{"id":324585,"date":"2021-08-14T23:56:17","date_gmt":"2021-08-14T20:56:17","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/convicted-conman-sues-his-nyc-victims-and-wins-12m\/"},"modified":"2021-08-14T23:56:17","modified_gmt":"2021-08-14T20:56:17","slug":"convicted-conman-sues-his-nyc-victims-and-wins-12m","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/convicted-conman-sues-his-nyc-victims-and-wins-12m\/","title":{"rendered":"#Convicted conman sues his NYC victims \u2014 and wins $12M"},"content":{"rendered":"<p>&#8220;<strong>#Convicted conman sues his NYC victims \u2014 and wins $12M<\/strong>&#8221;<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n        <\/aside>\n<p>A convicted thief has successfully sued a family for more than $12 million \u2014 after robbing them of $1 million, his victims claim. <\/p>\n<p>The Queens conman \u2014 who raked in more than $1 million by swiping the IDs of six unsuspecting family members more than a decade ago \u2014 could now walk away with an even bigger pile of cash after convincing a Manhattan jury that his victims were to blame for his criminal conviction, according to court records.<\/p>\n<p>The victims claim they had no idea the lawsuit filed against them by ex-con Jacob Milton had gone to trial, until getting an Aug. 5 letter telling them they owed him a whopping $12.5 million. <\/p>\n<p>\u201cHow can victims of his fraud \u2018repay\u2019 him this amount when their financial lives are still hurt by this?\u201d said Kate Alvarez, a family member of one of the victims.<\/p>\n<p>Milton, 55, was a Queens mortgage broker who pleaded guilty to grand larceny and served three years behind bars.<\/p>\n<p>He was accused of taking out hefty mortgages and running up huge credit card bills on behalf of more than half a dozen unsuspecting victims<strong> <\/strong>in the 2007 scheme, six of whom are related. In 2010, Milton was sentenced to two to six years in prison, according to the Queens District Attorney\u2019s Office. <\/p>\n<p>About a year after Milton got his freedom back, he lodged a $50 million lawsuit against the people he stole from \u2014 claiming they\u2019d wrongly accused him, court documents show. <\/p>\n<p>The family \u2014 Mayra Macias, Juan C. Alvarez, Juan B. Alvarez, Lorena Alvarez, Martha Viteri and Hector Sandoval \u2014 initially hired lawyer Noah Goldstein to fight the case. <\/p>\n<p>But when Goldstein later dropped out of the case, they failed to hire a new lawyer or respond to orders from the judge directing them to <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ear at court.  <\/p>\n<p>\u201cThe family said they had no idea a trial was scheduled and held, and a judgment awarded until last week,\u201d said Goldstein, who has reconnected with the family. \u201cThe jury, seeing an empty defendant\u2019s chair, probably [thought] they [were] supposed to believe Milton and\u00a0give him what he wants.\u201d<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all&amp;w=1014\" alt=\"Milton claimed in court that his victims wrongfully accused him of his crimes.\" class=\"wp-image-19134265\" width=\"344\" height=\"343\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all&amp;w=679 688w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all&amp;w=509 516w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all&amp;w=340 344w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all&amp;w=170 172w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/jacob-milton-2.jpg?quality=90&amp;strip=all 1024w\" sizes=\"auto, (max-width: 344px) 100vw, 344px\"\/><figcaption>Milton claimed in court that his victims wrongfully accused him of his crimes.<\/figcaption><\/figure>\n<\/div>\n<p>Milton\u2019s lawyer, John DeMaio, told the court in 2017 he\u2019d mailed the victims various documents alerting them to the proceedings as the case dragged on, legal papers show. <\/p>\n<p>\u201cI have no reason to believe Defendants will ever appear,\u201d he wrote in one 2018 filing.<\/p>\n<p>The case landed in front of a jury in Justice Doris Ling-Cohan\u2019s courtroom in March 2019.  <\/p>\n<p>Alvarez insisted that \u201cno letter was ever received stating any court date or document saying they had to show up or else. Instead they receive this first letter stating he won his case and [they] have to pay 12 million.\u201d<\/p>\n<p>The victims can go back to court and try to wipe out the judgment, or appeal, said Lucian Chalfen, spokesman for the state Office of Court Administration.<\/p>\n<p>Milton, a Bangladeshi immigrant with a bombastic personality who once had a public access television show in Queens called \u201cWe Are The People With Jacob Milton,\u201d has maintained his innocence despite his guilty plea. <\/p>\n<p>Reached for comment, Milton claimed to The Post that the prosecutors who handled his case misrepresented evidence, and repeated his allegations that his victims in the criminal case had falsely accused him. <\/p>\n<p>Goldstein told The Post he is expected to meet with them Monday.
