{"id":398439,"date":"2022-01-21T22:12:13","date_gmt":"2022-01-21T19:12:13","guid":{"rendered":"https:\/\/en.buradabiliyorum.com\/google-asks-judge-to-throw-out-texas-led-antitrust-suit\/"},"modified":"2022-01-21T22:12:13","modified_gmt":"2022-01-21T19:12:13","slug":"google-asks-judge-to-throw-out-texas-led-antitrust-suit","status":"publish","type":"post","link":"https:\/\/buradabiliyorum.com\/en\/google-asks-judge-to-throw-out-texas-led-antitrust-suit\/","title":{"rendered":"#Google asks judge to throw out Texas-led antitrust suit"},"content":{"rendered":"<p>&#8220;<strong>#Google asks judge to throw out Texas-led antitrust suit<\/strong>&#8221;<\/p>\n<div>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>Google asked a New York federal judge on Friday to throw out most of what it claimed was an \u201cinaccurate and inflammatory\u201d antirust suit brought by Texas and 14 other states over the tech giant\u2019s online advertising practices.\u00a0<\/p>\n<p>The Texas suit \u2014 which was first filed in December 2020 and been updated twice since then \u2014 claims that Google illegally muscled competitors out of the online advertising market and even struck a backroom deal with Mark Zuckerberg to give Meta\u2019s <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">Facebook<\/a> a lucrative leg up in online ad auctions.\u00a0<\/p>\n<p>In Friday\u2019s motion to dismiss, Google claimed that there was no evidence it had broken antitrust laws and argued that Texas attorney <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> Ken Paxton and the other attorneys general behind the suit are unfairly trying to punish Google for being successful.\u00a0<\/p>\n<p>\u201cThey criticize Google for not designing its products to better suit its rivals\u2019 needs and for making improvements to those products that leave its competitors too far behind,\u201d Google\u2019s attorneys wrote. \u201cThey see the \u2018solution\u2019 to Google\u2019s success as holding Google back, rather than letting market forces urge its competitors forward.\u201d\u00a0<\/p>\n<p>Paxton didn\u2019t immediately respond to Google\u2019s motion, but has previously accused the company of playing \u201cpitcher, catcher, batter and umpire\u201d in the ad market. \u201cThis isn\u2019t the \u2018free market\u2019 at work here,\u201d the Texas AG said shortly after the suit was originally filed. <\/p>\n<p>Manhattan federal court Judge P. Kevin Castel will now have to rule on the 52-page motion, which will likely be challenged by Paxton. The Texas attorney general\u2019s office did not immediately respond to a request for comment.\u00a0<\/p>\n<figure class=\"wp-block-image size-large is-style-default\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-03.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Texas attorney general Ken Paxton is leading the suit. \" class=\"wp-image-20918409\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-03.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-03.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-03.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Texas attorney general Ken Paxton is leading the suit. <\/figcaption><figcaption><span class=\"credit\">AP<\/span><\/figcaption><\/figure>\n<p>According to the suit, Google\u2019s power over the online ad market is equivalent to a large bank like Goldman Sachs or Citibank owning the New York Stock Exchange. <\/p>\n<p>Google\u2019s monopoly power allows it to take a 22% to 42% cut of all US ad spending that passes through its systems, effectively taking millions out of the pockets of advertisers and publishers, the suit argues.\u00a0<\/p>\n<p>When Facebook developed an alternative online ad bidding system that could have challenged Google\u2019s dominance, Google hatched \u201can unlawful agreement\u201d in 2018 to give Facebook \u201cinformation, speed, and other advantages\u201d in Google-run ad auctions in exchange for the social network backing down from competitive threats against the company, the suit alleges. <\/p>\n<p>The agreement was allegedly <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>roved personally by Google CEO Sundar Pichai and Meta CEO Mark Zuckerberg.\u00a0<\/p>\n<aside class=\"single__inline-module alignright\">\n    <\/aside>\n<p>In Friday\u2019s motion, Google denied manipulating ad actions and said that the deal with Facebook was neither secret nor anticompetitive.\u00a0<\/p>\n<p>\u201cThe allegation that has generated the most attention is that we somehow \u2018colluded\u2019 with Facebook Audience Network (FAN) through our Open Bidding agreement,\u201d Google economic director Adam Cohen <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/blog.google\/outreach-initiatives\/public-policy\/ag-paxtons-false-claims-still-dont-add-up\/\">wrote in a blog post<\/a> on Friday. \u201cThat\u2019s simply not true.\u201d\u00a0<\/p>\n<p>\u201cThis agreement does not provide [Facebook] with an advantage in the Open Bidding auction,\u201d Cohen added. \u201cWe don\u2019t allocate ad space to [Facebook], they don\u2019t receive speed advantages, and we don\u2019t guarantee that they win any auctions.\u201d\u00a0<\/p>\n<p>Google\u2019s motion seeks to throw out four of the suit\u2019s six counts with prejudice. <\/p>\n<p>In addition to the four federal claims, the suit also contained two state law claims that were stayed in September and not covered by Friday\u2019s motion.\u00a0<\/p>\n<figure class=\"wp-block-image size-large is-style-default\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-01.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Google\" class=\"wp-image-20918434\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-01.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-01.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/tech-antitrust-lobbying-01.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Google called the lawsuit \u201cinaccurate and inflammatory.\u201d <\/figcaption><figcaption><span class=\"credit\">REUTERS<\/span><\/figcaption><\/figure>\n<p>\u201cWe\u2019re confident that this case is wrong on the facts and the law, and should be dismissed,\u201d Cohen said. \u201cHowever, if it does move forward, we\u2019ll continue to vigorously defend ourselves.\u201d\u00a0\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
