She thought she had canceled her sub<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">script<\/a>ion and called the company asking why she\u2019d received a bill for about $50.<\/p>\n<p>She remembered the company responded that she should have read the fine print. It wasn\u2019t until Ross called the company out on <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Twitter<\/a> that she got a refund, but the experience still frustrates her years later.<\/p>\n<p>\u201cI felt duped in some way because behind the scenes of this wholesome image in this company, they use these deceptive practices,\u201d Ross said. \u201cIt should have been more straight-up to be able to cancel it and be done and not have my information on file.\u201d<\/p>\n<p>Ross had stumbled across a dark pattern\u2014design choices that steer people into decisions they may not have made under normal conditions. They can take the form of a visual cue like a subscribe button that\u2019s much larger than an opt-out button, or hidden information on pages that people don\u2019t read.<\/p>\n<p>Last September, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2020\/09\/childrens-online-learning-program-abcmouse-pay-10-million-settle\">ABCmouse reached a $10\u00a0million settlement with the Federal Trade Commission<\/a> over its automatic subscription renewals for customers who signed up under a free trial. The company paid out refunds to more than <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2021\/04\/ftc-sends-refunds-consumers-unfairly-billed-abcmouse-memberships\">200,000 people<\/a>.<\/p>\n<p>\u201cThe facts do not support the FTC\u2019s broad claims, and the vast majority of ABCmouse customers are highly satisfied with their memberships,\u201d Kathryn Green, a senior director of communications for ABCmouse\u2019s parent company, Age of Learning, said in an email. \u201cWhile we cannot comment on litigation, we want every family to have a great experience with ABCmouse and regret any confusion that any subscriber may have had.\u201d<\/p>\n<p>The FTC\u2019s actions come amid growing concerns about dark patterns. The FTC held a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/news-events\/events-calendar\/bringing-dark-patterns-light-ftc-workshop\">workshop on the practice in April<\/a>, and Sen. Mark Warner, a Democrat from Virginia, and Rep. Lisa Blunt Rochester, a Democrat from Delaware, have said they intend to reintroduce the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.scribd.com\/document\/405606873\/Detour-Act-Final\">DETOUR Act<\/a> to regulate dark patterns.<\/p>\n<p>Tech giants are also facing legal challenges over dark patterns. In January, after <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/fil.forbrukerradet.no\/wp-content\/uploads\/2021\/01\/2021-01-14-you-can-log-out-but-you-can-never-leave-final.pdf\">researchers accused<\/a> Amazon of making it too difficult for Prime members to cancel their subscriptions, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.bbc.com\/news\/technology-55637140\">the Norwegian Consumer Council <\/a>filed a legal complaint with Norway\u2019s consumer protection authority, while the U.S. consumer advocacy group Public Citizen requested that the FTC investigate Amazon\u2019s dark patterns for maintaining subscriptions. In 2015, LinkedIn <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.fastcompany.com\/3051906\/after-lawsuit-settlement-linkedins-dishonest-design-is-now-a-13-million-problem\">settled a lawsuit for $13 million over dark patterns<\/a> in which it collected new users\u2019 email contacts through deceptive design. The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/wittelslaw.com\/cases\/noom-weight-loss-program-auto-enrollment-class-action\">weight loss app Noom<\/a> faces an ongoing federal lawsuit in the Southern District of New York by a group of consumers who claim they were automatically enrolled into pricey plans.<\/p>\n<p>\u201cCustomer trust is at the heart of all of our products and services and we strongly disagree with any claim that our cancellation process creates uncertainty,\u201d Amazon spokesperson Jena Boehnke said in an emailed statement.<\/p>\n<p>LinkedIn spokesperson Leonna Spilman said in an emailed statement that the company works to help members understand how they can manage their information.<\/p>\n<p>\u201cResponsible design is a well-established principle at LinkedIn that has informed our engineering and product development process for years,\u201d she said.<\/p>\n<p>Noom didn\u2019t respond to a request for comment.<\/p>\n<p>In March, California passed a law banning dark patterns, but only for <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-announces-approval-additional-regulations-empower-data\">interfaces related to opting out of data collection<\/a> from the state\u2019s data privacy law.<\/p>\n<p>Harry Brignull, who coined the term back in 2010, said dark patterns have gotten worse.<\/p>\n<p>\u201cI\u2019d hope by naming and shaming these companies and bringing it to light, it would somehow magically make it go away,\u201d Brignull said. \u201cI thought there would be less dark patterns 10 years later.
