{"id":305366,"date":"2021-07-21T23:15:37","date_gmt":"2021-07-21T20:15:37","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/federal-judge-blocks-arkansas-trans-youth-treatment-ban\/"},"modified":"2021-07-21T23:15:37","modified_gmt":"2021-07-21T20:15:37","slug":"federal-judge-blocks-arkansas-trans-youth-treatment-ban","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/federal-judge-blocks-arkansas-trans-youth-treatment-ban\/","title":{"rendered":"#Federal judge blocks Arkansas trans youth treatment ban"},"content":{"rendered":"<p>&#8220;<strong>#Federal judge blocks Arkansas trans youth treatment ban<\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/07\/Trans-rights-feature.jpg?quality=90&amp;strip=all\" \/><\/p>\n<div>\n<p>LITTLE ROCK, Ark.\u2014 A federal judge on Wednesday temporarily blocked enforcement of Arkansas\u2019 ban on gender confirming treatments for transgender youth while a lawsuit challenging the prohibition proceeds.<\/p>\n<p>The American Civil Liberties Union\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/arkansas-business-lawsuits-health-government-and-politics-296daadb3b59a04da2222a45f9ef8991\">filed a lawsuit<\/a>\u00a0in May asking US District Judge Jay Moody in Little Rock to strike down the law that made Arkansas the first state to forbid doctors from providing gender confirming hormone treatment, puberty blockers or sex reassignment surgery to anyone under 18 years old, or from referring them to other providers for such treatment. The ACLU sought the preliminary injunction while its lawsuit proceeded.<\/p>\n<p>Moody found that the plaintiffs were likely to succeed with their challenge and that allowing it to be enforced would hurt transgender youth currently receiving the treatments.<\/p>\n<p>\u201cTo pull this care midstream from these patients, or minors, would cause irreparable harm,\u201d Moody said.<\/p>\n<p>The law had been set to take effect July 28.<\/p>\n<p>The ACLU filed the lawsuit on behalf of four transgender youths and their families, as well as two doctors who provide gender confirming treatments. The lawsuit argues that the prohibition would severely harm transgender youth in the state and violate their constitutional rights.<\/p>\n<p>\u201cThis ruling sends a clear message to states across the country that gender affirming care is life-saving care, and we won\u2019t let politicians in Arkansas \u2014 or anywhere else \u2014 take it away,\u201d said Holly Dickson, executive director of the ACLU of Arkansas.<\/p>\n<p>An attorney for the ACLU had said the ban was forcing some families to consider uprooting from their homes to move to other states where the care was legal.<\/p>\n<p>\u201cThis care has given me confidence that I didn\u2019t know I had,\u201d Dylan Brandt, a 15-year-old transgender boy from Greenwood who is one of the plaintiffs, said at at a <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> conference after the ruling.<\/p>\n<p>Arkansas\u2019 Republican-dominated Legislature\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/arkansas-lawmakers-enact-transgender-youth-treatment-ban-dce1d5ca9450b255caabc18f547f7b9b\">overrode GOP Gov. Asa Hutchinson\u2019s veto\u00a0<\/a>of the measure. Hutchinson\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/apnews.com\/article\/arkansas-legislature-us-news-legislation-asa-hutchinson-83d07a502678f9745bb00f91aa4865f6\">vetoed the ban<\/a>\u00a0following pleas from pediatricians, <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social<\/a> workers and the parents of transgender youths who said it would harm a community already at risk for depression and suicide.<\/p>\n<p>Attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">General<\/a> Leslie Rutledge, a Republican, said she planned to <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>eal the decision.<\/p>\n<p>\u201cI will aggressively defend Arkansas\u2019s law, which strongly limits permanent, life-altering sex changes to adolescents,\u201d Rutledge said. \u201cI will not sit idly by while radical groups such as the ACLU use our children as pawns for their own social agenda.\u201d<\/p>\n<p>Moody issued the ruling shortly after hearing arguments from the law\u2019s opponents and the state for about an hour and a half.<\/p>\n<p>The judge appeared skeptical of the state\u2019s argument that the ban was targeting the procedure, not transgender people. For example, he questioned why a minor born as a male should be allowed to receive testosterone but not one who was born female<\/p>\n<p>\u201cHow do you justify giving that to one sex but not the other and not call that sex discrimination?\u201d Moody asked.<\/p>\n<p>Arkansas argued that the state has a legitimate interest in banning the procedures for minors. Republican attorneys general from 17 states asked Moody to uphold the ban.<\/p>\n<p>Several major medical groups, including the American Medical Association and the American Academy of Pediatrics, filed a brief with the court challenging the ban. The state Chamber of Commerce and the Walton Family Foundation, which was founded by relatives of Arkansas-based Walmart\u2019s founder, also asked the court to block the ban.\n            <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
