But Kevin spent 14 months in a crammed jail with 13 other cellmates and went to trial in April 2016. After another five months in detention, he was convicted on the trumped up charges, and handed an eight-year prison term.<\/p>\n<p>Then, two days after his sentencing, Garratt was abruptly deported back to Canada.<\/p>\n<p>The entire proceeding <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ears to have been retaliation for Canada\u2019s decision to arrest a Chinese businessman, Su Bin, and extradite him to the U.S., where he eventually pled guilty to hacking into the computer systems of U.S. defence contractors.<\/p>\n<p>The parallels between the Garratts\u2019 story and that of Michael Spavor and Michael Kovrig are undeniable. Unfortunately for the two Michaels, they appear to be the tit-for-tat retribution for the arrest of Meng Wanzhou, the chief financial officer of Huawei and a far more high-profile Chinese citizen than Su Bin was. She is far less likely to plead guilty.<\/p>\n<p>The Garratts now live in B.C.\u2019s Lower Mainland, and Kevin has\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.twotearsonthewindow.com\/\">written a book about his ordeal.<\/a>\u00a0He spoke to\u00a0<em>Maclean\u2019s <\/em>writer Michael Fraiman on the eve of the trial of Michael Spavor, which takes place on Friday morning, local time, in Dandong, China. Kovrig\u2019s trial is set for Monday.<\/p>\n<hr\/>\n<h3><span class=\"ez-toc-section\" id=\"Just_before_we_started_recording_you_were_saying_Michael_Spavor_will_be_in_the_same_courtroom_that_you_were\"><\/span><strong>Just before we started recording, you were saying Michael Spavor will be in the same courtroom that you were.<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Yeah, he was in the same prison I was in, just down the hall from where I was. I understand he was in cell 315\u2014I was in 318. There\u2019s only one court building in town, so that would be where he goes.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"What_do_you_think_is_going_through_the_Michaels_minds_right_now_on_the_eve_of_this_trial\"><\/span><strong>What do you think is going through the Michaels\u2019 minds right now, on the eve of this trial?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Probably a couple of things. One would be hope that the trial will solve things. But the problem in China is, with trials, you\u2019re presumed guilty\u2014you\u2019re not presumed innocent\u2014there\u2019s a 99.9 per cent chance of conviction. So, basically, they\u2019ll be convicted.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"So_what_is_the_point_of_having_a_trial\"><\/span><strong>So what is the point of having a trial?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>To say they follow the law, their own law. And to say, \u201cYes, they were guilty. Yes, they did this, according to our law.\u201d<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Could_you_describe_the_trial_experience_a_little_bit\"><\/span><strong>Could you describe the trial experience a little bit?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The trial was set for, I believe, around 9 o\u2019clock in the morning on April 20. They took me there, probably around eight, took me in handcuffs and leg irons, and put me in a van with two officers. And then I\u2019m taken into the court building area, we go up in an elevator to a kind of a waiting area just for prisoners. You\u2019re put in a little, tiny room, like a little closet that\u2019s padded and has a bar door on it. And you wait there until it\u2019s time to take you to the courtroom.<\/p>\n<p>Then I was taken to an older looking courtroom. They brought a camera and the guy was setting up when we got there. I was set aside in the middle of the courtroom, basically by myself on a chair. In front of me were three judges\u2014a main judge and two junior judges, I guess. To my left were two prosecutors, also very young-looking, and an interpreter. To my right was my lawyer\u2014who, actually, I couldn\u2019t talk to during the trial. It was very confusing, what I could and couldn\u2019t do. Mostly I couldn\u2019t do anything.<\/p>\n<p>The trial went on all day. There was a lunch break, and I was put back into the padded room for about an hour and a half or so, then back to the court. Then, the same kind of thing. I didn\u2019t understand everything that was going on, like the technical language, which I couldn\u2019t pick up on. At the end of the day, I have to go over the transcripts and approve them. You know: \u201cIs this what was said?\u201d And I said, \u201cWell, yeah, it could be, I don\u2019t know.\u201d<\/p>\n<p>Then I was put back into the van and went back to the prison, probably around 5:30 or 6 o\u2019clock in the evening. And that was the the whole day. When you realize that the outcome was already decided, it\u2019s kind of like, \u201cSo why are we here?\u201d But you still have that hope, right? You still have hope something will happen.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"What_kind_of_defence_does_your_lawyer_make\"><\/span><strong>What kind of defence does your lawyer make?\u00a0<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Because it\u2019s what they call a \u201cnational security\u201d case, the lawyers can\u2019t do much. They can say, \u201cOh, he really didn\u2019t mean to do anything.\u201d Or, \u201cYou know, maybe some pictures he took were sensitive, but he had no idea.\u201d You know, \u201cHe\u2019s he\u2019s very repentant,\u201d or something like that. He can\u2019t do a whole lot, but he can try.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"How_long_was_your_trial_in_total\"><\/span><strong>How long was your trial in total?