\n A conservative legal advocacy group is reviving its ethics complaint against Sen. Chuck Schumer for making \u201cthreatening comments\u201d against Supreme Court Justices Neal Gorsuch and Brett Kavanaugh during an abortion rights rally earlier this year.<\/p>\n

The National Legal and Policy Center said Thursday it app<\/a>ealed the New York State court system\u2019s dismissal of its complaint against Schumer after accusing state officials of trying to sweep the case \u201cunder the rug\u201d because he\u2019s a powerful politician.<\/p>\n

Schumer, a lawyer, is a member of the Bar Association and the Office of Court Administration\u2019s attorney grievance committees investigate ethics complaints leveled against licensed attorneys.<\/p>\n

During an abortion rights rally in March on the steps of the US Supreme Court, Schumer said, \u201cI want to tell you, Gorsuch\u2026 I want to tell you, Kavanaugh\u2026 you have released the whirlwind, and you will pay the price. You won\u2019t know what hit you if you go forward with these awful decisions.\u201d<\/p>\n

He was referring to the judges potentially restricting abortion rights.<\/p>\n

But in a one-paragraph dismissal letter dated July 27, 2020, the grievance committee of the state Supreme Court\u2019s Appellate Division told the NLPC that it is \u201ccautious\u201d about disciplining lawyers for comments that \u201cmay be protected by the First Amendment\u201d and was \u201cmindful not to wade into political controversies.\u201d<\/p>\n

NPLC counsel Paul Kamaner filed an appeal, accusing court officials of \u201cbrushing off\u201d the complaint.<\/p>\n

The counsel\u2019s chairman, Peter Slaherty, said \u201cSenator Schumer\u2019s threats against Supreme Court Justices cannot be swept under the rug by New York bar authorities just because they were politically controversial.\u201d<\/p>\n

\u201cSadly,\u201d Flaherty added, \u201cit appears that the Bar has abdicated its duty to enforce its ethics rules because Senator Schumer holds high political office.\u201d<\/p>\n

The New York State Republican Party also had filed an ethics complaint against Schumer.<\/p>\n

Schumer, through a spokesman, declined comment.<\/p>\n

Schumer previously walked back his comments after getting pilloried by Chief Justice John Roberts and GOP lawmakers, but denied he threatened the judges.<\/p>\n

\u201cI\u2019m from Brooklyn. We speak in strong language. I shouldn\u2019t have used the words I did, but in no way was I making a threat,\u201d Schumer, the Senate\u2019s top Democrat, said on the Senate floor.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
