{"id":17117,"date":"2020-06-29T04:04:00","date_gmt":"2020-06-29T01:04:00","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/nyc-first-responders-sue-ambulance-operator-for-pay-and-work-violations\/"},"modified":"2020-06-29T04:04:00","modified_gmt":"2020-06-29T01:04:00","slug":"nyc-first-responders-sue-ambulance-operator-for-pay-and-work-violations","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/nyc-first-responders-sue-ambulance-operator-for-pay-and-work-violations\/","title":{"rendered":"#NYC first responders sue ambulance operator for pay and work violations"},"content":{"rendered":"<p>&#8220;<strong>#NYC first responders sue ambulance operator for pay and work violations<\/strong>&#8221;<\/p>\n<div id=\"article-wrapper\" role=\"main\">\n<div>\n<div>\n<p>        June 28, 2020 <span>|<\/span> 9:04pm         <\/p>\n<div id=\"featured-image-wrapper\">\n                        Enlarge Image<\/p>\n<p><img decoding=\"async\" alt=\"James Richard is lead plaintiff of a group of EMTs and paramedics who are suing private ambulance company Ambulnz for controlling their NYC deployments and then not paying them.\" id=\"standard-article-image\"  src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2020\/06\/JamesRichard.jpg?quality=90&#038;strip=all&#038;w=618&#038;h=410&#038;crop=1\" ><\/img><br \/>\n                <span>James Richard is lead plaintiff of a group of EMTs and paramedics who are suing private ambulance company Ambulnz for controlling their NYC deployments and then not paying them.<br \/>\n<\/span><br \/>\n                            <span>James Richard<\/span><\/p><\/div>\n<div>\n                        Out-of-state EMTs and paramedics who risked their lives to help New Yorkers during the coronavirus crisis say the FEMA subcontractor that hired them controlled every second of their deployment, including their sex lives \u2014 and then refused to pay them for all of their time.<\/p>\n<p>According to a stunning lawsuit filed in Brooklyn state court, private ambulance operator Ambulnz promised the group of first responders it recruited back in March it \u201cwould be paid for 24-hours a day, 7-days a week\u201d for deploying to the city as the COVID-19 cases began skyrocketing.<\/p>\n<p>But Ambulnz went back on its word after the recruits arrived, including by refusing to pay people for the time it took to drive their ambulances to NYC, according to the suit.<\/p>\n<p>Once in the Big <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>le, Ambulnz told the recruits \u201cto remain in their hotel rooms at all times when not on shift,\u201d the lawsuit said, and were ordered to refrain from \u201cconsuming alcohol or engaging in any sexual activity while at their hotel, in order to remain \u2018on call\u2019 for any emergencies.\u201d<\/p>\n<p>Those who disobeyed faced punishment, including possible termination, according to the suit. Ambulnz even placed a security guard in the hotel lobby and required its workers to carry GPS devices to ensure they stayed put, the lawsuit said.<\/p>\n<p>In an interview with The Post, lead plaintiff James Richard said he worked seven days a week for the month of April, responding to heart attacks, gunshot incidents and COVID-19 cases while helping the fire department respond to 911 calls. When he wasn\u2019t working, Richard said he was awakened by blaring calls on his emergency-responder radio, which he was required to have with him at all times.<\/p>\n<p>The 29-year-old EMT from Murfreesboro, Tenn., said he only learned of the company\u2019s actual pay policy about two weeks into his stint when he was given a document showing that his pay \u2014 1.25 times his regular pay, plus overtime, for seven 12-hour shifts a week \u2014 would be less than other FEMA responders.<\/p>\n<p>Richard was told he could accept the terms or go home, he said. \u201cI didn\u2019t want to leave New York in that state,\u201d Richard said about the city\u2019s massive COVID-19 caseload. \u201cMorally, I couldn\u2019t do that.\u201d<\/p>\n<p>FEMA declined to provide information about its pay requirements, but the lawsuit claims that all other ambulance services companies contracted by FEMA during this time paid their EMTs and paramedics for 24\/7 shifts.<\/p>\n<figure id=\"attachment_15906018\"><img alt=\"An ambulance for Ambulnz, with a mourning band across the company logo in remembrance of paramedic Paul Cary of Colorado, who died from coronavirus while volunteering for a FEMA assignment to New York City.\" data- data- height=\"441\" width=\"662\"><\/img><figcaption><span>An ambulance for Ambulnz, with a mourning band across the company logo in remembrance of paramedic Paul Cary of Colorado, who died from coronavirus while volunteering for a FEMA assignment to New York City.<\/span><span>Taidgh Barron\/NY Post    <\/span><\/figcaption><\/figure>\n<p>Once its workers returned home, Ambulnz asked them to sign <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a>-release agreements giving up their right to recover unpaid wages, said Sally Abrahamson, the group\u2019s lawyer.
