Kathy Hochul\u2019s controversial mask mandate on Monday \u2014 in a move that could lead to the lifting of similar orders in schools across the state.<\/p>\n<p>Nassau County Supreme Court Justice Thomas Rademaker threw out a Nov. 24 rule issued by Health Commissioner Mary Bassett that led Hochul to order businesses without mandatory vaccination policies to require that all workers, customers and guests wear masks to prevent the spread of COVID-19.<\/p>\n<p>Nassau County Supreme Court Justice Thomas Rademaker said the rule amounted to \u201ca law that was promulgated and enacted unlawfully by an Executive branch state agency, and therefore void and unenforceable as a matter of law.\u201d<\/p>\n<p>And as a result, Rademaker said, the mask mandate Hochul announced on Dec. 10 \u201cmust fail as violative of the State Administrative Procedure Act.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-670.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"A general view of signs stating &quot;you need to be vaccinated against COVID-19 to enter this business&quot;\" class=\"wp-image-20954389\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-670.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-670.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-670.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Rademaker also noted that state lawmakers had \u201ccurbed\u201d former Gov. Andrew Cuomo from issuing executive orders during a state emergency, a ruling that <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>lies to Hochul as well.<\/figcaption><figcaption><span class=\"credit\">Christopher Sadowski<\/span><\/figcaption><\/figure>\n<p>\u201cWhile the intentions of Commissioner Bassett and Governor Hochul appear to be well aimed squarely at doing what they believe is right to protect the citizens of New York State, they must take their case to the State Legislature,\u201d he wrote.<\/p>\n<p>Rademaker\u2019s 6-page ruling also noted that state lawmakers had \u201ccurbed\u201d former Gov. Andrew Cuomo, \u201cas well as any future Governor,\u201d from issuing executive orders during a state disaster emergency.<\/p>\n<p>That move came amid the sexual harassment scandal that forced Cuomo to resign in August.<\/p>\n<p>The case was brought by Michael Demetriou and 13 other parents who objected to a provision in Bassett\u2019s rule that allowed her to order masking in \u201ccertain settings,\u201d including schools.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-728.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"120221 Showing NY Health Commissioner Dr. Mary Bassett. \" class=\"wp-image-20954394\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-728.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-728.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-728.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Hochul said in a statement that she strongly disagrees with Rademaker\u2019s ruling to throw out Bassett\u2019s mandate and will pursue options to reverse the decision.<\/figcaption><figcaption><span class=\"credit\">BRIGITTE STELZER<\/span><\/figcaption><\/figure>\n<p>The \u00a0Dec. 28 suit was brought \u201con behalf of all minor school children and persons similarly situated.\u201d<\/p>\n<p>The state Department of Health in August ordered all students, faculty and staff members in public and private schools to wear masks but it\u2019s unclear if Rademaker\u2019s ruling would affect New York City, which imposed its own mask requirement on public schools.<\/p>\n<p>The plaintiffs\u2019 lawyer, Chad LaVeglia, said Bassett had \u201ccircumvented the entire democratic process\u201d and  \u201cenhanced her own power to make law, and they just can\u2019t do that.\u201d<\/p>\n<p>\u201cIt\u2019s not about the pandemic, it\u2019s about the law,\u201d he said.<\/p>\n<p>Nassau County Executive Bruce Blakeman \u2014 an outspoken opponent of Hochul\u2019s mask mandate \u2014 called Rademaker\u2019s decision \u201ca tremendous victory for the people of New York State, especially the school kids.\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-729.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Bruce Blakeman in front of his home.\" class=\"wp-image-20954380\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-729.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-729.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/01\/hochul-mask-mandate-tossed-729.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Nassau County Executive Bruce Blakeman, who previously rejected Hochul\u2019s mandate and said he wouldn\u2019t enforce it, applauded Rademaker\u2019s decision.<\/figcaption><figcaption><span class=\"credit\">Bruce Blakeman for Nassau County<\/span><\/figcaption><\/figure>\n<p>\u201cSo many parents came to me and said that they didn\u2019t feel it was healthy for their children to be forced to wear masks and they wanted to have that choice and I agree,\u201d he said.<\/p>\n<p>In a prepared statement, Hochul said the state would appeal.<\/p>\n<p>\u201cMy responsibility as Governor is to protect New Yorkers throughout this public health crisis, and these measures help prevent the spread of COVID-19 and save lives,\u201d she said.<\/p>\n<p>\u201cWe strongly disagree with this ruling, and we are pursuing every option to reverse this im<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">media<\/a>tely.\u201d<\/p>\n<p>The State Department of Health said the appeal \u201cwill result in an automatic stay that will unambiguously restore the mask rule until such time as an appellate court issues a further ruling.\u201d<\/p>\n<p>\u201cTherefore, schools must continue to follow the mask rule,\u201d they said in a statement.\n                        <\/p><\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
