But a compelling strategy from Epic in its attempt to paint Apple as a monopolist emerged from its depiction of Apple\u2019s treatment of competing cloud-gaming platforms. <\/p>\n<p> As the scheduled three-week trial nears the conclusion of its first week, a major crux of Epic\u2019s case is that App Store has restrictions that aren\u2019t tenable for some developers, creating a lopsided competitive landscape for Apple Arcade, a videogame subscription service available on iOS. <\/p>\n<div class=\"paywall\">\n       A Microsoft Corp.<br \/>\n        MSFT,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/207732364\/composite\" class=\"positive\">+1.09%<\/bg-quote><br \/>\n       executive revealed the software giant spent four months discussing with Apple<br \/>\n        AAPL,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202934861\/composite\" class=\"positive\">+0.53%<\/bg-quote><br \/>\n       how to launch xCloud as a native app, only to claim Apple demanded Microsoft, Nvidia Corp.<br \/>\n        NVDA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/200467500\/composite\" class=\"positive\">+1.99%<\/bg-quote><span>,<\/span><br \/>\n       and others list cloud games as separate apps. <\/p>\n<p>Submitting Xbox games one-by-one was too onerous, Lori Wright, vice president of business development at Microsoft, said, forcing Microsoft to resort to making a web app. This not only represented a technological hurdle for Microsoft, she said, but also inconvenienced consumers. Users aren\u2019t used to installing apps from the web on their iPhones.<\/p>\n<p>Apple allows services that stream <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">movies<\/a> to offer them all in a single app, but forces services that stream games to separate each game for individual listing and review. \u201cI can use Netflix<br \/>\n        NFLX,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202353025\/composite\" class=\"positive\">+0.86%<\/bg-quote><br \/>\n       with a native app and I can see lots of different movies or TV shows or whatever. Is it that you didn\u2019t want to use a subscription model?\u201d a confused Judge Yvonne Gonzalez Rogers asked at one point.<\/p>\n<p>Safari on the iPhone only\u00a0recently\u00a0became capable of supporting a service like Xbox Cloud Gaming via specific controller support.<\/p>\n<p>Earlier this week, an executive from Nvidia Corp.<br \/>\n        NVDA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/200467500\/composite\" class=\"positive\">+1.99%<\/bg-quote><br \/>\n       explained how it had tried to get its GeForce Now cloud gaming service into the App Store, but had faced the same restrictions as Microsoft.<\/p>\n<p>\u201cThere are less controls over the streaming, so you could argue in some ways it\u2019s worse,\u201d than a native app, said Aashish Patel, Nvidia\u2019s director of product management.<\/p>\n<p>(An Nvidia spokesman, citing a quiet period before the company\u2019s earnings report May 26, declined to comment further.)<\/p>\n<p>Apple\u2019s exacting rules hampered Epic and others, its attorneys hammered home, at a time when mobile-gaming sales are expected to improve 6% to $90.7 billion this year, more than half of an otherwise flat $175.8 billion global market, according to Newzoo.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>In a few instances this week, Epic lawyers attempted to portray Apple Arcade as a competitor to other game apps such as Google Stadia. The testimony of Wright, and <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> tone of Microsoft\u2019s stance in the trial \u2014 both on the stand in the public forum \u2014 agitated and bemused Apple.<\/p>\n<p>Late Thursday, an Apple representative characterized Epic\u2019s case so far as the \u201ccherry-picking\u201d of a few disgruntled developers.<\/p>\n<p>A member of Apple\u2019s legal team late Wednesday called out Microsoft\u2019s \u201chypocrisy\u201d for its holier-than-thou posture on antitrust, given its long history of legal jousting with the Justice Department over anticompetitive business practices. He said it was \u201ckind of ironic that Microsoft is here, trying to prove that Apple is a monopolist. Is it a way to change history? I don\u2019t know.\u201d<\/p>\n<p>By aligning itself with Epic, the Apple representative said, Microsoft had adopted a \u201cvery risky strategy\u201d while mimicking Apple\u2019s business model, \u201ca good, highly successful business model.\u201d<\/p>\n<p>He added that Epic faces a mountainous burden to prove its case based on anecdotes and some colorful emails.