Virginia Olthoff had lived there for 15 years, and the administration communicated frequently with her family about her care.<\/p>\n<div class=\"paywall\">\n<p>Then Olthoff-Blank got a 3 a.m. call from an emergency room nurse. She learned, to her horror, that her mother was severely dehydrated. An ER physician told her, \u201cThis did not just h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>en.\u201d He believed her mother had been without water for four or five days.\u00a0<\/p>\n<p>Several hours later, Virginia Olthoff was dead.<\/p>\n<p>Her daughter recounted the events in testimony before the Senate Finance Committee in March 2019, telling them a Department of Inspections and Appeals report revealed her mother had not been eating or drinking for almost two weeks and had not received IV fluids. She had been crying out in pain and had lost considerable weight.\u00a0<\/p>\n<p>Despite repeated pleas by certified nursing assistants to their superiors about her mother\u2019s condition, \u201cnothing was done,\u201d Olthoff-Blank said.\u00a0<\/p>\n<p>The pandemic has exacerbated and raised awareness about the poor conditions in many nursing homes nationwide. But those conditions existed before COVID-19 hit the U.S., and they are likely to continue unless changes are made, experts say.\u00a0<\/p>\n<p>\u201cThere\u2019s an opportunity right now, because there are a lot of eyes on the nursing home sector,\u201d said David Grabowski, professor of healthcare policy at Harvard Medical School. \u201cOne of my big concerns is as things return to normal \u2026 [people will say] we can go back to business as usual. Business as usual wasn\u2019t working before the pandemic, and it certainly didn\u2019t work during the pandemic. We need to make some real changes here.\u201d<\/p>\n<p>What set nursing homes up to fail so dramatically during the pandemic? Experts point to five main factors.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"1_Staffing\"><\/span><strong>1. Staffing<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Chronic staffing shortages in nursing homes stretch existing staff to breaking points. These jobs of frontline workers, like certified nursing assistants (CNAs), are often as difficult as retail and fast food and usually pay less (the\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.salary.com\/research\/salary\/benchmark\/certified-nursing-assistant-nursing-home-salary\" class=\"icon none\">average annual income<\/a>\u00a0for a CNA in a nursing home is $28,450). The result? Employees don\u2019t stick around.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>\u201cWe found turnover rates of over 100% in a calendar year, meaning basically the entire staff turns over each year \u2014 and some nursing homes have turnover as high as three hundred percent,\u201d Grabowski said, referring to a\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.healthaffairs.org\/doi\/10.1377\/hlthaff.2020.00957\" class=\"icon none\">study<\/a>\u00a0he and colleagues published March 2021 in Health Affairs.\u00a0<\/p>\n<p>\u201cWe don\u2019t pay those direct caregivers enough,\u201d he said. \u201cThey\u2019re largely women, many are persons of color and immigrants, and they\u2019re overlooked in a lot of ways in terms of where we direct resources in our healthcare system.\u201d<\/p>\n<p>Inadequate staffing has a direct impact on residents, who may not only get poor care but cannot develop relationships with workers when they are there one day and gone another, Grabowski said.<\/p>\n<p>\u201cYou talk to the residents and you ask them, \u2018What is it about this nursing home that you liked or didn\u2019t like?\u2019 and it\u2019s always about the staff,\u201d he said.<\/p>\n<p>Staffing at the professional nurse level is also vital, said Charlene Harrington, professor emerita of <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social<\/a> behavioral <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/sciencee\/\" data-internallinksmanager029f6b8e52c=\"5\" title=\"Science\" target=\"_blank\" rel=\"noopener\">science<\/a>s in the School of Nursing at the University of California, San Francisco.<\/p>\n<p>Harrington joined 21 other nursing experts in\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/journals.lww.com\/ajnonline\/Fulltext\/2021\/03000\/A_Call_to_the_CMS__Mandate_Adequate_Professional.19.aspx\" class=\"icon none\">publishing a call<\/a>\u00a0to the Centers for Medicare and Medicaid Services (CMS) in March for a federal mandate for a stronger presence of registered nurses (RNs) in nursing homes.