claims: DOJ&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<div>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>Top Google executives including CEO Sundar Pichai used phony claims of \u201cattorney-client privilege\u201d to hide thousands of emails from federal scrutiny and other possible legal proceedings, according to the Justice Department.\u00a0<\/p>\n<p>Executives including Pichai participated in the search giant\u2019s internal practice, which was called \u201cCommunicate with Care,\u201d and may have unfairly \u201ccamouflaged\u201d thousands of documents from scrutiny, the department said in a Monday filing in Washington, DC, federal court.\u00a0<\/p>\n<p>\u201cGoogle has explicitly and repeatedly instructed its employees to shield important business communications from discovery by using false requests for legal advice,\u201d attorneys for the Justice Department wrote. <\/p>\n<p>\u201cSpecifically, Google teaches its employees to add an attorney, a privilege label, and a generic \u2018request\u2019 for counsel\u2019s advice to any sensitive business communications the employees or Google might wish to shield from discovery.\u201d\u00a0<\/p>\n<p>In one such example from 2018, Pichai emailed <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/social-mediaa\/\" data-internallinksmanager029f6b8e52c=\"1\" title=\"Social Media\" target=\"_blank\" rel=\"noopener\">YouTube<\/a> CEO Susan Wojcicki to discuss an upcoming press story.\u00a0<\/p>\n<p>\u201cAttorney Client Privileged, Confidential,\u201d Pichai wrote, copying Google\u2019s then-<a href=\"https:\/\/buradabiliyorum.com\/en\/category\/general\/\" data-internallinksmanager029f6b8e52c=\"3\" title=\"General\" target=\"_blank\" rel=\"noopener\">general<\/a> counsel Kent Walker. \u201cKent pls advise.\u201d\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-71.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Gmail app\" class=\"wp-image-21611676\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-71.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-71.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-71.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>\u201cGoogle has explicitly and repeatedly instructed its employees to shield important business communications from discovery by using false requests for legal advice,\u201d the Justice Department said. <\/figcaption><figcaption><span class=\"credit\">SOPA Images\/LightRocket via Gett<\/span><\/figcaption><\/figure>\n<p>Yet Walker <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/download-scripts-themes-apps\/\" data-internallinksmanager029f6b8e52c=\"9\" title=\"Download Scripts &amp; Themes &amp; Apps\" target=\"_blank\" rel=\"noopener\">app<\/a>arently never replied to the thread, which the Justice Department said was \u201cdirected to a non-attorney\u201d about \u201ca non-legal press issue.\u201d<\/p>\n<p>The email was initially withheld by Google in an ongoing antitrust case and was only produced after the Justice Department challenged it, the department said.\u00a0<\/p>\n<p>\u201cIn these email chains, the attorney frequently remains silent, underscoring that these communications are not genuine requests for legal advice but rather an effort to hide potential evidence,\u201d the Justice Department said.\u00a0<\/p>\n<p>The federal government\u2019s ongoing antitrust suit, which was filed by President Donald Trump-appointed Attorney General Bill Barr in 2020, accuses the search giant of establishing \u201cunlawful monopolies\u201d in the online search and advertising industries.\u00a0<\/p>\n<p>In Monday\u2019s filing, the Justice Department asked the federal judge hearing its suit against Google to order the company to turn over all requested emails where an attorney was copied but never responded.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-73.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Department of Justice\" class=\"wp-image-21611655\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-73.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-73.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/google-gmail-73.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Google improperly \u201ccamouflaged\u201d business emails, the Justice Department said. <\/figcaption><figcaption><span class=\"credit\">Xinhua <a href=\"https:\/\/buradabiliyorum.com\/en\/category\/news\/\" data-internallinksmanager029f6b8e52c=\"2\" title=\"News\" target=\"_blank\" rel=\"noopener\">News<\/a> Agency\/Getty Images<\/span><\/figcaption><\/figure>\n<p>Google denied wrongdoing in a statement to The Post and said it has already turned over more than 4 million documents in the Justice Department\u2019s antitrust case.\u00a0<\/p>\n<p>\u201cOur teams have conscientiously worked for years to respond to inquiries and litigation, and suggestions to the contrary are flatly wrong,\u201d a Google spokesperson said. \u201cJust like other American companies, we educate our employees about legal privilege and when to seek legal advice.\u201d\u00a0<\/p>\n<p>Attorney-client privilege cannot always be claimed on emails that include a generic request for legal advice, experts say.\u00a0<\/p>\n<p>\u201cThe historical purpose of the privilege is to give lawyers the ability to be involved in frank conversations with the client so as to deter misconduct \u2014 prevent it before it happens \u2014 not to protect misconduct against disclosure,\u201d Michele DeStefano, a University of Miami law professor, <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wsj.com\/articles\/google-improperly-invoked-legal-privilege-to-withhold-emails-government-claims-11647894881?mod=tech_lead_pos1\">told the Wall Street Journal<\/a>.\u00a0\n                        <\/div>\n<blockquote><p><strong><span style=\"color: #ff6600;\">If you liked the article, do not forget to share it with your friends.
