“#Biden picks Big Tech gadfly Jonathan Kanter as DOJ antitrust chief<\/strong>”<\/p>\n

The White House has tapp<\/a>ed a longtime gadfly of Google and other big tech companies to lead the Department of Justice\u2019s antitrust division. <\/p>\n

President Biden on Tuesday nominated<\/a> Jonathan Kanter \u2014 a pugnacious antitrust attorney who has fought legal battles against Google and who has said US competition enforcers have \u201clost our way\u201d \u2014 to head the key agency.\u00a0<\/p>\n

Kanter must be confirmed by the Senate, where news<\/a> of his nomination was immedia<\/a>tely met with praise from Elizabeth Warren (D-Mass.) and Amy Klobuchar (D-Minn.).\u00a0Senator Mike Lee, a Republican from Utah, has also called Kanter\u2019s record \u201cencouraging,\u201d according to the New York Times.<\/p>\n

Warren this week called<\/a> the move \u201ctremendous news for workers and consumers,\u201d adding that Kanter has \u201cbeen a leader in the fight to check consolidated corporate power and strengthen competition in our markets.\u201d\u00a0<\/p>\n

If confirmed, Kanter will take over the Justice Department\u2019s ongoing suit against Google over the company\u2019s \u201cunlawful monopolies\u201d in search and advertising \u2014 the department\u2019s first substantial challenge to a big tech company since its 1998 antitrust suit against Microsoft.\u00a0<\/p>\n

The 47-year-old Kanter has a long history with Google. After starting his career at the Federal Trade Commission, he moved into private practice, where he represented Google rivals and critics including Microsoft, Yelp and New York Post parent company News Corp.\u00a0<\/p>\n

In addition to his legal work, the combative attorney has advocated publicly for more assertive antitrust enforcement against tech giants. In 2016, Kanter slammed<\/a> the Obama administration antitrust enforcement as being \u201cbarely on life support.\u201d \u00a0<\/p>\n

\u201cMonopoly cases are the equivalent of jaywalking,\u201d Kanter said two years later in a 2018 speech<\/a>. \u201cThe last big Section 2 case brought by the United States government \u2026 is the Microsoft case 20 years ago. So what has gone wrong? How have we lost our way?\u201d<\/p>\n

Kanter\u2019s nomination comes on the heels of fellow big tech foe Lina Khan\u2019s confirmation in June as head of the Federal Trade Commission.\u00a0<\/p>\n

Khan has already clashed with Amazon and Facebook during her short tenure as FTC chief. Both tech giants have demanded she recuse herself from antitrust investigations involving them due to past critical writing about the companies, though Khan has yet to respond.<\/p>\n

Given Kanter\u2019s work for Google\u2019s rivals, he may face similar pressure to recuse himself from the Justice Department\u2019s suit against Google, according to Mark McCareins, a business law professor at Northwestern University\u2019s Kellogg School of Management.\u00a0<\/p>\n

McCareins added that the methodical nature of the Justice Department\u2019s work means that anyone expecting \u201cimmediate fireworks against big tech will probably be disappointed.\u201d<\/p>\n

Kanter will also be busy overseeing antitrust cases not related to tech, including a long-running investigation into poultry price-fixing, McCareins said.\u00a0<\/p>\n

\u201cChickens are not big tech but he has inherited that investigation \u2014 it is massive, it is important, and if anybody thinks his day will be occupied 100 percent about trying to deal with Big Tech, they are wrong,\u201d the professor said.\u00a0\n <\/p><\/div>\n