<\/p>\n<p>CMS staffing rules currently call for one RN on duty at a nursing home for eight consecutive hours each day. Harrington and her colleagues said that should be increased to a 24-hour, seven-day on-site RN presence. There are no federal ratios for staff of any level.<\/p>\n<p>\u201cIt\u2019s pure ageism that you can warehouse older people and not have to get adequate staff and pay them so that they\u2019re competent and have experience,\u201d Harrington said.<\/p>\n<p>Pamela Mickens, a long-term care ombudsman in Dallas, said she sees the impact of inadequate staffing daily. But a comment by a resident\u2019s family member crystallized the issue of staffing standards for her.<\/p>\n<p>The family member worked in the prison system and pointed out that there are staffing ratios for inmates, but not for people in nursing homes, Mickens recalls.<\/p>\n<p>\u201cThat was an epiphany for me,\u201d she said.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"2_Funding\"><\/span><strong>2. Funding<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Medicaid covers more than\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ahcancal.org\/News-and-Communications\/Press-Releases\/Pages\/Financial-Struggle-of-Nursing-Homes-Puts-Medicaid-Reimbursement-Rates-Back-in-the-Spotlight.aspx\" class=\"icon none\">60% <\/a>of all nursing home residents, and Medicaid reimbursements cover 70% to 80% of nursing home operating costs, according to the American Health Care Association, an industry group. It points to that funding gap as the culprit in \u201cshoestring budgets.\u201d<\/p>\n<p>\u201cMedicaid is not a generous payer,\u201d Grabowski said. \u201cThe way most nursing homes have made things work is to take on these short-stay, post-acute patients who come from the hospital,\u201d since Medicare covers these patients for a limited time and at a much higher rate.<\/p>\n<p><strong>Don\u2019t miss: <\/strong>Best New Ideas in Retirement<\/p>\n<p>That creates incentives to hospitalize long-term patients and bring them back, Grabowski said. \u201cThe margins on that side of the business are really quite high.\u201d<\/p>\n<p>Harrington, of UCSF, said her research shows the nursing home payment model is not the problem.<\/p>\n<p>\u201cAll the nursing homes say they don\u2019t have enough money, but in reality they [for-profit nursing homes] make excessive profits on the backs of their poorly paid staff,\u201d she said.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"3_Corporate_structure\"><\/span><strong>3. Corporate structure<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Those profits, Harrington said, are hidden by the often Byzantine corporate structure that undergirds for-profit nursing homes, which make up 70% of the total.<\/p>\n<p>An\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/khn.org\/news\/care-suffers-as-more-nursing-homes-feed-money-into-corporate-webs\/\" class=\"icon none\">article<\/a>\u00a0from Kaiser Health <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> revealed it has become increasingly common for nursing homes to outsource goods or services to companies they control or have a financial interest in. Some even rent their buildings back from a sister corporation. The result: the owners can siphon off profits that are not reflected in the nursing homes\u2019 books.<\/p>\n<p>A related benefit for nursing homes is that, if they are sued, the plaintiffs often have a hard time collecting, since the assets are not held with the licensee, Kaiser reported.<\/p>\n<p>\u201cThey set up these complex structures, and they\u2019re pulling out so much money from their related party organizations \u2026 there\u2019s no money left for staffing and services,\u201d Harrington said. She advocates for greater transparency and financial accountability in nursing homes.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"4_Lack_of_oversight_and_enforcement\"><\/span><strong>4. Lack of oversight and enforcement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Nursing homes agree to follow minimum standards of care when they participate in Medicaid and Medicare programs. Federal\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=a7af2bde32b9a3760c6cc7b79b562e5e&amp;mc=true&amp;node=se42.5.483_124&amp;rgn=div8\" class=\"icon none\">regulations<\/a>\u00a0require that they \u201cprovide the necessary care and services to attain or maintain the highest practicable physical, mental and psychosocial well-being\u201d of their residents. That includes maintaining proper hydration \u2013 something Patricia Olthoff-Blank\u2019s mother certainly did not get.