Boasberg tossed a Federal Trade Commission complaint accusing the company of \u201cillegal monopolization\u201d resulting from \u201ca years-long course of anticompetitive conduct.\u201d<\/p>\n<p>Boasberg also dismissed a parallel suit against Facebook from 46 states, including New York, that also accused the company of squashing competition through anti-competitive practices. <\/p>\n<p>The lawsuits, which were filed simultaneously in December, could have resulted in Facebook being forced to separate or sell Instagram and Whats<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a> \u2014 acquisitions that critics say were done to neutralize a growing threat of competition from the apps.<\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"682\" alt=\"Protesters demonstrate against Facebook.\" class=\"wp-image-18659810 lazyload\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-4.jpg?quality=90&amp;strip=all&amp;w=300 300w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-4.jpg?quality=90&amp;strip=all&amp;w=640 640w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-4.jpg?quality=90&amp;strip=all&amp;w=1280 1280w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-4.jpg?quality=90&amp;strip=all&amp;w=1024 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-4.jpg?quality=90&amp;strip=all&amp;w=2000 2000w\" data-sizes=\"(max-width: 640px) 100vw, 1024px\"\/><figcaption>The development represents an early challenge for recently confirmed FTC chair and big tech foe Lina Khan.<\/figcaption><figcaption><span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>In a major blow to regulators\u2019 efforts to crack down on the Silicon Valley giant, Judge Boasberg slammed the FTC\u2019s suit as \u201cvague\u201d and \u201ctoo speculative\u201d in an opinion published Monday afternoon. <\/p>\n<p>\u201cAlthough the court does not agree with all of Facebook\u2019s contentions here, it ultimately concurs that the agency\u2019s complaint is legally insufficient and must therefore be dismissed,\u201d wrote Boasberg.\u00a0<\/p>\n<p>He gave the FTC one month to file an amended compliant in order for the suit to proceed. But he did not give the states an opportunity to file an amended suit, dismissing their case outright, ruling that they waited too long to file their claims.\u00a0 <\/p>\n<p>A spokesperson for the FTC said the agency \u201cis closely reviewing the opinion and assessing the best option forward.\u201d New York Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Tish James\u2019 office did not immediately reply to a request for comment on the dismissal.<\/p>\n<p>Facebook in a statement said: \u201cWe are pleased that today\u2019s decisions recognize the defects in the government complaints filed against Facebook. We compete fairly every day to earn people\u2019s time and attention and will continue to deliver great products for the people and businesses that use our services.\u201d<\/p>\n<p>Facebook stock ended the day higher 4.18  percent, or $14.27 a share, to $355.64, giving it a market capitalization of slightly more than $1 billion.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"682\" alt=\"A shot of a phone with Facebook logo\" class=\"wp-image-18661694 lazyload\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-2.jpg?quality=90&amp;strip=all&amp;w=300 300w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-2.jpg?quality=90&amp;strip=all&amp;w=640 640w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-2.jpg?quality=90&amp;strip=all&amp;w=1280 1280w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-2.jpg?quality=90&amp;strip=all&amp;w=1024 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/06\/facebook-ftc-2.jpg?quality=90&amp;strip=all&amp;w=2000 2000w\" data-sizes=\"(max-width: 640px) 100vw, 1024px\"\/><figcaption>A DC federal judge tossed a slew of anti-trust complaints against Facebook, sending the stock up.<\/figcaption><figcaption><span class=\"credit\">zz\/STRF\/STAR MAX\/IPx<\/span><\/figcaption><\/figure>\n<p>The development represents an early challenge for FTC chair and big tech foe Lina Khan, who was sworn in less than two weeks ago.\u00a0The agency will likely take Boasberg up on his offer and file a new complaint by July 28, said Herbert Hovenkamp, an antitrust expert and University of Pennsylvania law professor.\u00a0<\/p>\n<p>\u201cThey can start from scratch and do whatever they want to do,\u201d Hovenkamp told The Post. \u201cThis complaint is gone.\u201d<\/p>\n<p>The professor also said he found the judge\u2019s move of dismissing the complaint but not the entire case unusual.<\/p>\n<p>\u201cThe judge may have thought that there was something to the case but that the complaint was not very well drafted to state it,\u201d Hovenkamp said.\u00a0<\/p>\n<p>In the FTC\u2019s initial complaint, the agency claimed that Facebook controlled \u201c60 percent-plus\u201d of the social media market. But Boasberg said the agency failed to provide any indication of the metric or method used to calculate that figure.\u00a0<\/p>\n<p>He also said that Facebook\u2019s large market share alone was insufficient evidence of a monopoly.\u00a0<\/p>\n<p>\u201cTo merely allege that a defendant firm has somewhere over 60 percent share of an unusual, nonintuitive product market \u2014 the confines of which are only somewhat fleshed out and the players within which remain almost entirely unspecified \u2014 is not enough,\u201d Boasberg wrote.\u00a0<\/p>\n<p>While Facebook will certainly breathe a sigh of relief at Monday\u2019s dismissal, the company is not out of the regulatory woods yet. Congress is currently\u00a0weighing several bills that could break up Facebook\u00a0and other big tech companies, while a Texas judge ruled Friday that\u00a0Facebook must face a suit in state court for allegedly knowingly profiting off of sex trafficking.\u00a0\n            <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
