A photo that recently emerged online of a juror on the Derek Chauvin murder trial wearing a Black Lives Matter T-shirt has sparked questions about his impartiality, according to reports.<\/p>\n

Juror Brandon Mitchell, 31, who is black, could be seen in the photo wearing the T-shirt emblazoned with a picture of Martin Luther King Jr. and the phrases \u201cGet your knee off our neck\u201d and \u201cBLM.\u201d He is also wearing a \u201cBlack Lives Matter\u201d hat in the photo.<\/p>\n

Mitchell was the first member of the jury that convicted Chauvin of murdering George Floyd to publicly comment about the trial.<\/p>\n

In a Monday interview with the Star Tribune<\/a>, Mitchell said the photo is from a rally in Washington, DC, last summer commemorating Martin Luther King Jr.\u2019s famous 1963 \u201cI Have a Dream\u201d speech.<\/p>\n

Mitchell told the news<\/a>paper his uncle had posted the photo to social media<\/a>.<\/p>\n

The juror insisted the DC march had nothing to do with George Floyd.<\/p>\n

\u201cIt was directly related to MLK\u2019s March on Washington from the \u201960s \u2026 The date of the March on Washington is the date,\u201d he told the newspaper.<\/p>\n

\u201cI\u2019d never been to [Washington] D.C.,\u201d Mitchell said in explaining why we attended the rally.<\/p>\n

\u201cThe opportunity to go to D.C., the opportunity to be around thousands and thousands of Black people; I just thought it was a good opportunity to be a part of something.\u201d<\/p>\n

During the jury selection process, each prospective juror is required to answer a questionnaire which includes questions about participation in demonstrations and protests.<\/p>\n

\u201cDid you, or someone close to you, participate in any of the demonstrations or marches against police brutality that took place in Minneapolis after George Floyd\u2019s death?\u201d one question read, according to the newspaper.<\/p>\n

The other asked: \u201cOther than what you have already described above, have you, or anyone close to you, participated in protests about police use of force or police brutality?\u201d<\/p>\n

Mitchell told the Tribune that he replied \u201cno\u201d to both questions.<\/p>\n

\u201cI think I was being extremely honest, for sure,\u201d Mitchell said of the jury selection process. \u201cI gave my views on everything \u2014 on the case, on Black Lives Matter.\u201d<\/p>\n

Jury consultant Alan Tuerkheimer told The Washington Post<\/a> that Mitchell\u2019s questionnaire answers could lead to an app<\/a>eal by Chauvin\u2019s attorney. The judge could also call in Mitchell for questioning, Tuerkheimer said.<\/p>\n

\u201cThat could change the outcome of things; if there is anything that makes him seem that he was not forthcoming, it could be an avenue for the judge to reconsider the case,\u201d Tuerkheimer told the newspaper.<\/p>\n

Meanwhile, civil rights attorney Brian Dunn told The Washington Post that the photo is \u201cundeniably suggestive of a possible bias in this juror.\u201d<\/p>\n

Dunn said a more detailed review would be needed to determine if Mitchell \u201clied about, or failed to provide complete answers on whether he has engaged in public activism.\u201d<\/p>\n

\u201cIf it is determined that the juror did not provide full disclosure to the defense, the question then becomes whether this lack of candor violated Mr. Chauvin\u2019s right to a fair trial,\u201d Dunn said.\n <\/p><\/div>\n
