While Epic could not prove the latter, it did chalk up a big win on the former, assuming the ruling stands.<\/p>\n<blockquote class=\"admonishment_update\"><p><strong>Update, 9\/10\/21:<\/strong> Added Apple and Epic comments on the ruling.<\/p><\/blockquote>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"Judge_Rules_on_Apple_Versus_Epic_Fortnite_Case\"><\/span>Judge Rules on Apple Versus Epic Fortnite Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>As first reported by <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.theverge.com\/2021\/9\/10\/22662320\/epic-apple-ruling-injunction-judge-court-app-store\">The Verge<\/a>, Judge Yvonne Gonzalez-Rogers <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.documentcloud.org\/documents\/21060628-epic-apple-injunction\">issued a ruling<\/a> in the ongoing Apple versus Epic case. She\u00a0issued a permanent injunction that says Apple is \u201cpermanently restrained and enjoined from prohibiting developers from including in their apps and their metadata buttons, external links, or other calls to action that direct customers to purchasing mechanisms.\u201d<\/p>\n<p>That means that developers, such as Epic, can direct people to in-app payment methods outside of the App Store, thus preventing Apple from taking 30% of the transaction.<\/p>\n<p>However, it\u2019s important to note that this won\u2019t start until December 9, 2021, which is 90 days from the ruling.<\/p>\n<p>Even more important to note is that Apple will almost certainly exhaust every appeal available to it in an attempt to reverse the ruling.<\/p>\n<p>The ruling also stated that Apple can\u2019t prevent developers from \u201ccommunicating with customers through points of contact obtained voluntarily from customers through account registration within the app.\u201d This means that developers can use the contact information obtained through the App Store to reach out to customers, similar to the ruling offered by the Japan Fair Trade Commission.<\/p>\n<p>Epic also claimed that Apple was a monopoly with the current App Store situation. However, Judge\u00a0Gonzalez-Rogers ruled that \u201cthe court cannot ultimately conclude that Apple is a monopolist under either federal or state antitrust laws. Nonetheless, the trial did show that Apple is engaging in anti-competitive conduct under California\u2019s competition laws.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Crucial nuance here: I&#8217;ve seen some folks saying Apple has been found to *not* be a monopolist in the Epic <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/game\/\" data-internallinksmanager029f6b8e52c=\"7\" title=\"Game\" target=\"_blank\" rel=\"noopener\">Game<\/a>s verdict. That&#8217;s not quite right. The judge said Epic failed to *prove* Apple a monopolist\u2013but she was careful to leave open the possibility that it is. <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/ArNvV6Owed\">pic.twitter.com\/ArNvV6Owed<\/a><\/p>\n<p>\u2014 Will Oremus (@WillOremus) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/WillOremus\/status\/1436358141638217729?ref_src=twsrc%5Etfw\">September 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>Essentially, that means that Epic couldn\u2019t convince the court that Apple is a monopoly, but it doesn\u2019t unequivocally mean that Apple isn\u2019t one.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Apple\u2019s response to Judge\u2019s ruling in Epic Case: <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/t.co\/LeF4osdTQC\">pic.twitter.com\/LeF4osdTQC<\/a><\/p>\n<p>\u2014 Mark Gurman (@markgurman) <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/twitter.com\/markgurman\/status\/1436360257127653380?ref_src=twsrc%5Etfw\">September 10, 2021<\/a><\/p>\n<\/blockquote>\n<p>Additionally, Epic will be forced to pay Apple\u00a0$3.65 million, which is 30% of the $12,167,719 Epic earned from Fortnite iOS players between August and October 2020, when Epic used its own payment system without permission. On top of that, Epic must pay Apple 30% of the revenue it earned through that method between November 1st and today.<\/p>\n<h2 role=\"heading\" aria-level=\"2\"><span class=\"ez-toc-section\" id=\"What_Does_This_Mean_for_You\"><\/span>What Does This Mean for You?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>As mentioned, this will likely be appealed by Apple in every way it can. That means it could change nothing in terms of the App Store of the mobile payment landscape, or it could change everything.<\/p>\n<p>This could affect both iPhone and Android users if it does stick, as Google has a similar case with Epic.
