But what Facebook is doing lately is just sleazy.\u00a0<\/p>\n<p>Recently, I sued them because they defamed me. They, along with one of their \u201cfact-checkers,\u201d a group called <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/sciencee\/\" data-internallinksmanager029f6b8e52c=\"5\" title=\"Science\" target=\"_blank\" rel=\"noopener\">Science<\/a> Feedback, lied about me and continue to lie about me.<\/p>\n<p>Now Facebook has responded to my lawsuit in court.<\/p>\n<p>Amazingly, their lawyers now claim that Facebook\u2019s \u201cfact-checks\u201d are merely \u201copinion\u201d and therefore immune from defamation.<\/p>\n<p>Wait \u2014 Facebook\u2019s fact-checks are just \u201copinion\u201d?! I thought fact-checks are statements of fact.<\/p>\n<p>That\u2019s how Facebook portrays them on its website: \u201cEach time a fact-checker rates a piece of content as false, Facebook significantly reduces the content\u2019s distribution \u2026 We \u2026 <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ly a warning label that links to the fact-checker\u2019s article, disproving the claim.\u201d<\/p>\n<p>\u201cDisproving.\u201d Sure sounds like Facebook claims its labels are statements of fact.\u00a0<\/p>\n<p>Facebook\u2019s \u201copinion\u201d defense is similar to what Tucker Carlson and Rachel Maddow argued when they were sued. They said we just give opinions; our viewers knew we aren\u2019t sources for objective facts.\u00a0<\/p>\n<p>But Carlson and Maddow have a better argument. They\u2019re known for giving opinions. Facebook posts \u201cfact-checks.\u201d<\/p>\n<h2><span class=\"ez-toc-section\" id=\"I_never_said_that\"><\/span>I never said that!<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The company, which now calls itself Meta, also asked a judge to toss my lawsuit \u201cbecause Section 230 of the Communications Decency Act protects Meta from liability for material posted to the Facebook platform by third parties.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/12\/facebook-lawsuit-436.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"A woman holds smartphone with Facebook logo in front of a displayed Facebook's new rebrand logo Meta.\" class=\"wp-image-20481472\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/12\/facebook-lawsuit-436.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/12\/facebook-lawsuit-436.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/12\/facebook-lawsuit-436.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Facebook says its censors are protected by \u201cSection 230 of the Communications Decency Act.\u201d<\/figcaption><figcaption><span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>But it was Facebook, not just a third party, that declared my posts \u201cpartly false.\u201d Facebook\u2019s warning was created by Facebook and posted in Facebook\u2019s voice.\u00a0<\/p>\n<p>As Facebook\u2019s own website says: \u201cWe \u2026 apply a warning label \u2026\u201d<\/p>\n<p>I brought Facebook\u2019s defamation to their attention a year ago, and they did nothing to correct it.\u00a0<\/p>\n<p>I did not want to sue Facebook. I hate lawsuits. But after they defamed me, I felt I had no choice.\u00a0<\/p>\n<p>How did Facebook defame me?\u00a0<\/p>\n<p>I made a video that said that <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=N-xvc2o4ezk\">California\u2019s wildfires<\/a> were mostly caused by poor government management. Facebook censored that as \u201cmisleading.\u201d They linked to a Science Feedback post that puts the following sentence in quotation marks, as if it were something I said: \u201cForest fires are caused by poor management. Not by climate change.\u201d\u00a0<\/p>\n<p>But I never said that!\u00a0<\/p>\n<p>Facebook\u2019s reviewers took that quotation from someone else. Or maybe they just made it up?<\/p>\n<p>In my video, I acknowledge, \u201cClimate change has made things worse!\u201d I just argued that government mismanagement was a bigger factor. Two agreed to on-camera interviews. When I asked what was misleading about my video, they surprised me by saying that they hadn\u2019t even watched my video! They offered no defense for posting words in quotation marks that I\u2019d never said.\u00a0<\/p>\n<p>I notified Facebook. No luck.<\/p>\n<p>Facebook\u2019s refusal to acknowledge its mistake hurts me because when Facebook fact-checks something, its algorithm makes sure fewer people see that video.<\/p>\n<p>That hurt me. But I hate lawsuits, so I didn\u2019t sue.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_wrong_%E2%80%98tone\"><\/span>The wrong \u2018tone\u2019<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Then Facebook struck again.<\/p>\n<p>They declared a video I did about the climate \u201ccrisis\u201d partly false. This video, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.youtube.com\/watch?v=b8JZo6PzpCU\">\u201cAre We Doomed,\u201d<\/a> said that climate change is real but suggested that we can adapt to it, as Holland has. That video received 24 million views on Facebook. But after that second Facebook smear, viewership stopped.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2021\/12\/facebook-lawsuit-437.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"A sign at Facebook headquarters in Menlo Park, Calif. I still get millions of views via YouTube, Rumble, etc., but I used to get most of my views from Facebook. No more.<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>I asked a Science Feedback reviewer what was wrong with my climate-crisis video, and he admitted that he and his other fact-checkers found no incorrect facts. Instead, they simply didn\u2019t like my tone.\u00a0<\/p>\n<p>\u201cThe problem is the omission of contextual information rather than specific \u2018facts\u2019 being wrong,\u201d he said.<\/p>\n<p>What? It\u2019s fine if people don\u2019t like my tone. But Facebook declares my post \u201cpartly false,\u201d a term it defines on its website as including \u201cfactual inaccuracies.\u201d<\/p>\n<p>My video does not contain factual inaccuracies. Again, I pointed this out to \u00adFacebook.
