investment adviser?<\/p>\n<p> If so, how might you begin this process?<\/p>\n<p>Well, given numerous research reports that highlight how easy it is for dishonest advisers to<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/law.stanford.edu\/wp-content\/uploads\/2018\/11\/JFE_Honigsberg-and-Jacob-2021.pdf\" class=\"icon none\"> expunge their records of wrongdoing<\/a> or<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/ssrn.com\/abstract=3769653\" class=\"icon none\"> wander from one firm to another<\/a>, and<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.nber.org\/system\/files\/working_papers\/w22050\/w22050.pdf\" class=\"icon none\"> how pervasive financial adviser misconduct is<\/a>, and given the role that<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.rand.org\/pubs\/working_papers\/WR1075.html\" class=\"icon none\"> trust plays in selecting an adviser<\/a>, the best place to start is with a technique used in the world of cybersecurity.<\/p>\n<div class=\"paywall\">\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n       You would first adopt a \u201czero-trust\u201d protocol. So says Keith Loveland, the co-founder and <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> counsel of the Center for Board Certified Fiduciaries.<\/p>\n<p>This isn\u2019t \u201ctrust but verify\u201d. Rather, it\u2019s \u201ctrust no one\u201d. Not one single adviser. No one gets through the perimeter without going through multiple authentications, according to Loveland.\u00a0<\/p>\n<p><strong>See Also:<\/strong> Visit our How to Invest section to get expert guidance on investing<\/p>\n<p>These bad <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>les, he said, are very skilled at \u201ccultivating confidence.\u201d<\/p>\n<p>And given that, Loveland recommends another <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/watch-movies-tv-seriess\/\" data-internallinksmanager029f6b8e52c=\"8\" title=\"Watch Movies &amp; TV Series\" target=\"_blank\" rel=\"noopener\">series<\/a> of authentications once an adviser passes through the \u201cperimeter.\u201d Those authentications include but aren\u2019t limited to you \u2014 the prospective client \u2014 interviewing the adviser\u2019s former and current clients, branch managers, former employers, colleagues. And it includes you \u2014 the potential client \u2014 searching Google as well as reviewing<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/brokercheck.finra.org\/\" class=\"icon none\"> Finra\u2019s BrokerCheck<\/a>, the<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/adviserinfo.sec.gov\/\" class=\"icon none\"> SEC\u2019s Investment Adviser Public Disclosure website<\/a>, and for certified financial planners,<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cfp.net\/verify-a-cfp-professional\" class=\"icon none\"> the CFP Board\u2019s website<\/a>. You might even ask for the adviser to provide you with his or her background check, or provide you with a copy of their bond and errors and omissions insurance policy.<\/p>\n<p>Check out: Not sure if you can retire? After all, we are talking about you entrusting your money to another person and it wouldn\u2019t be wise to rely on one single factor, on one single authentication.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>\u201cWhat would really be good is that you don\u2019t trust the people that you trust and that you check them out,\u201d said Loveland. \u201cAnd that\u2019s a huge emotional hurdle.\u201d<\/p>\n<p>Why is this mind-set and protocol necessary given that most of the people in the financial and investment community are not bad apples? Well, sometimes it\u2019s hard to tell the good from the bad given how easy it is to be bad and still be in the business.<\/p>\n<p>Check out: Not sure where to retire? Our tool can help you narrow it down<\/p>\n<p><strong>Wandering financial advisers<\/strong><\/p>\n<p>Consider: Using a novel data set of 1.2 million advisers across four major regulatory \u201cregimes\u201d (brokers regulated by Finra, advisers regulated by the SEC, insurance agents regulated by state insurance departments, and commodities dealers) and Colleen Honigsberg, an associate professor at Stanford Law School, Edwin Hu, a research fellow at New York University School of Law, and Robert Jackson, Jr. a professor at New York University School of Law, recently conducted the first systematic analysis of what they called \u201cwandering financial advisers.\u201d<\/p>\n<p>And in their paper, the researchers showed that a little over a third of advisers who exit the brokerage industry remain in at least one other regime, that advisers are significantly more likely to change regimes after committing serious misconduct, and that wandering advisers with a history of misconduct are significantly more likely to engage in future misconduct.