{"id":327995,"date":"2021-08-19T22:43:28","date_gmt":"2021-08-19T19:43:28","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/facebook-has-held-a-durable-monopoly-for-a-decade-ftc-says-in-amended-suit\/"},"modified":"2021-08-19T22:43:28","modified_gmt":"2021-08-19T19:43:28","slug":"facebook-has-held-a-durable-monopoly-for-a-decade-ftc-says-in-amended-suit","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/facebook-has-held-a-durable-monopoly-for-a-decade-ftc-says-in-amended-suit\/","title":{"rendered":"#Facebook has held a \u2018durable monopoly\u2019 for a decade, FTC says in amended suit"},"content":{"rendered":"<p>&#8220;<strong>#<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> has held a \u2018durable monopoly\u2019 for a decade, FTC says in amended suit<\/strong>&#8221;<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n        <\/aside>\n<p>Facebook has held a monopoly over personal social networking for the past decade, according to a beefed-up antitrust suit by the Federal Trade Commission filed Thursday.\u00a0<\/p>\n<p>The FTC\u2019s amended suit, which comes two months after a federal judge dismissed an earlier version, seeks to force Facebook to restructure or sell off assets including Instagram and Whats<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a> that it says help the company squash competition.\u00a0<\/p>\n<p>\u201cFacebook holds monopoly power in the provision of personal social networking in the United States and has held such power continuously since at least 2011,\u201d the FTC wrote, accusing the company of illegally maintaining a \u201cdurable monopoly.\u201d\u00a0<\/p>\n<p>The new <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.224921\/gov.uscourts.dcd.224921.75.1_1.pdf\">complaint<\/a> is longer and more detailed than a Trump-era suit against the company that was dismissed this June. At the time, Washington, DC, federal Judge James E. Boasberg said the complaint was \u201cvague\u201d and \u201ctoo speculative\u201d in its arguments.\u00a0<\/p>\n<p>In Thursday\u2019s complaint, the FTC retained its core argument that Facebook engaged in a \u201cbuy or bury\u201d scheme to eliminate competition including Instagram and WhatsApp, helping the firm secure an illegal monopoly that hurts consumers.\u00a0<\/p>\n<p>\u201cUnable to maintain its monopoly or its advertising profits by fairly competing, Facebook\u2019s executives addressed this existential threat by buying up the new mobile innovators, including its rival Instagram in 2012 and mobile messaging app WhatsApp in 2014, who had succeeded where Facebook had failed,\u201d the FTC <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2021\/08\/ftc-alleges-facebook-resorted-illegal-buy-or-bury-scheme-crush\">alleged<\/a>.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-03.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Facebook logo\" class=\"wp-image-19179838\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-03.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-03.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-03.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The FTC\u2019s amended suit comes two months after a federal judge dismissed an earlier version.<\/figcaption><figcaption><span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>But the new filing also contains more fleshed-out language that seems designed to address Boasberg\u2019s concerns. In particular, the new complaint \u2014 which comes in at 80 pages, compared to the original\u2019s 53 \u2014 was clearer about the definition of the \u201cpersonal social media\u201d market.\u00a0<\/p>\n<p>The FTC argued that Facebook\u2019s sphere of competition is separate from online platforms like YouTube or TikTok, which users do not primarily use to communicate with friends and family. Therefore, TikTok\u2019s widespread popularity in the US does not serve as an argument against Facebook maintaining a monopoly within the sphere of social media platforms that people use for personal communication, according to the FTC.\u00a0<\/p>\n<p>\u201cSnapchat is the next-largest provider of personal social networking services, but its user base pales in comparison: Snapchat has tens of millions fewer monthly users than either Facebook Blue or Instagram,\u201d the FTC said.\u00a0<\/p>\n<p>Facebook, which has until Oct. 4 to respond to the amended complaint in court, called the amended suit \u201cmeritless\u201d in a Thursday statement.<\/p>\n<p>\u201cOur acquisitions of Instagram and WhatsApp were reviewed and cleared many years ago, and our platform policies were lawful,\u201d a Facebook spokesperson said. \u201cThe FTC\u2019s claims are an effort to rewrite antitrust laws and upend settled expectations of merger review, declaring to the business community that no sale is ever final.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-02.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"FTC chair\" class=\"wp-image-19179833\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-02.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-02.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/08\/facebook-antitrust-02.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>FTC Chair Lina Khan is not recusing herself from antitrust actions against Facebook.<\/figcaption><figcaption><span class=\"credit\">POOL\/AFP via Getty Images<\/span><\/figcaption><\/figure>\n<p>Facebook\u2019s stock was up 0.1 percent Thursday afternoon.\u00a0<\/p>\n<p>Shortly after Boasberg rejected the FTC\u2019s initial petition, Facebook requested that President Biden-appointed FTC Chair Lina Khan recuse herself from antitrust actions involving the company because she had written critically about big tech in the past.\u00a0<\/p>\n<p>The FTC said Thursday that it had rejected the petition after having \u201ccarefully reviewed\u201d it, indicating that Khan is likely to play an active role in the case.\u00a0<\/p>\n<p>Also on Thursday, Facebook revealed a new feature called \u201cFacebook Workrooms,\u201d which is designed to replace in-person business meetings and Zoom calls with a virtual reality world where people are represented by avatars.<\/p>\n<p>Rep.
