Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>ened here,\u201d Oustatcher told The Post.<\/p>\n<p>\u201cBy failing to bring to the Court\u2019s attention the evidence adduced and facts established at trial, the Bronx County District Attorney\u2019s Office essentially sealed the case\u2019s fate\u2026and lost an appeal that should have been won.\u201d<\/p>\n<p>Hemphill contends that the witness whose statement was used against him, Nicholas Morris, is the gunman who opened fire and shot Pacheco as he rode in a minivan with his kin near Harrison and West Tremont avenues.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/supreme-court-trial-479.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Bronx District Attorney Darcel Clark\" class=\"wp-image-20910917\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/supreme-court-trial-479.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/supreme-court-trial-479.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/supreme-court-trial-479.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Bronx District Attorney Darcel Clark \u201cwithheld consent\u201d for former Assistant District Attorney Adam Oustatcher to submit a 33-page brief to the justices, despite a request by Pacheco\u2019s mother.<\/figcaption><figcaption><span class=\"credit\">Pacific Press\/LightRocket via Getty Images<\/span><\/figcaption><\/figure>\n<p>Morris was initially charged with killing the tot and illegal possession of a 9 mm pistol, but that case ended in a mistrial in 2008.<\/p>\n<p>Morris later copped a plea to criminal possession of a .357 revolver, but not the gun that was used to kill Pacheco.<\/p>\n<p>Although Morris was unavailable to testify at Hemphill\u2019s trial \u2014 after getting barred from re-entering the US following a <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a> to Barbados \u2014 the presiding judge ruled that the defense \u201copened the door\u201d to admitting his statement by arguing that he was the real triggerman.<\/p>\n<p>The Supreme Court\u2019s ruling sends the case back to New York\u2019s highest court, the Court of Appeals, to decide whether Hemphill would have been convicted without that evidence.<\/p>\n<p>A spokesperson for the Bronx DA\u2019s Office said, \u201cWe cannot comment as the case is still being litigated.\u201d<\/p>\n<p>Stanford University law professor Jeffrey Fisher, a constitutional law expert who represented Hemphill before the Supreme Court, told the Associated Press that \u201cour position is that Hemphill\u2019s conviction must be reversed and he\u2019s entitled to a new trial.\u201d\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
