In England, this is the reality for escooters, where their legality depends on whether riders own or hire them.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The battle between public and private escooters has meant that their low carbon footprint in the micromobility space has been obscured mainly by police intervention and what some call over-policing.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">I wanted to understand the situation more. So I reached out to Dott, who is participating in Transport for London\u2019s (TfL) escooter hire scheme, and also a private escooter retailer, \u00a0<a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.scootered.co.uk\/\">Escootered<\/a>. But first, let\u2019s take a walk through the legalities of escooters in the UK:<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Law_and_order\"><\/span><span data-preserver-spaces=\"true\">Law and order<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">In micromobility, escooters are a poster child for when tech rolls out faster than the laws around its use.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In the UK, escooters are covered by the Road Traffic Act (1988) and <\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.gov.uk\/government\/publications\/powered-transporters\/information-sheet-guidance-on-powered-transporters\"><span data-preserver-spaces=\"true\">fall under the category of powered transporters<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">z It\u2019s legal to buy, sell, and own escooters. There\u2019s <\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.halfords.com\/scooters\/electric-scooters\/globber-one-k-e-motion-10-v3-kids-electric-scooter---black%2Fgrey-537918.html\"><span data-preserver-spaces=\"true\">no age limit<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0on ownership. But you can only ride them on private land.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">By comparison, rideshare escooters can be ridden on roads and cycle paths and can only be hired by people 18 years or over who own a <\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.gov.uk\/driving-licence-categories\"><span data-preserver-spaces=\"true\">category Q or P\/M<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0driver\u2019s license. Many people are using their purchased escooters for commuting, despite the fact that it\u2019s illegal.<\/p>\n<p><span data-preserver-spaces=\"true\">I spoke to Ed Wiles, owner of retail business\u00a0<\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.scootered.co.uk\/\"><span data-preserver-spaces=\"true\">Escootered<\/span><\/a><span data-preserver-spaces=\"true\">, who shared:\u00a0<\/span><\/p>\n<blockquote><p><span data-preserver-spaces=\"true\">My <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> thinking is that escooters are over-policed. And I think Brexit and COVID have had a knock-on effect with the government not introducing new laws which could have legalized private escooters.\u00a0<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">He suggested<\/span><\/p>\n<blockquote><p><span data-preserver-spaces=\"true\">I think that they\u2019ve actually done it the wrong way around. If you\u2019re a private owner, you\u2019re much more likely to wear a helmet. Also, you\u2019re much more likely to test out the scooter to avoid injury before you ride it.<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">Notably, it\u2019s not illegal to ride an escooter without a helmet. However, rideshare companies like Dott offer incentives to riders. These include bonus points towards free rides for those that take a selfie wearing their helmet.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Wiles also raises an important point: the risk of injury.\u00a0<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"How_common_are_escooter_injuries\"><\/span><span data-preserver-spaces=\"true\">How common are escooter injuries?\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">There\u2019s plenty in the press about injuries caused by riding an escooter, and the head of the Metropolitan road and transport police has not helped their reputation by branding them as \u201c<\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.thesun.co.uk\/news\/15173803\/e-scoorts-death-traps-police-crashes\/\"><span data-preserver-spaces=\"true\">death traps<\/span><\/a><span data-preserver-spaces=\"true\">.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Escooter crashes\u00a0<\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/uk.news.yahoo.com\/e-scooter-crashes-london-surge-143100328.html\"><span data-preserver-spaces=\"true\">shot up almost 2,800%<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0in London in the first half of 2021 compared to the entirety of 2018, according to Met Police data.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">There were 258 collisions in the capital in the first six months of last year. In 2018 there were 9.