{"id":232282,"date":"2021-04-21T17:39:12","date_gmt":"2021-04-21T14:39:12","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/eus-proposed-ai-regulation-has-some-major-loopholes\/"},"modified":"2021-04-21T17:39:12","modified_gmt":"2021-04-21T14:39:12","slug":"eus-proposed-ai-regulation-has-some-major-loopholes","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/eus-proposed-ai-regulation-has-some-major-loopholes\/","title":{"rendered":"#EU\u2019s proposed AI regulation has some major loopholes"},"content":{"rendered":"<p>&#8220;<strong>#EU\u2019s proposed AI regulation has some major loopholes<\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/img-cdn.tnwcdn.com\/image?fit=796%2C417&amp;url=https%3A%2F%2Fcdn0.tnwcdn.com%2Fwp-content%2Fblogs.dir%2F1%2Ffiles%2F2021%2F04%2FUntitled-design-2021-04-21T151947.431.png&amp;signature=0d42325fc5e214a55a3928d851b881d0\" \/><\/p>\n<div>The European Commission plans\u00a0to ban the use of AI for <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social<\/a> credit scoring, exploitation of the vulnerable, and subliminal manipulation, as part of new proposals for regulating <span id=\"urn:enhancement-2\" class=\"textannotation disambiguated wl-thing\" itemid=\"http:\/\/data.thenextweb.com\/tnw\/entity\/artificial_intelligence\">artificial intelligence<\/span> in the EU.<\/p>\n<p><span>Police use of real-time biometric identification systems \u2014 such as facial recognition \u2014 will also be \u201cprohibited in principle,\u201d albeit with a rather <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_21_1682\">vague list of exemptions<\/a>.<\/span><\/p>\n<p>Judges can <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>rove their use\u00a0for finding victims of specific crimes, preventing terrorist attacks, and locating suspects or perpetrators of certain offenses.<\/p>\n<p><span>The rules follow \u201ca risk-based approach\u201d that categorizes\u00a0AI systems as unacceptable, high, limited, and minimal risk.\u00a0<\/span><span>Companies who break the rules will face fines of up to\u00a06% of their global revenue or\u00a0\u20ac30 million ($36 million), whichever figure is higher.<\/span><\/p>\n<p><em>[Read:\u00a03 new technologies ecommerce brands can use to connect better with customers]<\/em><\/p>\n<p>The Commission aims to create a \u201chuman-centric\u201d form of\u00a0regulation that provides a competitive advantage over the US and China.<\/p>\n<p>But the rules have been criticized, both by those who think they go too far, and those who think they don\u2019t go far enough.<\/p>\n<p>Advocates for stronger protections note that only four applications have been banned, while the prohibition of biometric systems comes with a range of exemptions. Furthermore, the \u201chigh risk\u201d category isn\u2019t clearly defined.<\/p>\n<p>Daniel Leufer, Europe policy analyst at digital rights group Access Now, said there are major loopholes in the rules.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\u2026and major loopholes remain.<\/p>\n<p>Most of civil society&#8217;s red lines are just listed as high risk, including predictive policing, post-hoc facial recognition (think Clearview AI) &amp; more<\/p>\n<p>We need bans on these, otherwise AI will not be a force for progress, but for social regression<\/p>\n<p>\u2014 Daniel Leufer (@djleufer) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/djleufer\/status\/1384817631929196544?ref_src=twsrc%5Etfw\">April 21, 2021<\/a><\/p>\n<\/blockquote>\n<p>Representatives of the US tech sector are also unhappy with the proposals.<\/p>\n<p>Benjamin Mueller, a senior policy analyst at the Center for Data Innovation, a think tank that gets funding from Google, Apple, Microsoft, and Facebook, was among the most vociferous critics. He\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/datainnovation.org\/2021\/04\/the-artificial-intelligence-act-is-a-threat-to-europes-digital-economy-and-will-hamstring-the-eus-technology-sector-in-the-global-marketplace\/\">said<\/a> the rules \u201cwill kneecap the EU\u2019s nascent AI industry before it can learn to walk.\u201d<\/p>\n<blockquote>\n<p>Rather than supercharge the European digital economy, this law will cause it to fall even further behind the United States and China.<\/p>\n<\/blockquote>\n<p>Mueller argued that the definition of AI is too expansive and that the requirements for high-risk systems would restrict many socially beneficial applications of the tech.\u00a0Unsurprisingly, he wants the EU to adopt a light-touch framework that\u2019s limited in scope.<\/p>\n<p>In its efforts to balance safety and innovation, the EU was always likely to displease both sides of the debate. However, the rules could still change and won\u2019t be implemented in the immediate future.<\/p>\n<p>The European Parliament and EU member states both need to approve the proposals before they become law, a process that can take years. Lobbyists will also be generously providing their own suggested tweaks to the rules.<\/p>\n<p>When the regulation finally becomes official, it might already be outdated.<\/p>\n<p><em style=\"font-size: 16px;\">Greetings Humanoids!
