“#Facebook<\/a> under fire as US lawmakers press for new antitrust complaint<\/strong>”<\/p>\n

\u00a0A bipartisan group of US lawmakers expert in antitrust urged the Federal Trade Commission Friday to press on with its lawsuit against\u00a0Facebook, according to a statement from Sen. Amy Klobuchar.<\/p>\n

In a letter to new FTC Chair Lina Khan, Klobuchar, Sen. Mike Lee and Reps. David Cicilline and Ken Buck urged the FTC to \u201cpursue enforcement action against\u00a0Facebook\u00a0and to consider all available options under the law for ensuring that the commission\u2019s claims receive a full and fair hearing.\u201d<\/p>\n

Klobuchar and Cicilline, both Democrats, and Lee and Buck, both Republicans, hold the top positions on congressional antitrust panels.<\/p>\n

The FTC is expected to file a new complaint against\u00a0Facebook\u00a0after US District Judge James Boasberg of District of Columbia dismissed one filed in December, experts said.<\/p>\n

That complaint, which asked him to require\u00a0Facebook\u00a0to sell photo-sharing app<\/a> Instagram and messaging app WhatsApp, fell short, Boasberg said, because the FTC failed to show the company had monopoly power and instances of alleged anticompetitive behavior were too old.<\/p>\n

Several veteran FTC officials said it was implausible that the agency did not have data to back up its assertion that\u00a0Facebook\u00a0had \u201cin excess of 60 percent\u201d of the social media market.<\/p>\n

\u201cWhat he told them was \u2018I\u2019m not going to read the news<\/a>paper and believe that\u00a0Facebook\u00a0is a monopoly\u2019,\u201d said Andy Gavil, an FTC veteran who teaches at the Howard University School of Law.<\/p>\n

Facebook\u00a0declined to comment for this story. In earlier comment, it noted that Instagram and WhatsApp grew mightily under\u00a0Facebook\u00a0stewardship. It said it would vigorously fight the FTC in court.<\/p>\n

GO BIG AND GO HOME?<\/p>\n

The FTC, under new leadership, might write a considerably broader complaint and could file it before an FTC administrative law judge, essentially taking the case in-house.<\/p>\n

William Kovacic, a former FTC chair now at George Washington University Law School, said that a new complaint could add allegations, including potentially unfair method of competition.<\/p>\n

\u201cThat is a topic that she (Khan) has talked about and written about on many occasions,\u201d he said.<\/p>\n

Experts also predicted the dismissal would build support for bills to ramp up antitrust enforcement.<\/p>\n

\u201cIf these dismissals tip the scales, it will be toward doing something. If the government could win even modestly on these cases, it\u2019s an argument to do nothing,\u201d said Herb Hovenkamp of the University of Pennsylvania Carey Law School.\n <\/p><\/div>\n
