“# Nexo faces lawsuit for liquidating $5m in client collateral amid XRP delisting <\/strong>”

United States-based crypto lending platform Nexo is facing a class-action lawsuit over suspension of XRP services on Dec. 23, 2020. <\/p>\n

Lead plaintiff, California resident Junhan Jeong submitted the complaint on April 1. The complaint accuses Nexo of breaching its user agreement by suspending the use of XRP as loan collateral without notifying its customers beforehand. The suspension followed the SEC\u2019s legal action against Ripple Labs for conducting unregistered securities offerings on December 22.<\/p>\n

Nexo allows users to borrow fiat currency or stablecoins using over-collateralized loans that are backed by crypto assets. Should price fluctuations in the crypto markets cause loans to no longer meet the platform\u2019s required loan-to-value, or LTV, ratio, the complaint cites Nexo\u2019s terms of service as stating that \u201cNexo will \u2014 after providing notice to the customer \u2014 sell the collateral to bring the LTV ratio back in line.\u201d<\/p>\n

Jeong alleges that Nexos reacted to the SEC\u2019s announcement by suspending the use of XRP as collateral, to pay down loans, and for staking on Dec. 23. As a result, many users were left unable to support their loan positions, prompting wholesale liquidations across the platform.<\/p>\n

Further, the plaintiff alleges Nexo \u201cunjustifiably\u201d sold off customers\u2019 XRP and pocketed the proceeds, stating:<\/p>\n

“Seeing the price of XRP thus drop significantly, on December 23, Nexo suspended customers\u2019 use of XRP to stake as collateral or pay down on loans and did so without providing notice of the suspension. Nexo did so because it did not want to be left holding XRP at its substantially decreased value\u2014not because Nexo believed that the SEC\u2019s announcement counseled against the use or sale of XRP.”<\/p><\/blockquote>\n

According to the lawsuit, Nexo\u2019s suspension resulted in the liquidation of more than $5 million worth of its customers’ assets.\u00a0The plaintiff also alleges that Nexo\u2019s XRP liquidations contradicted the company\u2019s claim it doesn\u2019t possess ownership rights of users\u2019 collateral.<\/p>\n

Jeong is seeking restitution for the alleged losses incurred from the XRP suspension, along with an order declaring Nexo\u2019s contractual rights:<\/p>\n

\u201cDeclaration regarding the parties\u2019 contractual rights is necessary because the rights and obligations at issue are central to the very operation and use of the Nexo Crypto Credit, and because Nexo\u2019s public statements demonstrate that the parties have a fixed and genuine dispute over those rights and obligations.\u201d<\/p><\/blockquote>\n

Nexo is yet to comment on the accusations, however, the platform recently filed<\/a> a defamation lawsuit against its former customer, <\/strong>Lance Johansen, over multiple negative reviews the defendant published on review platform Trustpilot in early 2021. <\/p>\n

In particular, Nexo is taking aim at Johansen’s comments claiming the platform is operated by an ex-felon, uses bot accounts to disseminate fake news<\/a>, and that it purposely \u201crobbed all XRP owners blind\u201d through its suspension of the token.<\/p>\n
