“#Man who killed Texas protester Garrett Foster released, claims self defense<\/strong>”<\/p>\n

\n The driver who shot dead Texas Black Lives Matter protester Garrett Foster was released within 24 hours \u2014 claiming he was defending himself after being threatened with an AK-47-style rifle, according to cops.<\/p>\n

The unidentified driver was released by homicide cops without charge Sunday pending an ongoing investigation over the deadly shooting at the previous night\u2019s rally in Austin, police said.<\/p>\n

Garrett, 28, died from multiple gunshot wounds at the march, where friends say he had been with his quadruple-amputee fianc\u00e9e, for whom he had quit the Air Force to be a full-time caregiver.<\/p>\n

The driver sped off, but called 911 and told officers during interviews that he \u201chad shot someone who had app<\/a>roached the driver\u2019s window of their vehicle and pointed a rifle at them,\u201d Austin police chief Brian Manley said.<\/p>\n

\u201cDuring the initial investigation of this incident, it appears that Mr. Foster may have pointed his weapon at the driver of this vehicle prior to being shot,\u201d Manley said in a Zoom press conference Sunday.<\/p>\n

\u201cMr. Foster \u2014 who was holding an AK-47-type assault rifle \u2014 approached the driver\u2019s side window as others in the crowd began striking the vehicle,\u201d Manley said of witness statements.<\/p>\n

The driver\u2019s \u201caccount is that Mr. Foster pointed the weapon directly at him and he fired his handgun at Mr. Foster,\u201d Manley said.<\/p>\n

After opening fire, the driver sped off \u2014 and another protester \u201cfired multiple shots at the vehicle as it drove away,\u201d Manley said.<\/p>\n

Both shooters had licenses to carry a concealed handgun and were released Sunday pending the ongoing investigation, Manley said.<\/p>\n

The police chief did not say if Foster had a license, but it is legal in Texas to openly carry a rifle like an AK-47 without one, The Dallas Morning News<\/a> noted.<\/p>\n

\u201cWe are heartbroken over the loss of Mr. Foster last night,\u201d Manley said.<\/p>\n

Witnesses had claimed the car drove through the protest \u2014 only coming to a stop when it hit a barricade \u2014 but the police chief refused to comment on what the driver said he had been doing.<\/p>\n

Foster\u2019s sister, Anna Mayo, told the Statesman that her brother was passionate about his Second Amendment rights \u2014 but \u201cwould have never, ever pointed a gun at somebody.\u201d<\/p>\n

\u201cHe always carried his guns with him \u2026 He always would exercise his right to carry, but he would never threaten somebody,\u201d she insisted.<\/p>\n

\u201cHe was one of the most kindhearted people \u2014 that was the whole reason he was out there.\u201d<\/p>\n

The protests were also important for him because of his relationship with his fianc\u00e9e, Whitney Mitchell, who is black, his sister told the paper.<\/p>\n

\u201cThey\u2019ve experienced so much hate just for their relationship in general<\/a>,\u201d Mayo said. \u201cFrom day one, he\u2019s fought to end that.\u201d<\/p>\n

Foster had quit the Air Force to care for Mitchell after she had all four limbs amputated after she developed a medical condition that led to sepsis in 2011.<\/p>\n

\u201cHe\u2019s been doing it ever since,\u201d his mother, Sheila Foster, told The Dallas Morning News. \u201cHe loved that woman unconditionally.\u201d<\/p>\n

Mitchell\u2019s mother, Patricia Kirven, told the Dallas Morning News she warned her daughter about going to the protests.<\/p>\n

\u201cI told her not to go. I was afraid something would happen,\u201d Kirven said.<\/p>\n

\u201cShe physically is OK, but mentally she is not. \u2018Inconsolable\u2019 is the only word I can think of, because she\u2019ll talk for a bit and then break down.\u201d\n <\/p><\/div>\n
