channel=\"\/zigman2\/quotes\/205453964\/composite\" class=\"positive\">+0.63%<\/bg-quote><br \/>\n       is in the hottest of hot seats as the antitrust spotlight intensifies on Big Tech, with multiple actions expected to come to a head in 2022. <\/p>\n<p> A rumored Justice Department lawsuit targeting Google\u2019s digital advertising practices tops its list of regulatory headaches heading into the new year. The suit, which would be the second monopoly case against the company\u2019s ad business, is the outgrowth of an accelerated investigation.<\/p>\n<div class=\"paywall\">\n       Google already faces an antitrust case from a\u00a0group of 36 state attorneys <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a>  and the District of Columbia that asserts the company\u2019s mobile <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a> store abuses its market power and forces aggressive terms on software developers. A Utah-led lawsuit targets Google\u2019s Play app store. Those cases are set for trial in 2023 or later.<\/p>\n<p>Wilson White, Google\u2019s senior director of public policy, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blog.google\/outreach-initiatives\/public-policy\/lawsuit-ignores-choice-android-and-google-play\/\" class=\"icon none\">argued <\/a>such litigation \u201ccompletely ignores the competition we face from other platforms, such as Apple\u2019s incredibly successful App Store, which accounts for the majority of mobile app-store\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/appleinsider.com\/articles\/21\/01\/05\/app-store-earns-723-billion-in-2020-almost-double-google-play-revenues\" class=\"icon none\">revenues<\/a>\u00a0according to third-party estimates.\u201d<\/p>\n<p>Yet another suit, led by Texas Attorney General Ken Paxton and joined by 15 states, claims Google commands a cut of 22% to 42% of U.S. ad spending that goes through its systems, according to\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/attorneys-general-launch-probe-of-google-11568055853?mod=article_inline&amp;mod=article_inline\" class=\"icon none\">a newly unredacted lawsuit<\/a>. The complaint alleges Google\u2019s advertising exchange, AdX, charges a fee of between 19% and 22% of the prices advertisers are paying on the exchange to reach publishers  \u2014 double to quadruple what AdX\u2019s nearest competitors charge, according to the suit.<\/p>\n<p>In refuting Paxton\u2019s \u201cmisleading\u201d suit in a detailed <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blog.google\/outreach-initiatives\/public-policy\/ag-paxtons-misleading-attack-on-our-ad-tech-business\/\" class=\"icon none\">blog post<\/a>, Adam Cohen, Google\u2019s director of economic policy, asserted the online advertising market is \u201cfamously crowded\u201d with the likes of Adobe Inc.<br \/>\n        ADBE,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/200389143\/composite\" class=\"positive\">+1.41%<\/bg-quote><span>,<\/span><br \/>\n       Amazon<br \/>\n        AMZN,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/210331248\/composite\" class=\"negative\">-0.82%<\/bg-quote><span>,<\/span><br \/>\n       AT&amp;T Inc.<br \/>\n        T,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/203165245\/composite\" class=\"negative\">-0.36%<\/bg-quote><span>,<\/span><br \/>\n       Comcast Corp.<br \/>\n        CMCSA,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/209472081\/composite\" class=\"positive\">+0.88%<\/bg-quote><span>,<\/span><br \/>\n       Meta<br \/>\n        FB,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/205064656\/composite\" class=\"positive\">+3.26%<\/bg-quote><span>,<\/span><br \/>\n       Oracle Corp.<br \/>\n        ORCL,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/202180826\/composite\" class=\"negative\">-0.20%<\/bg-quote><span>,<\/span><br \/>\n       <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Twitter<\/a> Inc.<br \/>\n        TWTR,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/203180645\/composite\" class=\"positive\">+0.38%<\/bg-quote><br \/>\n       and Verizon Communications Inc.<br \/>\n        VZ,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/204980236\/composite\" class=\"\"><\/bg-quote><span>.<\/span><br \/>\n       Furthermore, he said Google\u2019s ad tech fees are\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.emarketer.com\/chart\/229879\/one-third-of-us-nonsocial-programmatic-display-ad-spending-goes-fees-this-year-2019-billions-of-total\" class=\"icon none\">lower than reported industry averages<\/a>.<\/p>\n<p>A bipartisan bill from Sens. Richard Blumenthal, D-Conn., Marsha Blackburn, R-Tenn., and Amy Klobuchar, D-Minn., called the Open App Markets Act, will \u201ctear down coercive anticompetitive walls in the app economy, giving consumers more choices and smaller startup tech companies a fighting chance,\u201d Blumenthal said. <\/p>\n<p>Meanwhile, Epic <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/game\/\" data-internallinksmanager029f6b8e52c=\"7\" title=\"Game\" target=\"_blank\" rel=\"noopener\">Game<\/a>s Inc., maker of the popular \u201cFortnite\u201d videogame, is scheduled to face off with Google in court over claims Google engaged in antitrust behavior through its app store. The case mirrors the Apple-Epic court showdown earlier this year.<\/p>\n<p>Then there is the situation in Europe, where more aggressive antitrust authorities have fined Google billions of dollars over the years and are sharpening digital competition and content moderation laws. <\/p>\n<p>Recent updates to the Digital Markets Act (DMA) and Digital Services Act (DSA), which could be adopted by mid-2022, would force Google, Apple and others to better police content on their platforms and to boost digital competition. Violators could face fines of up to 10% of their global revenue.<\/p>\n<div id=\"cx-membership-tile\"><\/div>\n<p>In a <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blog.google\/around-the-globe\/google-europe\/the-digital-services-act-must-not-harm-europes-economic-recovery\/\" class=\"icon none\">blog post<\/a>, Karan Bhatia, vice president of global public affairs and government relations at Google, contended some updates to the DSA \u201cwould prevent global <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/technology\/\" data-internallinksmanager029f6b8e52c=\"4\" title=\"Technology\" target=\"_blank\" rel=\"noopener\">technology<\/a> companies like Google from building innovative digital tools like the ones that people have used through lockdown \u2014 and that will help European businesses rebuild their operations.\u201d Small businesses, in particular, would be adversely impacted, Bhatia added.<\/p>\n<p>The broad takeaway from Google\u2019s blog posts is that competition is thriving in the ad-tech and app-store markets.<\/p>\n<p>And yet, Google has lowered the temperature with several actions. In October, it said it was slashing its app-store fees in half, to 15%, for most developers, effective Jan. 1. In November, Google announced it would allow third-party payment options for in-app purchases on Google Play.<\/p>\n<p>The crush of lawsuits and legislation carry a tinge of irony since Google emerged as a shining example of innovation during the late 1990s, as the Justice Department cracked down on Microsoft Corp.\u2019s<br \/>\n        MSFT,<br \/>\n        <bg-quote field=\"percentchange\" format=\"0,000.00%\" channel=\"\/zigman2\/quotes\/207732364\/composite\" class=\"positive\">+2.32%<\/bg-quote><br \/>\n       anticompetitive practices. But these are the regulatory times the digital economy now finds itself in.<\/p>\n<p>\u201cThere is a growing \u2018tech-lash\u2019, but the tech sector has advanced major innovation. I am a proponent for federal standards of privacy legislation,\u201d venture-capital legend John Doerr, an early backer of Google and Amazon as well as an Alphabet board member, told MarketWatch. \u201cBut not legislation that would put a damper on M&amp;A and hurt the industry.
