data-save-publication=\"false\">\n        <\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>       On a recent blustery September morning, Melissa Taylor stood in front of a gathered crowd in New York City. \u201cNew York State has been waging an economic war against poor people for decades,\u201d <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/us02web.zoom.us\/rec\/play\/zkGDeftSUZUZu27hbvDJrtpTBYEwCzCMxEuOZIkAh1m1FbW-stiVURogcB7wE0M47pHeU_XJcMdZ0FFO.E0JO6XFo7ovg0LzH?continueMode=true&amp;_x_zm_rtaid=KaX1_qGgR9SWxDpIF_xuLg.1632157043648.b783b8bf0b4e193a70f3fb3fe061f0bb&amp;_x_zm_rhtaid=494\" class=\"icon none\">she said<\/a>.\u00a0<\/p>\n<p> Taylor, now 45, said she had been arrested at age 19 for failing to pay an old $90 probation fee that she had not known existed, and spent the night in jail. Other small brushes with the criminal justice system also dogged her: as a teenager, she began driving with a learner\u2019s permit without an adult in the car. Fines and fees for those offenses eventually reached $5,000, keeping her from driving and pursuing her dream of going to college. <\/p>\n<div class=\"paywall\">\n       What Taylor calls \u201ceconomic war against poor people\u201d is well-documented. A Justice Department investigation into the 2014 death of Michael Brown in Ferguson, Missouri, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.justice.gov\/opa\/speech\/attorney-general-holder-delivers-update-investigations-ferguson-missouri\" class=\"icon none\">called<\/a> Brown\u2019s death \u201cdriven by overriding pressure from the city to use law enforcement not as a public service, but as a tool for raising revenue.\u201d<\/p>\n<p>Since that investigation, several states and the District of Columbia have enacted reforms to address the issue, and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.governing.com\/archive\/gov-addicted-to-fines.html\" class=\"icon none\">national media<\/a> are taking a closer look. But new momentum behind <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/nopriceonjustice.org\/wp-content\/uploads\/2021\/04\/End-Predatory-Court-Fees-Act_Explainer_Final_Version1.pdf\" class=\"icon none\">legislation<\/a> in New York, which ranks with far less progressive states in the scope of its punitive fines and fees problem, may go a long way toward galvanizing national reform.\u00a0\u00a0<\/p>\n<p>\u201cFines and fees don\u2019t just plague big cities,\u201d said Antonya Jeffrey, the New York State director for the Fines and Fees Justice Center. <\/p>\n<p>\u201cSmaller cities in our state experience this harm even greater because a lot of the fees are associated with traffic, and you need a car to get around there. If we\u2019re able to accomplish this in New York we\u2019ll set precedents for other states. If New York can be a leader, I can see it helping nationally,\u201d she said.\u00a0<\/p>\n<p>Precise data on the scope of the problem is notoriously hard to collect, in part because it h<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ens at the micro-local level. Those who impose the fees are also reluctant to open their files. <\/p>\n<p>Still, Jeffrey\u2019s group has published extensive research on New York\u2019s problems, sliced and diced several ways. Among them: a dozen New York localities collect more than 20% of their revenues from fines and fees.\u00a0<\/p>\n<p>\u201cPolice acting as armed debt collectors risk Black and Brown lives and extract wealth from New York\u2019s poorest communities,\u201d the Fines and Fees Justice Center writes in a report titled <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/nopriceonjustice.org\/wp-content\/uploads\/2020\/09\/New_York_Ferguson_Problem_NPJ_Report.pdf\" class=\"icon none\">\u201cNew York\u2019s Ferguson Problem.\u201d<\/a><\/p>\n<h6><span class=\"ez-toc-section\" id=\"Fees_add_up\"><\/span>Fees add up<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>While the use of fines can be a legitimate way to discourage violations, it\u2019s the fees that get tacked on top that can add up, as they did for Taylor. Even if a defendant happens to be tried in front of a sympathetic judge, New York State\u2019s \u201cmandatory surcharge\u201d can\u2019t be waived, in part because it\u2019s used to finance the local court system.\u00a0<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n          type-InsetPullQuote\n            inline\n    scope-web|mobileapps\n  article__inset\n          article__inset--type-InsetPullQuote\n            article__inset--inline\n  \"><\/p>\n<div class=\"wsj-article-pullquote article__inset__pullquote \">\n<p class=\"pullquote-content article__inset__pullquote__quote\">\n        <span class=\"l-qt article__inset__pullquote__mark--left\">\u201c<\/span>New York collects far more per capita revenue through fines and forfeitures than most other states, according to a 2017 study: $110 compared to $68 in California, $60 in Illinois, and $41 in North Carolina.\u00a0<span class=\"r-qt article__inset__pullquote__mark--right\">\u201d<\/span><\/p><\/div>\n<\/p><\/div>\n<p>       Fines and fees are also disproportionately levied on poorer people \u2014 mostly communities of color. In 2018, Black people made up 14% of the New York state population, the Fines and Fees Justice Center\u2019s report notes, but accounted for 38% of all arrests and 48% of all prison sentences. Hispanic people accounted for 19% of the population, but 24% of arrest and 22% of sentences.<\/p>\n<p>They are often wielded in what advocates call a predatory manner.\u00a0<\/p>\n<p>\u201cI am routinely harassed by the Suffolk County police who pull me over nearly every other week and ticket me,\u201d wrote Charlie Jones in <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/nopriceonjustice.org\/\" class=\"icon none\">testimony supporting the statewide campaign<\/a>. \u201cI\u2019ve never gotten a DWI or a speeding ticket. Instead, the tickets are for nonsense like \u2018not enough air in my tires,\u2019 \u2018driving without my lights on\u2019 or \u2018obstruction of view because I had a Christmas tree dangling from my rear view mirror. The tickets are about $250 each, half in fines and half in fees that get tacked on top.