a state <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eals court had upheld a decision ordering Uber and Lyft to comply with AB 5. <\/p>\n<p>See: Uber and Lyft told to classify drivers as employees<\/p>\n<p>Gig companies are also facing other lawsuits over worker classification in the state and elsewhere, and under Thursday\u2019s ruling \u2014 which applies to cases that had not been settled before the Dynamex ruling in April 2018 \u2014 they could face liability if they lose those cases.<\/p>\n<p>Thursday\u2019s ruling was in response to a case brought by workers against Jan-Pro Franchising International, Inc.
