<\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>       Is three going to be the new two?<\/p>\n<p> With employer vaccination requirements already widespread, workplace experts say it\u2019s possible some companies will convert their full vaccination requirement, now two shots, into a three-shot requirement as the omicron variant emerges.<\/p>\n<p>Pfizer<br \/>\n        PFE,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202877789\/composite\" class=\"negative\">-0.62%<\/bg-quote><br \/>\n       and BioNTech<br \/>\n        BNTX,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/214419716\/composite\" class=\"negative\">-3.55%<\/bg-quote><br \/>\n       said three of its vaccine doses can \u201cneutralize\u201d the omicron variant, while two doses may not be enough to prevent infection, according to very early-stage results released Wednesday.<\/p>\n<div class=\"paywall\">\n       The vaccine makers emphasized the results come from preliminary laboratory studies. That echoes public health officials like Dr. Anthony Fauci, President Joe Biden\u2019s medical adviser, who say early <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> may be encouraging, but it\u2019s still very early in the process of understanding omicron\u2019s threat.<\/p>\n<p>\u201cI think the days \u2014 at least for Pfizer and Moderna \u2014 the days you were considered fully vaccinated with two shots are going to be a thing of the past,\u201d said Christopher Feudo, a partner at the Boston-based law firm Foley Hoag representing management in employment law matters.<\/p>\n<p>Even before omicron\u2019s rise, Feudo had been fielding calls from clients curious about whether they could require their employees to get boosters too. \u201cI say yeah, why not?\u201d<\/p>\n<p>The same legal leeway that allows companies to institute vaccination requirements at all should also let them alter the requirements to three shots, Feudo said. To his knowledge, none has followed through with a booster requirement yet, but he wouldn\u2019t be surprised if companies eventually did.<\/p>\n<p>Like Feudo, employment lawyer Erin McLaughlin expects some of the companies she represents to tack on booster shot requirements. \u201cI think it\u2019s coming,\u201d said McLaughlin, a partner at the national law firm Buchanan Ingersoll &amp; Rooney. The same companies that felt strong enough to require vaccines in the name of protecting their workforce will \u201c<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly that same rationale to the booster,\u201d she said.<\/p>\n<p>Some employers are thinking about folding boosters into the workplace and some are already doing it \u2014 including the NBA.<\/p>\n<p>The professional basketball league does not have a vaccine mandate, but approximately <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.usatoday.com\/story\/sports\/nba\/2021\/12\/07\/unvaccinated-nba-players-wont-allowed-travel-canada\/6419758001\/\" class=\"icon none\">97% <\/a>of its players are vaccinated.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>Starting Dec. 17, players who have not received a booster shot have to undergo <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/game\/\" data-internallinksmanager029f6b8e52c=\"7\" title=\"Game\" target=\"_blank\" rel=\"noopener\">game<\/a> day COVID-19 testing before they step on the court, according to a league memo reviewed by MarketWatch.<\/p>\n<p>The memo is dated Dec. 3, a week after the World Health Organization labeled omicron a \u201cvariant of concern.\u201d The memo also says team personnel without a booster by Dec. 17 cannot <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">travel<\/a> with the team or be near other players. There are exceptions to the rule if it\u2019s still too soon for players or personnel to get the additional jab, the memo noted.<\/p>\n<p>Other employers are going slower on boosters, which the U.S. Centers for Disease Control and Prevention is <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.cdc.gov\/media\/releases\/2021\/s1129-booster-recommendations.html\" class=\"icon none\">advising<\/a> for all adults six months after they\u2019ve been fully vaccinated with the Pfizer\/BioNTech shot or the Moderna<br \/>\n        MRNA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/205619834\/composite\" class=\"positive\">+0.37%<\/bg-quote><br \/>\n       shot. The CDC advises a booster two months after the Johnson &amp; Johnson<br \/>\n        JNJ,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/201724570\/composite\" class=\"positive\">+0.60%<\/bg-quote><br \/>\n       shot.