\n President Trump can\u2019t postpone E. Jean Carroll\u2019s defamation case against him by using an immunity defense, a judge ruled Thursday \u2014citing a recent Supreme Court decision in a case to subpoena the president\u2019s tax records.<\/p>\n

Trump had asked a judge for a stay in the Elle magazine \u201cAsk E. Jean\u201d advice columnist\u2019s case, while a similar defamation lawsuit is decided on app<\/a>eal and while he is still in office.<\/p>\n

But Manhattan Supreme Court Justice Verna Saunders denied the request in light of the high court\u2019s ruling last month that Trump is not immune from Manhattan District Attorney Cy Vance\u2019s efforts to subpoena eight years of his tax records and financial statements.<\/p>\n

\u201cWhile the Vance Court\u2019s decision permits the issuance of a criminal subpoena to a sitting President, it\u2019s analysis and conclusions address the same issues and questions raised by defendant in this action,\u201d Saunders ruling read.<\/p>\n

In particular, one of those questions is, \u201cWhether the Supremacy Clause of the constitution bars a state court from exercising jurisdiction over a sitting President of the United States during his term,\u201d Saunders said. \u201cNo, it does not.\u201d<\/p>\n

Saunders added that the Supreme Court decision can be applied to all state court lawsuits against the president, \u201cincluding those involving his or her unofficial\/personal conduct.\u201d<\/p>\n

Carroll sued Trump in November claiming that he defamed her when he publicly denied her allegations that he raped her in a Bergdorf Goodman changing room around 1995.<\/p>\n

\u201cWe are very gratified,\u201d Carroll\u2019s lawyer, Roberta Kaplan said of Saunder\u2019s decision. \u201cWe are now eager to move forward with discovery so that we can prove that Donald Trump defamed E Jean Carroll when he lied about her in connection with her brave decision to tell the truth about the fact that Donald Trump had sexually assaulted her.\u201d<\/p>\n

Lawyers for Trump didn\u2019t immedia<\/a>tely return a request for comment.\n <\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/div>\n
