“#Man charged with attacking undercover Asian NYPD cop released without bail<\/strong>”<\/p>\n

The man charged with trying to shove an Asian undercover cop onto Queens subway tracks was cut loose without bail Sunday \u2014 as the judge claimed, \u201cMy hands are tied.\u201d<\/p>\n

Suspect Richard Hernandez, 32 \u2014 who faces three hate-crime charges in the attack on the unnamed cop on a Long Island City train platform around 5:30 p.m. Saturday \u2014 even had an earlier open-container summons dismissed in court at the same time. <\/p>\n

At Hernandez\u2019s arraignment over the attempted push onto the tracks, Queens Supreme Court Justice Louis Nock said the state\u2019s bail-reform measures barred him from holding Hernandez in jail. <\/p>\n

\u201cMy hands are tied because under the new bail rules, I have absolutely no authority or power to set bail on this defendant for this alleged offense,\u201d the judge said.<\/p>\n

Under the new measures passed last year, attacks that cause no injury are exempt from bail in New York.<\/p>\n

The judge also agreed with Hernandez\u2019s lawyer to dismiss a warrant against the suspect involving a previous open-container summons. The suspect had had a can of Coors Light beer.<\/p>\n

Meanwhile, the cop assault came after another previous attack this month on an Asian undercover officer \u2014 in which the suspect also was almost immedia<\/a>tely freed.<\/p>\n

Hernandez, who lives near the subway station where the latest attempted shove took place, told The Post as he left court, \u201cI don\u2019t want to talk about this.\u201d<\/p>\n

According to police, Hernandez confronted the undercover cop on the N train platform at 31st Street and 39th Avenue in Dutch Kills and tried to shove him onto the tracks.<\/p>\n

\u201cThat\u2019s why you people are getting beat up,\u201d Hernandez allegedly snarled. \u201cI got nothing to lose.<\/p>\n

\u201cI will f\u2013k you up!\u201d Hernandez added, according to cops. \u201cThis is my house.\u201d<\/p>\n

He was arrested at the scene and charged with harassment, aggravated harassment and menacing \u2014 all classified as hate crimes.<\/p>\n

Meanwhile, on April 9, police said Juvian Rodriguez, 35, was busted after he told another Asian cop, \u201cGo back to China before you end up in a graveyard.\u201d<\/p>\n

\u201cI\u2019m gonna slap the holy piss out of you and stab you in the face,\u201d he allegedly added.<\/p>\n

Rodriguez was released fewer than 12 hours later.<\/p>\n

The incidents come as the city has seen a spike in attacks on Asian-Americans. <\/p><\/div>\n
