href=\"https:\/\/www.congress.gov\/117\/bills\/hr3684\/BILLS-117hr3684eas.pdf\" class=\"icon none\">more than 2,700 pages<\/a> of text, the bipartisan infrastructure bill is chock-full of provisions \u2014 including one that mandates new technology to prevent drunk driving.<\/p>\n<p> Such technology, says one auto-industry executive working to develop it, involves breath-based or touch-based sensors that function without drivers having to do anything differently as they start their engines. <\/p>\n<div class=\"paywall\">\n       \u201cIt\u2019s novel technology that will be able to measure your either breath or blood alcohol concentration \u2014 very rapidly with high precision and accuracy \u2014 without you doing anything that you aren\u2019t doing now, when you\u2019re interacting with your car,\u201d said Robert Strassburger, president and CEO of the Automotive Coalition for Traffic Safety, a group based in the Washington, D.C., area and made up of the major automakers, including Ford<br \/>\n        F,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/208911460\/composite\" class=\"negative\">-0.31%<\/bg-quote><span>,<\/span><br \/>\n       GM<br \/>\n        GM,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/205226835\/composite\" class=\"positive\">+2.54%<\/bg-quote><span>,<\/span><br \/>\n       Chrysler parent Stellantis<br \/>\n        STLA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/204248628\/composite\" class=\"negative\">-0.15%<\/bg-quote><span>,<\/span><br \/>\n       Toyota<br \/>\n        TM,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/200537742\/composite\" class=\"positive\">+3.02%<\/bg-quote><span>,<\/span><br \/>\n       Volkswagen<br \/>\n        VOW3,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/203434344\/delayed\" class=\"positive\">+1.23%<\/bg-quote><br \/>\n       and Honda<br \/>\n        HMC,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/207173990\/composite\" class=\"positive\">+1.61%<\/bg-quote><span>.<\/span>\n      <\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>\u201cIf you are over the legal limit, or some other limit that you might set, it would not allow the car to start, or the car would start but not move, or give you a warning, depending on how it\u2019s integrated into a vehicle. All three of those are options,\u201d Strassburger added.<\/p>\n<p>\u201cUltimately, it would give you, the driver, or you, the parent, the added peace of mind that you yourself are good to go, or your child maybe driving the car that night is good to go.\u201d <\/p>\n<p>The maximum level for blood alcohol content (BAC) in nearly all U.S. states is 0.08% for people 21 or older.<\/p>\n<p>The bipartisan infrastructure bill, known as the Infrastructure Investment and Jobs Act, says the U.S. Department of Transportation, acting through the National Highway Traffic Safety Administration, must issue a new standard for \u201cadvanced drunk and impaired driving prevention technology\u201d in new vehicles no later than three years after the bill\u2019s enactment, meaning potentially in 2024. The bill is silent on other details, such as whether the anti-drunk driving technology definitely would immobilize a car, or only give a warning. <\/p>\n<p>The Democratic-run Senate passed the infrastructure bill on Aug. 10 in a 69-30 vote, and the House of Representatives <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>roved the measure late Friday in a 228-206 vote, sending it over to President Joe Biden to get signed into law.\u00a0Biden plans to do the signing on Monday, according to the White House.<\/p>\n<p>The NHTSA and the Automotive Coalition for Traffic Safety, Strassburger\u2019s group, have been working together to develop the new technology through what\u2019s known as the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.dadss.org\/\" class=\"icon none\">Driver Alcohol Detection System for Safety research program<\/a>, or DADSS. The program is tackling a big problem, as an estimated 10,000-plus people are killed each year in the U.S. because of drunk driving.<\/p>\n<p>\u201cThat\u2019s a tragedy in and of itself, and for every person that is lost, there\u2019s untold family members, colleagues, etc. that are impacted as well,\u201d Strassburger said.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"Privacy_concerns\"><\/span>Privacy concerns<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>Automakers are aware of the privacy worries raised by the new technology to prevent drunk driving, Strassburger said.<\/p>\n<p>\u201cWe think we\u2019ve addressed that with the \u2018Consumer Privacy Protection Principles,&#8217;\u201d he said, referring to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.autosinnovate.org\/initiatives\/innovation\/automotive-privacy\" class=\"icon none\">guidelines for personal data<\/a> that carmakers have agreed to meet or exceed. \u201cThere are other concerns related to that. We\u2019re committed to addressing those concerns.\u201d<\/p>\n<p>Strassburger said surveys have found about 75% of respondents think the DADSS program is a good idea.<\/p>\n<p>\u201cSurprisingly, those that identify as heavy drinkers actually wanted more. They want the help,\u201d he told MarketWatch.<\/p>\n<p>The Center for Democracy &amp; Technology\u2019s Samir Jain, meanwhile, argues there should be more protections for personal information than the industry principles. His organization advocates for privacy rights and for stronger controls on surveillance programs.