We aim to overturn City Charter\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2022\/02\/150200_2022_Phyllis_Coachman_et_al_v_Phyllis_Coachman_et_al_EXHIBIT_S__3.pdf\">Chapter 46-A<\/a>,\u00a0which\u00a0our litigation dubs\u00a0the Foreign Citizen Voting\u00a0Bill. Passed by the City Council Dec. 9,\u00a0FCVB\u00a0lets foreign citizens vote in Gotham\u2019s local elections.\u00a0<\/p>\n<p>Starting Jan. 9, 2023, this absurdity would empower\u00a0foreign citizens\u00a0to\u00a0choose our mayor, City Council, borough\u00a0presidents and district attorneys and decide\u00a0local ballot measures. These new voters would include green-card-bearing legal immigrants and even\u00a0illegal aliens\u00a0under federal protection, such as\u00a0asylum seekers\u00a0and DACA designees.<\/p>\n<p>Foreign citizens\u00a0could invade the US-Mexico \u201cborder,\u201d penetrate America without permission, request asylum, fly to Westchester Airport aboard one of Joe Biden\u2019s free, clandestine, late-night flights, cab it to Manhattan and\u00a0\u2014 after\u00a030 days \u2014 cast ballots beside Gotham\u2019s\u00a0voters who were born in the USA.\u00a0<\/p>\n<p>New York joins San Francisco, two Vermont cities and 11 Maryland communities in converting foreign citizens into local voters. As it relentlessly mutilates America, its next demand will be for foreign votes in state races.\u00a0<\/p>\n<p>And then \u2014 why not? \u2014 \u201cLet them cast ballots for Congress and for president!\u201d<\/p>\n<p>Disagree? Racist!\u00a0<\/p>\n<p>But\u00a0FCVB is not just stupid, offensive and dangerous. It has the added disadvantage of being unconstitutional.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/02\/antonio-reynosos.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Councilman Antonio Reynoso said that the bill is being opposed by a &quot;sea of mostly white men&quot; who are trying to hang on to power and influence.\" class=\"wp-image-21196524\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/02\/antonio-reynosos.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/02\/antonio-reynosos.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/02\/antonio-reynosos.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Councilman Antonio Reynoso said that the bill is being opposed by a \u201csea of mostly white men\u201d who are trying to hang on to power and influence.<\/figcaption><figcaption><span class=\"credit\">Paul Martinka<\/span><\/figcaption><\/figure>\n<p>As\u00a0our\u00a0lawsuit details,\u00a0FCVB violates the\u00a0<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-15\/\">15th Amendment<\/a>\u00a0to the US Constitution, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.history.com\/topics\/black-history\/fifteenth-amendment\">adopted in\u00a01870<\/a>: \u201cThe right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.\u201d\u00a0<\/p>\n<p>My co-plaintiffs and I contend, and the New York City Council\u2019s <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2022\/02\/150200_2022_Phyllis_Coachman_et_al_v_Phyllis_Coachman_et_al_EXHIBIT_S__5.pdf\">deliberations confirm<\/a>, that\u00a0FCVB\u00a0dilutes and therefore abridges the votes of New Yorkers, not least\u00a0black citizens,\u00a0because\u00a0local lawmakers acted \u201con account of race,\u201d not color-neutral citizenship grounds.\u00a0<\/p>\n<ul>\n<li>Council Majority Leader Laurie Cumbo said that \u201cthis particular legislation is going to shift the power dynamics in New York City in a major way, and we do not have the numbers or the information to know how that is going to impact African-American communities.\u201d In a naked expression of tribalism, she added: \u201cWe\u2019re all here to support our ethnic groups, and we\u2019re all here to make sure that we all win.\u201d\u00a0<\/li>\n<\/ul>\n<ul>\n<li>Councilman Antonio\u00a0Reynoso complained about \u201cthis sea of mostly white men that have stood up against this bill at this moment in an effort to preserve their power and influence.\u201d\u00a0<\/li>\n<\/ul>\n<ul>\n<li>Councilman Ydanis Rodriguez said that because \u201cthis city has changed the color of the skin of people coming to this city, then we change who will be voting in this city.\u201d Rodriguez switched to Spanish and declared that FCVB would increase the political clout of New Yorkers of Hispanic and Asian heritage.<\/li>\n<\/ul>\n<p>FCVB\u00a0also grinds its\u00a0cleats\u00a0into\u00a0the New York state Constitution, which limits the vote to \u201c<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/dos.ny.gov\/system\/files\/documents\/2022\/01\/Constitution-January-1-2022.pdf\">every citizen<\/a>\u201d who is at least age 18 and a 30-day resident.\u00a0<\/p>\n<p>This outrage deserves to be strangled in its crib.
