MONTGOMERY, Ala. \u2014 An Alabama state trooper arrested last week on charges he raped an 11-year-old girl had been kicked out of the FBI amid a string of sexual misconduct allegations but was hired by the state agency with the app<\/a>arent help of a fake bureau letter that scrubbed his record clean.<\/p>\n

An Associated Press investigation found Christopher Bauer was suspended without pay and strip<\/a>ped of his security clearance in the FBI\u2019s New Orleans office in late 2018 \u2014 effectively fired \u2014 amid allegations that included a co-worker\u2019s claim that he raped her at knifepoint.<\/p>\n

But Alabama authorities either overlooked or were unaware of that history. The Alabama Law Enforcement Agency, the state police, told AP that it conducted a \u201cfull and thorough\u201d investigation into Bauer\u2019s background when he applied to be a trooper in 2019 and that \u201cno derogatory comments were uncovered by former employers.\u201d<\/p>\n

Bauer indicated on his application that he was still employed by the FBI and had never been dismissed or forced to resign because of disciplinary action. And the state\u2019s law enforcement credentialing commission provided AP a copy of a letter \u2014 purportedly from FBI headquarters \u2014 that makes no mention of Bauer\u2019s ouster, confirms his decade of \u201ccreditable service\u201d and deems him \u201celigible for rehire.\u201d<\/p>\n

\u201cThe letter is not legitimate,\u201d the FBI said in a statement to the AP on Wednesday. Bureau officials would not say who they believe forged the letter.<\/p>\n

Bauer, 41, was arrested last week in Montgomery on charges including sodomy and sexual abuse of a child under 12. The AP is withholding some details of the allegations to protect the girl\u2019s identity.<\/p>\n

Bauer remained jailed Wednesday on $105,000 bail, and court records do not list an attorney who could comment on his behalf. An attorney who represented Bauer in challenging his ouster from the FBI did not respond to requests for comment.<\/p>\n

The FBI declined to say whether it was asked for any information about Bauer\u2019s suitability to be hired by the state police.<\/p>\n

Alabama Gov. Kay Ivey\u2019s office referred questions on the matter to the state police, which did not respond to repeated queries about the details of Bauer\u2019s hiring.<\/p>\n

\u201cYou have to ask yourself why an agent from the FBI would want to leave after 10 years,\u201d said Lou Reiter, a policing consultant and former deputy chief with the Los Angeles Police Department. \u201cThey obviously didn\u2019t do any kind of due diligence with their background check.\u201d<\/p>\n

\u201cThere have to be phone calls,\u201d added Michael Avery, a retired professor at Suffolk University\u2019s Law School and an expert on police misconduct.<\/p>\n

Bauer resigned from the state police following his arrest, citing \u201cpersonal reasons.\u201d<\/p>\n

Bauer is the latest \u2014 and perhaps most extreme \u2014 example yet of an FBI agent accused of sexual misconduct moving on. An AP investigation last year found a pattern of FBI supervisors avoiding discipline \u2014 and retiring with full benefits \u2014 even after claims of sexual misconduct against them were substantiated.<\/p>\n

\u201cNobody wants to take responsibility,\u201d the former co-worker who accused Bauer of rape told the AP, which does not typically identify those who say they are the victims of sex crimes. \u201cI didn\u2019t want this to happen to anybody else.\u201d<\/p>\n

An Air Force veteran, Bauer was a member of the Montgomery police force before joining the FBI in 2009, working a number of high-profile cases in the New Orleans field office. He has disputed the sexual misconduct claims made by his FBI co-worker, telling colleagues the acts were consensual.<\/p>\n

FBI brass considered the misconduct case to be \u201cegregious,\u201d according to a former senior law enforcement official with direct knowledge of the matter. Internal investigators interviewed several female FBI employees about their dealings with Bauer and believed the truth to be \u201csomewhere in the middle\u201d of what Bauer and the co-worker claimed, the former official said. The internal inquiry found Bauer violated FBI policy, including by having sex in an FBI vehicle.<\/p>\n

\u201cHe flat-out needed to lose his job, and he really should have been charged criminally,\u201d said the former official, who wasn\u2019t authorized to discuss personnel matters and spoke on condition of anonymity.<\/p>\n

Bauer\u2019s co-worker told AP that Louisiana authorities had been pursuing criminal charges in St. Tammany Parish, north of New Orleans, but she didn\u2019t believe she had enough evidence to go forward.<\/p>\n

The allegations also played out in a restraining order obtained by the co-worker that names Bauer and had been in the public record in Louisiana for a year when Alabama hired him as a trooper. In it, the woman accuses the lawman of choking her, adding she was \u201cscared for my life.\u201d<\/p>\n

Bauer was ordered to surrender his \u201cfirearms, weapons, swords and knives\u201d as part of the case.<\/p>\n

\u201cI couldn\u2019t see any more and felt my legs go out from under me,\u201d the woman wrote in her application for the order. \u201cHe told me many times if I went to war with him I would lose. He told me many times he would destroy me.\u201d<\/p>\n

The woman told AP that Bauer sexually assaulted her so frequently her hair began to fall out.<\/p>\n

\u201cIt was a year of torture,\u201d she said. \u201cHe quite literally would keep me awake for days. I couldn\u2019t eat. I couldn\u2019t sleep, and in six months I went from 150 pounds to 92 pounds. I was physically dying from what he was doing to me.\u201d\n <\/p><\/div>\n
