Pro-Trump businessman Mike Lindell on Monday escalated his legal fight with voting machine company Dominion Voting Systems, responding to its recent defamation case with a countersuit of his own.<\/p>\n

Lindell\u2019s privately owned company, My Pillow, sued Dominion in federal court in Minnesota, alleging a campaign to \u201csilence\u201d and \u201cpunish\u201d him for his claims about the election software company.<\/p>\n

The lawsuit came two months after Dominion brought a $1.3 billion dollar case against Lindell in federal court in Washington.<\/p>\n

\u201cThis is a meritless, retaliatory lawsuit, filed by My Pillow to try to distract from the harm it caused to Dominion,\u201d Stephen Shackelford, a lawyer for Dominion, said in a statement.<\/p>\n

Lindell, a staunch supporter of former President Donald Trump, financed post-election protest movements in a bid to overturn Democratic President Joe Biden\u2019s Nov. 3 victory.<\/p>\n

Lindell used his personal Twitter<\/a> account, which had nearly half a million followers before being suspended, and media app<\/a>earances to falsely claim that Dominion\u2019s voting machines rigged the election.<\/p>\n

Dominion\u2019s Feb. 22 lawsuit, which named both Lindell and Chaska, Minn.-based My Pillow as defendants, accused the businessman of launching a \u201cdefamatory marketing campaign about Dominion that reached millions of people and caused enormous harm to Dominion.\u201d<\/p>\n

The new My Pillow lawsuit said Dominion\u2019s litigation against him violates his right to free speech under the First Amendment of the US Constitution.<\/p>\n

Under US law, the First Amendment only applies to government officials and entities, not private companies. Lindell argues that Dominion, because of its role in helping administer elections, was acting \u201cunder color of law\u201d and should be viewed like a government entity.<\/p>\n

Jessica Levinson, a professor at Loyola Law School, said My Pillow\u2019s lawsuit showed a \u201cmisunderstanding\u201d of the First Amendment and would be dismissed.<\/p>\n

\u201cIt\u2019s an abuse of the court system,\u201d she said.\n <\/p><\/div>\n
