A prosecutor in Michigan suggested that Gov. Gretchen Whitmer could face criminal charges over her handling of deaths at nursing homes in the early days of the coronavirus pandemic as the state attorney general<\/a> launched a probe into the fatalities.<\/p>\n

The news<\/a> comes as Republicans in the Michigan legislature said they will hold hearings into a $155,000 confidential separation agreement made to former Health Department director Robert Gordon amid accusations that it may be a \u201chush payment.\u201d<\/p>\n

Macomb County prosecutor Peter Lucido said he\u2019s unable to get information about the deaths at nursing homes and long-term care facilities because of strict laws that shield \u200bpatients\u2019\u00a0health care information.<\/p>\n

\u201cIf we find there\u2019s been willful neglect of office, if we find there\u2019s been reckless endangerment of a person\u2019s life by bringing them in, then we would move forward with charges against the Governor. Of course, we would. Nobody\u2019s above the law in this state,\u201d Lucido told ABC 7 WXYZ<\/a> on Monday.<\/p>\n

The questions surrounding \u200bWhitmer over the\u00a0nursing home deaths are similar to the scandal swirling around New York Gov. Andrew Cuomo that even before his mounting sexual harassment scandal had prompted calls for him to step down or be impeached.<\/p>\n

The embattled governor is also dogged by accusations from five women that he sexually harassed them by inapp<\/a>ropriately touching or kissing them, and by making improper comments to them.\u200b<\/p>\n

Whitmer, in an interview on CNN Sunday, said she supports an independent investigation into her\u00a0fellow Democratic governor.<\/p>\n

\u201cI think the allegations here are very serious and need to be taken seriously. And I do think that an impartial, thorough, independent investigation is merited and appropriate,\u201d she said on \u201cState of the Union.\u200b\u201d\u200b\u200b<\/p>\n

Michigan Attorney General Dana Nessel will examine the state coronavirus nursing home policies,\u00a0according to ClickonDetroit.com.\u200b\u200b<\/a><\/p>\n

Whitmer\u2019s office blasted Lucido in a statement to WXYZ, calling his comments\u00a0\u201cshameful political attacks based in neither fact or reality.\u201d\u00a0<\/p>\n

The statement also said \u200bLucido\u2019s\u00a0Republican colleagues \u200bconfirmed they\u00a0\u201chave not seen any evidence or testimony that says that a nursing home was forced to take someone against their will.\u201d\u200b<\/p>\n

Her office said the state \u201cprioritized testing\u201d of nursing home staff and residents \u201cto save lives.\u201d<\/p>\n

\u201cEarly in the pandemic, the state acted swiftly to create a network of regional hubs with isolation units and adequate PPE to prevent the spread of COVID-19 within a facility. In addition, we have offered 100 percent of nursing home residents priority access to the vaccine. Both the former head of AARP, as well as an independent U-M study, praised our work to save lives in nursing homes\u200b,\u201d the statement said.\u200b<\/p>\n

Michigan House Oversight\u00a0Chairman Steve Johnson, a Republican, said he wants answers from Whitmer on the nursing home deaths and the payment to the former health director.<\/p>\n

\u201cWe have invited the department to come and testify before our oversight committee\u200b. They have refused to\u200b.\u200b\u00a0\u200bW\u200be\u2019ve asked them to share with us the data with the nursing home deaths. \u200bT\u200bhey refuse that. And now we see that the governor has paid the former health department director Robert Gordon $155,000 to stay quiet\u200b, w\u200bhich begs the question\u200b:\u200b what are they trying to hide\u200b,\u201d he told Fox News.<\/a><\/p>\n

He said Michigan, like New York, was among the states that \u201cforced COVID patients\u201d into nursing homes, \u201cjust like what you saw in New York, Gov. Cuomo.\u201d\u200b<\/p>\n

\u201cThat happened here, and they hi\u200bd\u200b the numbers in New York and nursing home deaths, and that\u2019s the question here, are they hiding the numbers\u200b,\u201d Johnson said.\u00a0<\/p>\n

Whitmer denied that Gordon, who resigned in January, received a payment to stay quiet.<\/p>\n

\u201cI really bristle at that characterization. It is the nature of a separation agreement, when someone in a leadership position leaves \u2026 that there are terms to it and you can\u2019t share every term to it. That\u2019s simply what it is,\u201d Whitmer told reporters at a news conference earlier this month, the Detroit Free Press <\/a>reported.<\/p>\n

But she would not address why Gordon resigned or why taxpayer money was used for a separation agreement that remains confidential.<\/p>\n

J\u200bohnson said he had the same questions.\u200b<\/p>\n

\u201cThis is not something that\u2019s common, not something that we\u2019ve seen here in state government before. \u200bI\u200bf it is so common\u200b,\u200b\u00a0\u200bt\u200bhen why were\u200bn\u2019t\u200b they open \u200bto \u200bthe public about it,\u201d he said.\u200b<\/p>\n

Whitmer\u2019s office didn\u2019t immedia<\/a>tely respond to The Post\u2019s request for comment about the nursing homes and the separation payment.\u200b\n <\/p><\/div>\n