\u201d\u00a0\u00a0<\/p>\n<p>New York collects far more per capita revenue through fines and forfeitures (seized property) than most other states, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"http:\/\/www.monetarysanctions.org\/wp-content\/uploads\/2017\/04\/Monetary-Sanctions-Legal-Review-Final.pdf\" class=\"icon none\">a 2017 study<\/a>: $110 compared to $68 in California, $60 in Illinois, and $41 in North Carolina.\u00a0<\/p>\n<p>And, as documented in <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/law.yale.edu\/sites\/default\/files\/area\/center\/liman\/document\/fees_fines_and_the_funding_of_public_services.pdf\" class=\"icon none\">a 2020 report from a group of law schools led by Yale<\/a>, New York is home to approximately 1,300 town and village courts that get most of their revenues from fines and fees, suggesting that judges in those jurisdictions \u201chave an incentive to show that their courts earn back the money spent on them, given that they\u2019re funded almost entirely by the locality.\u201d<\/p>\n<p><strong>Related:<\/strong> Black Americans suffered the most under Trump-era consumer-protection agency, study finds<\/p>\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n          type-InsetPullQuote\n            inline\n    scope-web|mobileapps\n  article__inset\n          article__inset--type-InsetPullQuote\n            article__inset--inline\n  \"><\/p>\n<div class=\"wsj-article-pullquote article__inset__pullquote \">\n<p class=\"pullquote-content article__inset__pullquote__quote\">\n        <span class=\"l-qt article__inset__pullquote__mark--left\">\u201c<\/span>\u2018Police acting as armed debt collectors risk Black and Brown lives and extract wealth from New York\u2019s poorest communities.\u2019<span class=\"r-qt article__inset__pullquote__mark--right\">\u201d<\/span><\/p>\n<p>        <small><br \/>\n          <span class=\"inset-author article__inset__pullquote__author\">\u2014 Fines and Fees Justice Center, writing in the report \u201cNew York\u2019s Ferguson Problem\u201d<\/span><br \/>\n        <\/small><\/p><\/div>\n<\/p><\/div>\n<p>       Aravind Boddupalli is an analyst in the Urban-Brookings Tax Policy Center. Like many researchers, Boddupalli said, he found himself drawn to the fines and fees issue by the 2015 Justice Department report on Ferguson, which he called \u201ca huge reveal of something advocates had been talking about for a while.\u201d<\/p>\n<p> That conflict of interest inherent in courts or municipalities levying fees to fund their operations is \u201cnot about budget gaps, but more a predatory fee instituted to make sure we can keep the cycle going of charging primarily low-income defendants,\u201d Boddupalli told MarketWatch. <\/p>\n<p>\u201cIt\u2019s the clearest picture of where the criminal justice system\u2019s inequities come into state and local revenue collections, which we normally consider a colorblind system.\u201d<\/p>\n<p>The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/nopriceonjustice.org\/wp-content\/uploads\/2021\/04\/End-Predatory-Court-Fees-Act_Explainer_Final_Version1.pdf\" class=\"icon none\">End Predatory Court Fees Act<\/a> was introduced in Albany in 2020 by two progressives, Senator Julia Salazar and Assemblymember Yuh-Line Niou. Neither responded to MarketWatch requests for comment.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"Relying_on_law_breaking_for_revenue\"><\/span>Relying on law breaking for revenue<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>In Washington, Sen. Chris Coons, a Democrat from Delaware, and Sen. Roger Wicker, a Mississippi Republican, introduced the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/998\/text\" class=\"icon none\">\u201cDriving for Opportunity Act,\u201d<\/a> reflecting a recognition, Boddupalli noted, that these methods aren\u2019t just unjust, but also a \u201ccounterintuitive penalty\u201d to keep people from their means of getting to work, and from accessing health care.\u00a0<\/p>\n<div data-layout=\"inline\n                \" data-layout-mobile=\"\" class=\"\n          media-object\n          type-InsetPullQuote\n            inline\n    scope-web|mobileapps\n  article__inset\n          article__inset--type-InsetPullQuote\n            article__inset--inline\n  \"><\/p>\n<div class=\"wsj-article-pullquote article__inset__pullquote \">\n<p class=\"pullquote-content article__inset__pullquote__quote\">\n        <span class=\"l-qt article__inset__pullquote__mark--left\">\u201c<\/span>\u2018We are trying to raise revenues for programs that localities really do need but why are we trying to do it on the backs of people who can least afford it?\u2019<span class=\"r-qt article__inset__pullquote__mark--right\">\u201d<\/span><\/p>\n<p>        <small><br \/>\n          <span class=\"inset-author article__inset__pullquote__author\">\u2014 Antonya Jeffrey, the New York State director for the Fines and Fees Justice Center<\/span><br \/>\n        <\/small><\/p><\/div>\n<\/p><\/div>\n<p>       Politicians not normally drawn to progressive causes also note that it\u2019s a regressive,  inefficient revenue raiser \u2014 it costs anywhere from 40 cents to $1.15 to bring in a dollar of fines and fees revenue \u2014 and above all, a method that relies on a cycle of law breaking to work. <\/p>\n<p> Still, the injustice is what motivates advocates like Jeffrey.\u00a0<\/p>\n<p>\u201cFor me, it is really about the unfair playing field that currently exists for people of color and low-income communities,\u201d she said in an interview. \u201cNot being able to catch a break even if they are, quote unquote law abiding citizens.
