{"id":330953,"date":"2021-08-27T06:35:57","date_gmt":"2021-08-27T03:35:57","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/surveillance-state-australian-police-given-sweeping-new-hacking-powers\/"},"modified":"2021-08-27T06:35:57","modified_gmt":"2021-08-27T03:35:57","slug":"surveillance-state-australian-police-given-sweeping-new-hacking-powers","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/surveillance-state-australian-police-given-sweeping-new-hacking-powers\/","title":{"rendered":"# &#8216;Surveillance state&#8217;: Australian police given sweeping new hacking powers"},"content":{"rendered":"<p>&#8220;<strong># &#8216;Surveillance state&#8217;: Australian police given sweeping new hacking powers  <\/strong>&#8221;<br \/>\n<img decoding=\"async\" src=\"https:\/\/images.cointelegraph.com\/images\/840_aHR0cHM6Ly9zMy5jb2ludGVsZWdyYXBoLmNvbS91cGxvYWRzLzIwMjEtMDgvODgwNjFlZDItMGJiNi00ZDhlLWFmM2EtNjMyOTQ3MjQ4NGFhLmpwZw==.jpg\" \/><\/p>\n<div class=\"post-content\" data-v-128018ef>Sweeping legislation allowing officials from the Australian Federal Police and Australian Criminal Intelligence Commission to target suspected criminals online has passed through the country\u2019s parliament with bipartisan support.<\/p>\n<p>On August 25, the Identify and Disrupt bill <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.innovationaus.com\/extraordinary-new-hacking-powers-pass-parliament\/\">passed<\/a> through Australia\u2019s Senate, introducing three new warrants allowing authorities to take unprecedented action against suspected cybercriminals.<\/p>\n<p>The new warrants include authorizing police to hack the personal computers and networks of suspected criminals, seize control of their online accounts and identities, and disrupt their data. <\/p>\n<p>Home Affairs Minister, Karen Andrews, praised the broad expansion of powers available to Australian authorities targeting cyber actors. \u201cUnder our changes, the AFP will have more tools to pursue organised crime gangs to keep drugs off our street and out of our community, and those who commit the most heinous crimes against children,\u201d she said. <\/p>\n<p>While both the government and opposition supported the legislation, Senator Lidia Thorpe of minor party The Greens slammed the bill for hastening Australia\u2019s march down the path to becoming a \u201csurveillance state:\u201d<\/p>\n<blockquote><p>&#8220;In effect, this Bill would allow spy agencies to modify, copy, or delete your data with a data disruption warrant; collect intelligence on your online activities with a network activity warrant; also they can take over your <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">social media<\/a> and other online accounts and profiles with an account takeover warrant.\u201d\u00a0<\/p><\/blockquote>\n<p>\u201cWhat&#8217;s worse, the data disruption and network activity warrant could be issued by a member of the Administrative <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">App<\/a>eals Tribunal [&#8230;] It is outrageous that these warrants won&#8217;t come from a judge of a superior court,&#8221; she added.<\/p>\n<p>While 60 amendments were made to the legislation after the Parliamentary Joint Committee on Intelligence and Security (PJCIS) recommended changes to the legislation, 10 of the security committee\u2019s 33 suggestions were ignored. <\/p>\n<p>The amendments added to the bill bolster regulatory oversight of the new measures, include strengthened protections for journalists, and sunset the expanded powers after five years.<\/p>\n<p>However, calls for warrants to be exclusively approved by a judge were excluded from the legislation.The PJCIS also recommended that issuance of warrants be restricted to offenses against national security including money laundering, serious narcotics, cybercrime, weapons and criminal association offenses, and crimes against humanity. However, the finalized bill does not include amendments that reduce the scope of offenses in this way.<\/p>\n<p>The government has pledged to revisit the PJCIS\u2019s recommendations through a broad reform of the intelligence surveillance apparatus. <\/p>\n<p><strong><em>Related: <\/em><\/strong><strong><em>Australian Hacker Sentenced to 2 Years in Prison for $300K XRP Theft<\/em><\/strong><\/p>\n<p>Shadow assistant minister of cybersecurity, Tim Wilson, described the PJCIS\u2019 rejected recommendations as offering \u201can important constraint\u201d on authorities exercising the new powers, stating:<\/p>\n<blockquote><p>\u201cWhile we support the bill [&#8230;] safeguards in this bill could go further, particularly in relation to the offenses this bill applies to.\u201d<\/p><\/blockquote>\n<p><template data-name=\"subscription_form\" data-type=\"law_decoded\"><\/template><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