<\/p>\n<p>After Virginia Olthoff\u2019s death and that of another resident of the same nursing home,\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.desmoinesregister.com\/story\/news\/2018\/08\/03\/iowa-nursing-home-fined-patient-death\/902702002\/\" class=\"icon none\">CMS fined the facility<\/a>\u00a0$77,462, and the families sued.<\/p>\n<p>But federal action against nursing home neglect is frequently insufficient, and too many nursing homes are allowed to function while perennially falling below minimum standards and then bouncing back up.<\/p>\n<p><strong>Related: <\/strong>COVID-19 devastated nursing homes \u2014 here are safer, more cost-effective options<\/p>\n<p>\u201cThere\u2019s a segment of the industry that has what we call \u2018yo-yo compliance,\u2019 because they\u2019re constantly coming in and out of compliance,\u201d and rotating through various deficiencies, said Lori Smetanka, executive director of the National Consumer Voice for Quality Long-Term Care. \u201cAnd they\u2019re just not held accountable.\u201d<\/p>\n<p>\u201cWe see continued and routine noncompliance\u201d with laws and regulations, said Eric Carlson, directing attorney with Justice in Aging, a nonprofit that fights against poverty among older Americans. \u201cThere are facilities that have business practices that are inconsistent with the law \u2013 for example, they treat Medicaid patients more poorly, and there\u2019s a federal statute that says you can\u2019t discriminate based on reimbursement source.\u201d<\/p>\n<p>Too often, he said, CMS \u201cdoes not recognize the violation, or if it does recognize it, it doesn\u2019t impose a penalty.\u201d<\/p>\n<h6><span class=\"ez-toc-section\" id=\"5_Aging_buildings\"><\/span><strong>5.\u00a0Aging buildings<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>The physical environment of nursing homes has become another source of problems. Traditional nursing homes built 30, 40 or 50 years ago\u00a0were often modeled on hospitals, with long hallways and small, shared rooms.<\/p>\n<p>\u201cThere\u2019s a warehouse mentality that\u2019s communicated by that kind of floor plan and architecture,\u201d Carlson said. \u201cFor most people, our lives are not organized around our beds\u2026 we don\u2019t sleep three-feet away from strangers.\u201d<\/p>\n<p>The\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nextavenue.org\/reimagining-what-nursing-home-can-be\/\" class=\"icon none\">Green House<\/a>\u00a0model of nursing care and others like it, in contrast, consists of small-scale, homelike units limited to groups of 10 to 12 older adults, each with their own private room. These models often operate with a \u201cmore enlightened\u201d staffing arrangement, with nurse aides working consistently with the same residents, Carlson said.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"A_culture_change\"><\/span><strong>A culture change<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Mickens, the Texas ombudsman, said one ongoing challenge in nursing homes is a lack of acknowledgment that residents have rights.<\/p>\n<p>\u201cThey have a voice, and their voice and their preferences may be contrary to what the nursing home staff, to include the doctor, is wanting for them,\u201d she said.<\/p>\n<p>Even if it\u2019s something as simple as getting a shower at night instead of 6 in the morning, the nursing home must strive to include that preference in the resident\u2019s care plan. \u00a0<\/p>\n<p>Carlson agreed. He assembled a list, available through Justice in Aging, called\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/justiceinaging.org\/25-common-nursing-home-problems-how-to-resolve-them\/\" class=\"icon none\">25 Common Nursing Home Problems and How to Resolve Them<\/a>.<\/p>\n<p>In addition to enforcement, everyone involved in the system \u2013 from hospital discharge planners to staff to family members to the residents themselves \u2013 must have higher standards, Carlson said.<\/p>\n<p><strong>Read next: <\/strong>Want to age at home instead of a nursing home? If a facility says it is not going to honor a request \u201cbecause it\u2019s going to be too much of a hassle,\u201d Carlson noted, the consumer can say, \u201cNo. Unacceptable.\u201d<\/p>\n<p>It will take a culture change, he said. And if the facilities don\u2019t do it themselves, he added, consumers must say, \u201cWe\u2019re going to change your culture for you.
