Gov. Andrew Cuomo\u2019s cover-up of nursing home deaths from COVID-19 could lead to federal criminal charges, a former assistant attorney general<\/a> has warned.<\/p>\n

In an op-ed for the Wall Street Journal<\/a>, John Daukas \u2014 who was acting attorney general for the Justice Department\u2019s Civil Rights Division under President Trump \u2014 insisted that the multi-agency probe was \u201cserious, perhaps meriting federal criminal charges.\u201d<\/p>\n

Daukas said Cuomo\u2019s executive order last March requiring New York nursing homes to admit hospitalized patients who had tested positive for COVID-19 \u201cled to many more tragic and unnecessary deaths than were reported to the public.\u201d<\/p>\n

\u201cAnd his administration app<\/a>ears to have engaged in a coverup designed to frustrate the federal government\u2019s oversight efforts,\u201d Daukas wrote in the op-ed posted late Sunday.<\/p>\n

\u201cNew York\u2019s apparently false statements about nursing-home deaths misled public-health officials across the country at a time when they were trying to develop strategies to battle a deadly pandemic,\u201d he wrote.<\/p>\n

Worse, he pointed to The Post\u2019s report on how Cuomo\u2019s top aide, Melissa DeRosa, admitted that the true death toll being hidden out of fear the figures would \u201cbe used against us\u201d by prosecutors.<\/p>\n

\u201cMs. DeRosa\u2019s reported admissions indicate the Cuomo administration\u2019s conduct wasn\u2019t merely negligent, but intentional and perhaps criminal,\u201d Daukas wrote.<\/p>\n

\u201cNumerous federal criminal statutes could apply,\u201d he warned.<\/p>\n

\u201cIt\u2019s a crime to make false statements to the federal government. It\u2019s also a crime to conceal information and otherwise obstruct government investigations.<\/p>\n

\u201cNew York may have engaged in a conspiracy to defraud the U.S. and its agencies and possibly obstruct justice, among other crimes,\u201d he stressed.<\/p>\n

\u201cEven if it cannot be proved that the Cuomo administration knowingly provided false information to Justice and [Centers for Medicare and Medicaid Services], New York\u2019s willful failure to provide information may itself constitute a criminal offense \u2014 particularly if the intent was to thwart a federal investigation \u2014 which, after all, is exactly what Ms. DeRosa reportedly said the administration did,\u201d he wrote.\n <\/p><\/div>\n
