{"id":392808,"date":"2022-01-12T01:27:27","date_gmt":"2022-01-11T22:27:27","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/ftc-can-proceed-with-facebook-lawsuit\/"},"modified":"2022-01-12T01:27:27","modified_gmt":"2022-01-11T22:27:27","slug":"ftc-can-proceed-with-facebook-lawsuit","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/ftc-can-proceed-with-facebook-lawsuit\/","title":{"rendered":"#FTC can proceed with Facebook lawsuit"},"content":{"rendered":"<p>&#8220;<strong>#FTC can proceed with <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> lawsuit<\/strong>&#8221;<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>The Biden administration was given another chance to pursue legal action against Facebook over claims that the social network is a monopoly.<\/p>\n<p>A federal judge rejected parent company Meta Platforms\u2019 attempt to throw out the Federal Trade Commission\u2019s antitrust complaint.<\/p>\n<p>The ruling by US District Judge James Boasberg on Tuesday is a reversal of his decision last summer to dismiss the initial FTC action.<\/p>\n<p>The agency was granted a request to file an amended complaint, which Boasberg on Tuesday called \u201cmore robust and detailed.\u201d<\/p>\n<p>\u201cSecond time lucky?\u201d Boasberg wrote in his ruling. He said the initial FTC lawsuit \u201cstumbled out of the starting blocks.\u201d<\/p>\n<p>The <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">news<\/a> doesn\u2019t <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ear to have affected the company in the eyes of investors. Shares of Meta Platforms rose by nearly 2% in trading on Wall Street on Tuesday.<\/p>\n<p>In Tuesday\u2019s ruling, Boasberg acknowledged that the FTC complaint could \u201cplausibly establish\u201d that Facebook\u2019s acquisitions of Instagram and WhatsApp constituted \u201canti-competitive conduct.\u201d<\/p>\n<p>Facebook sought to have Boasberg throw out the complaint just as he did last summer, saying that it had \u201cno valid factual basis.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-05.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"FTC Commissioner nominee Lina M. (Photo by Graeme Jennings \/ POOL \/ AFP) (Photo by GRAEME JENNINGS\/POOL\/AFP via Getty Images)\" class=\"wp-image-20798795\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-05.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-05.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-05.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>The ruling is a victory for the Federal Trade Commission and its commissioner, Lina Khan, who has vowed to rein in Big Tech.<\/figcaption><figcaption><span class=\"credit\">POOL\/AFP via Getty Images<\/span><\/figcaption><\/figure>\n<p>The amended complaint seeks to define what is meant by \u201cpersonal social media.\u201d<\/p>\n<p>The FTC argued that Facebook\u2019s sphere of competition is separate from online platforms like YouTube or TikTok, which users do not primarily use to communicate with friends and family. <\/p>\n<p>While the amended complaint was an improvement over the initial lawsuit, Boasberg, who was appointed to the federal bench by former President Barack Obama, said the FTC faces a daunting task \u2013 proving that Facebook is indeed a monopoly.<\/p>\n<p>\u201cAlthough the agency may well face a tall task down the road in proving its allegations, the Court believes that it has now cleared the pleading bar and may proceed to discovery,\u201d Boasberg wrote.<\/p>\n<p>A spokesperson for Meta told the Post: \u201cToday\u2019s decision narrows the scope of the FTC\u2019s case by rejecting claims about our platform policies. <\/p>\n<p>\u201cIt also acknowledges that the agency faces a \u2018tall task\u2019 proving its case regarding two acquisitions it cleared years ago.\u201d <\/p>\n<p>The spokesperson added: \u201cWe\u2019re confident the evidence will reveal the fundamental weakness of the claims. <\/p>\n<p>\u201cOur investments in Instagram and WhatsApp transformed them into what they are today. Examining the dominance of Amazon, Facebook, Google and Apple&quot; on Capitol Hill on July 29, 2020 in Washington, DC.\" class=\"wp-image-20798788\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-02.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-02.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/facebook-loses-antitrust-02.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Facebook has slammed the FTC\u2019s \u201cmeritless\u201d allegations that it has engaged in anti-competitive practices.<\/figcaption><figcaption><span class=\"credit\">Getty Images<\/span><\/figcaption><\/figure>\n<p>In the amended complaint, the FTC retained its core argument that Facebook engaged in a \u201cbuy or bury\u201d scheme to eliminate competition including Instagram and WhatsApp, helping the firm secure an illegal monopoly that hurts consumers.<\/p>\n<p>\u201cUnable to maintain its monopoly or its advertising profits by fairly competing, Facebook\u2019s executives addressed this existential threat by buying up the new mobile innovators, including its rival Instagram in 2012 and mobile messaging app WhatsApp in 2014, who had succeeded where Facebook had failed,\u201d the FTC alleged.<\/p>\n<p>Boasberg also rejected Facebook\u2019s contention that the FTC\u2019s vote to file the amended complaint is invalid due to Chair Lina Khan\u2019s past statements critical of Big Tech.<\/p>\n<p>The company demanded that Khan recuse herself from weighing in on matters related to Facebook due to an alleged inherent bias.<\/p>\n<p>But Boasberg disagreed, writing: \u201cThe Court believes that such contention misses its target, as Khan was acting in a prosecutorial capacity, as opposed to in a judicial role, in connection with the vote.\u201d<\/p>\n<p>The judge added: \u201cUltimately, whether the FTC will be able to prove its case and prevail at summary judgment and trial is anyone\u2019s guess.\u201d<\/p>\n<p>\u201cThe Court declines to engage in such speculation and simply concludes that at this motion-to-dismiss stage, where the FTC\u2019s allegations are treated as true, the agency has stated a plausible claim for relief under Section 2 of the Sherman Act.\u201d\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