<\/p>\n<p>Indeed, Epic faces steep odds in proving antitrust charges against Apple, several antitrust experts agree, but the cloud-gaming competition angle offers an intriguing legal gambit.<\/p>\n<p>\u201cThe experience of playing \u2018Fortnite\u2019 can be kludgy on iOS, yes, discouraging players,\u201d Ari Lightman, professor of digital <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a> and marketing at Carnegie Mellon University\u2019s Heinz College, told MarketWatch. \u201cThe argument makes sense, but when you get to the phone environment, it is a different ecosystem.\u201d<\/p>\n<p>In a recent blog post, Google<br \/>\n        GOOGL,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202490156\/composite\" class=\"positive\">+0.62%<\/bg-quote><\/p>\n<p>        GOOG,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/205453964\/composite\" class=\"positive\">+0.73%<\/bg-quote><br \/>\n       software engineer Alex Russell outlined a long list of all the features that Safari on iOS does not support under the headline, \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/infrequently.org\/2021\/04\/progress-delayed\/\" class=\"icon none\">Do App Store policies harm developers? Is the web a credible alternative?\u201d<\/a><\/p>\n<p>Epic\u2019s focus on cloud-gaming competition offered a technological bookend to its economic argument that Apple has abused its multibillion-dollar App Store platform to enrich itself while harming developers. During an overview of confidential documents early Thursday with Matthew Fischer, vice president of the App Store, Epic attorney Katherine Forrest showed that by late 2010, Apple already had $2.1 billion in cumulative billings from the App Store. Initially, Apple co-founder Steve Jobs did not envision the App Store as a big money maker when it was launched in 2008, Epic lawyers have repeatedly stressed.<\/p>\n<p>Fischer acknowledged Apple had not studied whether increases in price on the App Store caused users to switch from iPhone to Android nor had it studied how much an iPhone user spends on apps over the life cycle of their smartphone.<\/p>\n<p>Fischer did admit an Apple survey found \u201cdevelopers don\u2019t believe that the App Store enables profitability of their apps.\u201d<\/p>\n<p>While the cloud-gaming argument shows Apple\u2019s \u201cmarket power,\u201d antitrust attorney Valarie Williams maintained that \u201crestrictions that lead to higher prices is an easier legal standard\u201d for Epic to prove its case.<\/p>\n<p>Apple has rejected apps for trying to use alternative payment systems, Fischer said, though he acknowledged the company has not studied whether systems from PayPal Holdings Inc.<br \/>\n        PYPL,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/208054269\/composite\" class=\"positive\">+0.53%<\/bg-quote><span>,<\/span><br \/>\n       Amazon.com Inc.<br \/>\n        AMZN,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/210331248\/composite\" class=\"negative\">-0.45%<\/bg-quote><span>,<\/span><br \/>\n       Braintree, S<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a>e, Square Inc.<br \/>\n        SQ,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/205989440\/composite\" class=\"positive\">+4.19%<\/bg-quote><br \/>\n       or Epic Direct Pay are as secure or private as Apple\u2019s in-app purchase system.<\/p>\n<p>\u201cI might be biased, but I think that what we do is incredibly unique,\u201d Fischer said under questioning from an Apple lawyer. \u201cI have not see any marketplace that distributes apps or games do what we are doing in terms of providing marketing and editorial support like this to developers.\u201d<\/p>\n<p>Fischer detailed a largely positive relationship with Epic Games since 2010, but said he had not talked to a company representative since June 2020 and was \u201cblind-sided\u201d by Epic Chief Executive Tim Sweeney\u2019s email in August 2020 critical of Apple.<\/p>\n<p>The trial got off to a bumpy start Thursday, when federal judge Yvonne Gonzalez Rogers chastised lawyers from each side: \u201cYou have 45 hours each for this trial. And yesterday, I was wondering if I gave you too much time,\u201d she said.<\/p>\n<p>Epic could wrap up its case next week, followed by Apple\u2019s presentation. Apple has made it clear it intends to show that Epic attempted to skirt the App Store with a payment system of its own in an audacious bid to enrich itself in what amounts to a breach of contract.<\/p>\n<p>\u201cMy feeling is that Epic has lost the plot\u201d in proving Apple is a monopoly, said an Apple legal strategist late Thursday.