<\/p>\n<p>\u201cI see employers right now collecting data on boosters and encouraging them. But mandates remain focused on primary vaccination. We might have a new definition of fully vaccinated in the future,\u201d said Dr. Jeff Levin-Scherz, population health leader at Willis Towers Watson<br \/>\n        WLTW,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202694274\/composite\" class=\"positive\">+1.46%<\/bg-quote><span>,<\/span><br \/>\n       which provides human resources consulting.<\/p>\n<p>Even with omicron, Levin-Scherz noted \u201cboosters work better when delivered later, so we don\u2019t want to encourage people to \u2018rush\u2019 to get a booster prematurely.\u201d A booster requirement by a certain date could potentially exclude a vaccinated worker who\u2019s still within the booster timeframe, he noted.<\/p>\n<p>It\u2019s absolutely worth encouraging boosters, said Dr. William Schaffner, an infectious diseases professor at the Vanderbilt University School of Medicine.<\/p>\n<p>But companies and government officials should think hard about requiring three shots, he said. \u201cThe notion of redefining for practical purposes what fully vaccinated is would make things more confusing than they already are,\u201d Schaffner said.<\/p>\n<p>Just over <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/covid.cdc.gov\/covid-data-tracker\/#vaccinations_vacc-total-admin-rate-total\" class=\"icon none\">a quarter of America\u2019s adult population<\/a> has received a booster shot, according to the CDC. Almost 72% of the adult population has either had two Pfizer or Moderna shots, or one Johnson &amp; Johnson shot, the agency said.<\/p>\n<p>Meanwhile, workplace vaccination requirements are spreading. Three in 10 workers say their employers required them to get vaccinated, according to a recent survey from the <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.kff.org\/coronavirus-covid-19\/poll-finding\/kff-covid-19-vaccine-monitor-november-2021\/\" class=\"icon none\">Kaiser Family Foundation.<\/a> The 29% rate in November is up from 25% in October.<\/p>\n<p>More than half of employers either have mandates in place or will require one if the Occupational Safety and Health Administration (OSHA) rules requiring vaccines at private businesses with 100 or more employees take effect, according to a recent Wills Towers Watson <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.willistowerswatson.com\/en-US\/News\/2021\/11\/over-half-of-us-employers-will-require-employee-vaccines-willis-towers-watson-survey-finds\" class=\"icon none\">survey<\/a>.<\/p>\n<p>The rules \u2014 which were supposed to go into effect on Jan. 4 \u2014 are on pause due to pending federal court challenges. (\u201cBooster shots and additional doses are not included in the definition of fully vaccinated\u201d OSHA said in <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.osha.gov\/coronavirus\/ets2\/faqs\" class=\"icon none\">an explanation <\/a>of its COVID-19 vaccine-related regulations.)<\/p>\n<p>The pending cases about federal rules on vaccine rules hinge on the question of whether the government overstepped its power in mandating that businesses require vaccines, Feudo said. On the other hand, lawsuits fighting a private employer\u2019s decision to make their own rules have been unsuccessful, he noted.<\/p>\n<p>That matters if employers are going to require boosters some day, he said. \u201cI don\u2019t see a distinction between regular doses and a booster in the eyes of the law in terms of the employer\u2019s ability to mandate vaccines.\u201d<\/p>\n<p>More requirements may involve more goading of workers and shifting requirements for some people who are not in the mood for more, Schaffner said. \u201cThis is not the time for the coach to say, \u2018You have run around another half mile here.\u2019\u201d<\/p>\n<p>For Schaffner, it goes back to avoiding more twists in a complicated situation. \u201cOne of the principles of translating <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/sciencee\/\" data-internallinksmanager029f6b8e52c=\"5\" title=\"Science\" target=\"_blank\" rel=\"noopener\">science<\/a> to public policy is K.I.S.S. \u2014 \u2018keep it simple stupid.\u2019\u201d<\/p>\n<p>Simplicity and clarity are in short supply when it comes to workplace COVID-19 laws, McLaughlin said.