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Nine to five, basically. But I saw 80 or 90 people pass through my cell in those 19 months I was there. There\u2019s 14 people [at a time] in the cell. I saw people leave at 8 o\u2019clock in the morning and be back by 10. Guilty. They\u2019ll be shipped off to the big prison. There\u2019s a formality.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"The_charge_of_espionage%E2%80%94its_the_same_for_them_as_it_was_for_you%E2%80%94does_this_change_the_nature_of_the_trial_system_as_far_as_you_know\"><\/span><strong>The charge of espionage\u2014it\u2019s the same for them as it was for you\u2014does this change the nature of the trial system, as far as you know?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>I just know they have the choice to make it a public trial or a closed trial. A closed trial is good, because that means they want it to kind of just go away\u2014they will make their decision, and it sort of goes away. (<em>Editor\u2019s note: Michael Spavor <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theglobeandmail.com\/world\/article-no-information-no-foreign-observers-china-will-conduct-secret-trials\/\">will have a closed trial,<\/a>\u00a0as did Garratt.)<\/em>\u00a0If it\u2019s an open trial, then they\u2019re making a statement. There\u2019ll be witnesses and the government will want to make it very, very public. And when the defendants will be found guilty, it\u2019ll be on national TV, things like that.<\/p>\n<p>I also want to say that with the trial, I was really very nervous and quite afraid, because I didn\u2019t know what to expect. I\u2019ve seen trials on TV, but they\u2019re not the same at all, especially when you have three judges staring down at you from a platform and you don\u2019t understand the proceedings. You don\u2019t really get a chance to talk, you can\u2019t talk to your lawyer. It\u2019s very upsetting, that way. That was very evident in the prison, itself. Every once in a while, the warden would come on the loudspeaker, they would give a little talk. And basically, they would say, \u201cSuck it up, you\u2019re here for a reason, take your punishment.\u201d Meaning, you\u2019re guilty, so why are you crying? Why are you upset? Why are you complaining? Just deal with it.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Lets_talk_a_little_bit_about_what_happens_next_The_Michaels_will_be_convicted_almost_certainly_What_is_the_process_for_what_takes_place_after_that\"><\/span><strong>Let\u2019s talk a little bit about what happens next. The Michaels will be convicted, almost certainly. What is the process for what takes place after that?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>You can appeal, and I\u2019d seen a few people in my prison appeal. I was advised not to , because that would mean many, many more months in prison waiting for the next court appearance. That\u2019s the advice I took\u2014which is not admitting guilt. It\u2019s just saying, \u201cI just want to get out of here.\u201d I didn\u2019t know I would be deported, that was almost five months later.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Does_the_appeal_process_change_the_outcome_very_often\"><\/span><strong>Does the appeal process change the outcome very often?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Sometimes, a little bit. I saw sentences go down from 10 years to five years. In my case, since it was an international case and more public, it wouldn\u2019t change anything. Or it might be worse.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"What_do_you_think_will_happen_next_Do_you_think_they_will_get_deported_Could_this_be_a_longer-term_prison_sentence_until_the_Meng_Wanzhou_situation_is_figured_out\"><\/span><strong>What do you think will happen next? Do you think they will get deported? Could this be a longer-term prison sentence until the Meng Wanzhou situation is figured out?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>I think until Meng Wanzhou is figured out, it\u2019ll probably keep going. My actual verdict hearing didn\u2019t come until almost five months after the trial. My lawyer had said, \u201cI expect something in two to three weeks.\u201d Knowing China, I thought, oh, maybe four to six weeks. And then it was five months. They can delay and delay and delay as much as they want. I met one guy in prison who had been there probably six years, still waiting to go through his appeal.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"So_in_that_light_knowing_that_it_could_even_be_many_more_months_until_a_verdict_is_reached_or_theyre_deported_this_trial_means_even_less\"><\/span><strong>So in that light, knowing that it could even be many more months until a verdict is reached, or they\u2019re deported, this trial means even less.<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The government has the freedom to do what they want, when they want to do it. They don\u2019t have to wait. They can deport them. They could put them in prison\u2014an actual prison, since what they\u2019re in now is basically a detention centre, which is almost the same as prison. But once you get to a local prison, then you\u2019re actually working.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"So_even_weeks_after_this_trial_it_may_still_be_status_quo_for_them\"><\/span><strong>So even weeks after this trial, it may still be status quo for them.<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>My guess is it will be, until something positive happens with Meng Wanzhou. If she gets extradited to the U.S., I don\u2019t know how well it will go for the Michaels. I just can\u2019t guess that.
