\nLooks like the royal family can\u2019t sweep this scandal under the rug!<\/p>\n

According to reports, a judge in New York refused to throw out the sexual assault case against Prince Andrew<\/strong> after the Duke of York\u2019s lawyers requested to have it shut down.<\/p>\n

That means the Queen<\/strong>\u2019s son has to either settle with accuser Virginia Roberts Giuffre<\/strong> or deal with a trial in nine months, where a court will look into the claims that Giuffre was repeatedly forced to have sex with him when she was just 17 and was trafficked by his former friends, Jeffrey Epstein<\/strong> and convicted felon Ghislaine Maxwell<\/strong>.<\/p>\n

If they can\u2019t reach a settlement, the ninth in line to the throne could be interviewed by Giuffre\u2019s lawyers in a videotaped deposition in London that might be played in court; however, Andrew can\u2019t be forced to give evidence because this is a civil suit in a different legal jurisdiction.<\/p>\n

The prince\u2019s lawyers tried to argue that her case should have been thrown out because of a freshly-unsealed $500,000 settlement with Epstein. Attorney Andrew Brettler<\/strong> argued the settlement protected Andrew because it contained a clause where she agreed not to take legal action against \u201cpotential defendants.\u201d<\/p>\n

But Judge Lewis Kaplan<\/strong> denied the motion to dismiss the complaint, claiming the court wasn\u2019t at this point able to consider the Duke\u2019s efforts to cast doubt on Giuffre\u2019s claims, or whether he was covered by the settlement agreement.<\/p>\n

Suggesting these were issues for a trial, he said in his ruling:<\/p>\n

\u201cThe 2009 Agreement cannot be said to demonstrate, clearly and unambiguously, the parties intended the instrument \u2018directly,\u2019 \u2018primarily,\u2019 or \u2018substantially,\u2019 to benefit Prince Andrew. The law prohibits the Court from considering at this stage of the proceedings the defendant\u2019s efforts to cast doubt on the truth of Ms Giuffre\u2019s allegations, even though his efforts would be permissible at trial. In a similar vein and for similar reasons, it is not open to the Court now to decide, as a matter of fact, just what the parties to the release in the 2009 settlement agreement signed by Ms Giuffre and Jeffrey Epstein actually meant.\u201d<\/p>\n<\/blockquote>\n

Giuffre\u2019s lawyer said she was \u201cpleased\u201d that \u201cevidence will now be taken concerning her claims against [Andrew],\u201d adding in a statement:<\/p>\n

\u201cShe looks forward to a judicial determination of the merits of those claims.\u201d<\/p>\n<\/blockquote>\n

Sources close to the royal told Page Six<\/em> that Andrew \u2014 who has denied all claims and said he can\u2019t recall ever meeting his accuser \u2014 is determined to \u201cclear his name.\u201d The insiders noted that while the decision to settle with Giuffre is still on the table, it\u2019s \u201cnot an option being considered at the moment.\u201d<\/p>\n

Meanwhile, the 61-year-old is facing losing not only the remainder of his military honors, but potentially his royal title amid the legal drama.<\/p>\n

Although he was forced to stand down from public duties in November 2019, the prince remains colonel of the Grenadier Guards. He\u2019s also still being referred to as \u201cHis Royal Highness\u201d on the royal family site, where he\u2019s listed as being a patron or member of about 100 charities.<\/p>\n

This is app<\/a>arently something that\u2019s gotten people inside the palace talking. A highly placed royal source told The Post<\/em>:<\/p>\n

\u201cHow does Andrew get to keep his HRH title when he\u2019s embroiled in this mess, [but] Harry and Meghan are banned from using theirs just for leaving everyday working life? I\u2019m fairly sure that\u2019s the exact same question being asked inside the palace. They have to do something with today\u2019s news<\/a> [about the lawsuit moving forward] \u2014 they can\u2019t just sit at their end and ignore it. They can\u2019t keep the status quo, they have to do something.\u201d<\/p>\n<\/blockquote>\n

It\u2019s worth mentioning that while Prince Harry<\/strong> and Meghan Markle<\/strong> retained their \u201cHRH\u201d titles following their royal departure, they can\u2019t use them officially.<\/p>\n

Last August, it was reported the Queen had \u201clet it be known\u201d she wanted her son to keep the title. That\u2019s apparently still the case, according to royal commentator and biographer Christopher Warwick<\/strong>, who told Sky News<\/strong> on Wednesday there was \u201ca feeling across the regiment that it\u2019s not appropriate to retain him. It puts her in an invidious situation but, of course, as his mother, what she\u2019s not going to do is turn her back on him.\u201d<\/p>\n

Majesty Magazine<\/em> managing editor Joe Little<\/strong> echoed that sentiment to The Post<\/em>, explaining that while his military titles should be relinquished, he didn\u2019t think \u201cthe HRH will be affected.\u201d He shared:<\/p>\n

\u201cAs far as Andrew\u2019s concerned, the honorable thing would be to relinquish his remaining military titles. Clearly this case is going to drag on and on and on \u2026 Out of respect for the military and the other institutions he\u2019s associated with, the time has now come for him to distance himself \u2014 and for him to do it himself rather than having the titles taken away from him\u2026 I don\u2019t think the HRH will be affected, I\u2019m sure the Queen won\u2019t take it away from him any more than she didn\u2019t take it away from Harry.\u201d<\/p>\n<\/blockquote>\n