<\/p>\n<p>\u201cIndustry best practices alone \u2014 it\u2019s usually not a reliable or foolproof way of really protecting user privacy, because they have their particular interests, and sometimes may not appreciate all the concerns,\u201d said Jain, who is the organization\u2019s director of policy and a former Obama administration official.<\/p>\n<p>Jain also said there might not be significant privacy concerns around the technology as it rolls out in the years ahead if it were configured to simply not allow a car to be operated when a driver was found to be drunk, but it \u201cdidn\u2019t collect any data about the fact that that had happened.\u201d<\/p>\n<p>The Electronic Frontier Foundation\u2019s Lee Tien said nobody wants drunk drivers, but at the same time \u201cyou want to be really careful that any system of technology that is basically driving surveillance doesn\u2019t go beyond what it needs to be.\u201d   <\/p>\n<p>\u201cMission creep is a big issue,\u201d said Tien, who is a senior staff attorney and Adams Chair for Internet Rights at the EFF, a digital rights group. \u201cThere\u2019s so much incentive, between the public and the private sector, to say, \u2018Well, we could force people to collect this information,\u2019 and, \u2018We would really like it if you did. We could use the information.\u2019 Companies and the government sort of have aligned interests, and they\u2019re kind of not aligned with consumers.\u201d<\/p>\n<p>Tien said the infrastructure bill doesn\u2019t appear to have language that addresses worries about privacy and data security, but it should. He also pointed to a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.highways.org\/wp-content\/uploads\/2020\/07\/HU-DADSS-Support-Letter-June-2020-Senate-Commerce-revised-3.pdf\" class=\"icon none\">2020 letter<\/a> about the new technology to lawmakers from the American Highway Users Alliance, saying it made quite a few good points, such as on privacy concerns and the potential for false positives and false negatives. <\/p>\n<p>That letter says in part that it\u2019s \u201cextremely important that a technology designed to control human behavior not be imposed before it is clear that civil liberties are protected.\u201d The highway users group didn\u2019t respond to a request for comment.<\/p>\n<h6><span class=\"ez-toc-section\" id=\"%E2%80%98Straight-up_fools\"><\/span>\u2018Straight-up fools\u2019<span class=\"ez-toc-section-end\"><\/span><\/h6>\n<p>The Automotive Coalition for Traffic Safety\u2019s Strassburger said work related to the new technology to prevent drunk driving began about 20 years ago with winning over naysayers. The skeptics in those days included a former NHTSA administrator who said the technology\u2019s supporters were \u201cstraight-up fools\u201d because it would never work and would never be accepted by consumers, he said.<\/p>\n<p>When it comes to getting drivers to support the technology, Strassburger said one key for the DADSS program has been \u201cthat whatever we do, we want to do it with the consumer, not to the consumer.\u201d   <\/p>\n<p>\u201cMany of the safety initiatives of the early days at least were things that were done to consumers \u2014 you will have a belt, you will use it,\u201d he said. \u201cWe want to be able to educate consumers about the technology, make them aware of it, gain their acceptance of it, and thus when we\u2019re ready to deploy it, they are asking for it.\u201d<\/p>\n<p>The <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.actsautosafety.org\/post\/technologyannouncement\" class=\"icon none\">DADSS program announced<\/a> a milestone over the summer, saying it will have a breath-based product available for licensing in commercial vehicle fleets later this year.<\/p>\n<p>\u201cWe\u2019ll begin first with the breath technology for fleets. We hope to follow that in 2023 with the touch technology for fleets, and then in 2024, the breath technology for all vehicles, and in 2025, the touch technology for all vehicles,\u201d Strassburger said. Tesla<br \/>\n        TSLA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/203558040\/composite\" class=\"negative\">-2.83%<\/bg-quote><br \/>\n       is \u201cnot supporting this research in any way, either financially or with technical expertise, nor is Jaguar Land Rover, but other than that we\u2019ve got everybody else supporting it,\u201d he said.<\/p>\n<p>Tesla, which has preferred to go it alone in other areas, didn\u2019t respond to a request for comment.<\/p>\n<p>A variety of lobbying groups in Washington, D.C., have expressed support for the anti-drunk driving technology. Praise for having it in the infrastructure bill came from <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.madd.org\/press-release\/senate-passes-bipartisan-provision-for-drunk-driving-prevention-tech-in-all-new-cars\" class=\"icon none\">Mothers Against Drunk Driving<\/a> and the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.distilledspirits.org\/news\/statement-by-chris-swonger-president-ceo-distilled-spirits-council-and-responsibility-org-on-passage-of-the-senate-infrastructure-investment-and-jobs-act\/\" class=\"icon none\">Distilled Spirits Council of the United States<\/a>, which advocates for the liquor industry.<\/p>\n<p>Democratic Sen. Ben Ray Luj\u00e1n of New Mexico said in a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.lujan.senate.gov\/press-releases\/lujan-secures-inclusion-of-drunk-and-impaired-driving-prevention-measures-in-bipartisan-infrastructure-legislation\/\" class=\"icon none\">statement<\/a> that he secured the inclusion of the provision related to impaired driving in the infrastructure bill. That\u2019s after he and Republican Sen.
