The notoriously litigious, self-described California sex addict best known for suing Twitch over masturbation injuries allegedly caused by the video streaming platform\u2019s \u201cscantily clad game<\/a>rs\u201d has a new target\u2014this time filing a lawsuit against Twitter, Rep. Alexandria Ocasio-Cortez and Rep. Ilhan Omar over the \u201coverbearing pain and suffering\u201d caused by the social media giant\u2019s ban of President Donald Trump.<\/p>\n

In an 11-page legal document<\/a> filed Tuesday in the Northern District of California, Erik Estavillo argues that he is entitled to $88.7 million in compensation, the reinstatement of Trump\u2019s account and a retaliatory ban of both AOC and Omar, who he says use the platform to \u201cpromote eastern communist philosophies.\u201d<\/p>\n

Estavillo, who is representing himself in the case, claims in the filing to have run for Congress himself last year and says that due to a variety of ailments \u2014 which include depression, agoraphobia, Crohn\u2019s disease and OCD \u2014 he has \u201cno friends\u201d and relies on social media as his only way of participating in political discourse.\u00a0<\/p>\n

\u201cThe Americans with Disabilities Act should protect him from such egregious behavior on the part of Twitter,\u201d according to the lawsuit. \u201cHe has nowhere else to voice his first amendment rights to free speech.\u201d<\/p>\n

The crux of his legal claim app<\/a>ears to center around the idea that being on Twitter is comparable to living in a \u201ccompany town,\u201d such as Pullman, Illinois, or Hershey, Pennsylvania, that he physically cannot leave. The suit cites case law from the 1946 ruling in Marsh v. Alabama.<\/em><\/p>\n

In an exclusive statement to The Post, Estavillo said he is a Democrat and supported Bernie Sanders in last year\u2019s primary election, but sees this lawsuit as a way to protect the American people\u2019s first amendment rights online.<\/p>\n

\u201cWe are not China and we shouldn\u2019t aspire to be,\u201d he said. \u201cLet\u2019s do what\u2019s right so we can all sleep well at the end of the day.\u201d<\/p>\n

Estavillo also says he\u2019s planning to file more lawsuits against other social media companies that have since given Trump the boot.\u00a0<\/p>\n

On the flipside, the lawsuit also argues that AOC and Ilhan Omar\u2019s incendiary posting style and public personas have damaged his \u201cpsyche\u201d \u2014 and that they should be banned from the platform as a result.<\/p>\n

Among the many claims meant to demonstrate why the pair of \u201cSquad\u201d members should have their accounts purged, Estavillo appears to contend that one reason is AOC\u2019s reluctance to date him.<\/p>\n

\u201cAOC even has a white boyfriend but would never think of dating a Mexican like the plaintiff,\u201d the suit reads. \u201cThey\u2019re hypocrites.\u201d<\/p>\n

Estavillo says that line was simply meant to \u201chighlight that I believe not everyone is who they say they are.\u201d<\/p>\n

He also notes that in a recent Twitch appearance Ilhan Omar\u2019s computer system appeared \u201chighly expensive,\u201d something that \u201cmost poor and disenfranchised people can\u2019t afford, even before the COVID-19 pandemic.\u201d<\/p>\n

Representatives for Rep. Ocasio-Cortez and Rep. Omar did not immediately respond to a request for comment\u2014though Omar tweeted Tuesday, \u201cBless their heart\u201d in response to news<\/a> of the suit. A spokesperson for Twitter told the Post the company had \u201cno comment at this time.\u201d<\/p>\n

Estavillo has also filed unsuccessful lawsuits against Microsoft, Sony, Nintendo, and Blizzard Entertainment in the past, according to The Sun<\/a>.<\/p>\n

In response to critics who describe these lawsuits as stunts, Estavillo said \u201cIt\u2019s all about perspective.\u201d<\/p>\n

\u201cThe thing about lawsuits is\u2014what\u2019s frivolous to one person, is not frivolous to another.\u201d\n <\/p><\/div>\n