<\/p>\n<p>Of note, the researchers not only offered explanations for why advisers wander but they offered policy makers concerned about the costs of financial-adviser misconduct with tools to address this phenomenon, a national database being one such tool.<\/p>\n<p>This research, for the record, was described by an expert who eats, breathes, and sleeps all things fiduciary as \u201csobering.\u201d It provides, said Knut Rostad, president and co-founder of the Institute for the Fiduciary Standard, \u201ca first-of-its-kind documentation of how many financial sales reps prey on unsuspecting citizens.\u201d It shows, he said, how they (advisers) appear to \u201csucceed\u201d by quitting FINRA and keeping their status as state insurance producers. To wit: 13.4% have \u201ca history of serious misconduct\u201d according to the paper.<\/p>\n<p>And serial recidivists appear commonplace. \u201cWandering advisers with a history of misconduct are more likely to be recidivists in the future (and) those with the most serious history of misconduct are disproportionately likely to end up in state insurance regimes.\u201d<\/p>\n<p><strong>Deleting misconduct: The expungement of BrokerCheck records<\/strong><\/p>\n<p>Researchers have also discovered how often unscrupulous advisers try to expunge their records of misconduct. In their research, Honigsberg and co-author Matthew Jacob, a researcher at Opportunity Insights, examine \u201ca controversial process, known as expungement, which allows brokers to remove evidence of financial misconduct from public records.<\/p>\n<p>From 2007 to 2016, Honigsberg and co-author Matthew Jacob identified 6,660 expungement requests, suggesting that brokers attempt to expunge 12% of the allegations of misconduct reported by customers and firms. \u201cWhen these requests are adjudicated on the merits, arbitrators approve expungement 84% of the time,\u201d the researchers wrote in their abstract.<\/p>\n<p>But these expungements, the authors discovered, \u201csignificantly predict future misconduct; brokers with prior expungements are 3.3 times as likely to engage in new misconduct as the average broker,\u201d they wrote.<\/p>\n<p>What\u2019s more Honigsberg and Jacob provided evidence that brokers who receive expungement are more likely to reoffend than brokers who are denied expungement. And if all that wasn\u2019t bad enough, the researchers discovered that \u201cexpungements improve long-term career prospects.\u201d<\/p>\n<p><strong>The market for financial adviser misconduct<\/strong><\/p>\n<p>Want more evidence of the need to adopt a zero-trust protocol? Consider research from Mark Egan, an assistant professor at Harvard Business School, Amit Seru, a professor at Stanford University, and Gregor Matvos, a professor at the University of Texas at Austin.<\/p>\n<p>Those researchers found that 7% of advisers have misconduct records, and this share reaches more than 15% at some of the largest firms. What\u2019s more, the researchers noted in their abstract that roughly one-third of advisers with misconduct are repeat offenders.<\/p>\n<p>The good <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a>: Approximately half of advisers lose their jobs after misconduct. The bad news: \u201cThe labor market partially undoes firm-level discipline by rehiring such advisers,\u201d the researchers wrote.<\/p>\n<p>And the hard part for those seeking advisers is this: \u201cFirms that persistently engage in misconduct coexist with firms that have clean records,\u201d the researchers wrote. And this phenomenon, the researchers discovered, may be explained by some firms \u201cspecializing\u201d in misconduct and catering to unsophisticated consumers.<\/p>\n<p><strong>Buyer beware<\/strong><\/p>\n<p>Let\u2019s be clear, most advisers are good apples and have nothing to hide. And since they\u2019ve got nothing to hide, they won\u2019t mind being put through the paces, they won\u2019t mind if you adopt a zero-trust protocol. On the other hand, the bad apples have lots to hide and with hope you\u2019ll uncover their misconduct long before you turn over your money to someone who might do right by you, who might not act in your best interest.<\/p>\n<p>\u201cPlease adopt a zero-trust attitude when it comes to your money,\u201d said Loveland. \u201cThat would be really good. Then the converse of that is it\u2019s more difficult to be cheated when you don\u2019t trust anyone.\u201d<\/p>\n<p>For his part, Rostad offered this advice: \u201cThe overriding message to investors and consumers is \u2018buyer beware.\u2019 Very few states offer investors the minimum tool to do so and to protect themselves.