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">It\u2019s unclear exactly how many of the injured riders are private owners riding illegally or rideshare participants. There are<\/span>\u00a0also no details on whether the \u201ccollisions\u201d were people falling off their escooters or colliding with pedestrians or road users.<\/p>\n<p><span data-preserver-spaces=\"true\">We do know that those injured are most like to be inexperienced riders. In response, the company limits the engine speed for these first few <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/trip-and-travel\/\" data-internallinksmanager029f6b8e52c=\"10\" title=\"Trip &amp; Travel\" target=\"_blank\" rel=\"noopener\">trip<\/a>s. Dott says this helps riders get comfortable with the scooters and reduces the likelihood of accidents.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Dott also requires users to complete a training course via its app.\u00a0<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_challenge_of_policing_and_curbing_bad_rider_behavior\"><\/span><span data-preserver-spaces=\"true\">The challenge of policing and curbing bad rider behavior\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">It\u2019s relatively easy for rideshare companies to <\/span><span data-preserver-spaces=\"true\">control user behavior<\/span><span data-preserver-spaces=\"true\"> by slowing down dangerous riders and stopping escooters from moving when ridden on the sidewalk. Such actions are not possible with privately-owned escooters.\u00a0\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Further, according to Wiles, conviction rates against illegal owners vary according to location. Boroughs outside London are more likely to give verbal warnings to offenders, for example. Officers in London seized 3,637 privately-owned e-scooters in total between January and November 2021.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Research by\u00a0<\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.vice.com\/en\/article\/wx5kbz\/black-people-using-e-scooters-disproportionately-targeted-by-police-in-london\"><span data-preserver-spaces=\"true\">VICE<\/span><\/a><span data-preserver-spaces=\"true\"> found Black teenagers are overrepresented in these seizures, suggesting it was part of a bigger problem of racial discrimination and over-policing.<\/span><\/p>\n<p><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.dailymail.co.uk\/news\/article-10384199\/E-scooter-rider-seeking-compensation-seriously-injured-London-set-test-case.html\"><span data-preserver-spaces=\"true\">Earlier this month<\/span><\/a><span data-preserver-spaces=\"true\">, a private escooter rider sought compensation after suffering serious injuries when he was overtaken by a London bus while riding his escooter illegally on the road. His lawyer told\u00a0<\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.thetimes.co.uk\/article\/insurers-seek-to-block-injury-claims-from-illegal-e-scooter-riders-gzj0tc7vh\"><span data-preserver-spaces=\"true\">The Times<\/span><\/a><span data-preserver-spaces=\"true\">:<\/span><\/p>\n<blockquote><p><span data-preserver-spaces=\"true\">We hope this case will help clarify the legal position for those injured in escooter accidents where the privately-owned escooter is ridden on a public road.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">But really, we urgently need new legislation, and we\u2019re calling on the government to implement laws to make e-scooters safer for riders and other road users and to enable injured people to access compensation.<\/span><\/p>\n<\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"Private_escooters_got_another_blow_in_December\"><\/span>Private escooters got another blow in December<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">In December 2021,\u00a0<\/span><span data-preserver-spaces=\"true\">TfL banned private e-scooters on its network<\/span><span data-preserver-spaces=\"true\"> after one burst into flames (although they can still travel on overground trains). According to Wiles:<\/span><\/p>\n<blockquote>\n<blockquote><p><span data-preserver-spaces=\"true\">Part of the problem is that these escooters may be imitation Xiami or Segways. Rideshare trails have expanded to 34 areas of England. They were originally due to last 12 months but are now <\/span><a rel=\"nofollow noopener\" target=\"_blank\" class=\"editor-rtfLink\" href=\"https:\/\/www.transportnottingham.com\/e-scooter-trial-extended-until-november-2022\/\"><span data-preserver-spaces=\"true\">extended to November 2022<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Until the UK Government\u2019s rideshare escooter trial concludes, it\u2019s unlikely we\u2019ll see any indication of legal reform around escooter use. Rideshare companies are working hard in their communities to ensure rider safety (and those surrounding them). Regardless, I\u2019m not sure private escooters will collectively suddenly town the line. Attempts to curtail private owners riding illegally show no sign of succeeding.
