Hochul&#8217;s criminal-justice plan&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<div>\n<aside class=\"single__inline-module alignleft\">\n<\/aside>\n<p>Crime-victim advocates Friday demanded that the state legislature support Gov. Kathy Hochul\u2019s proposed criminal-justice reforms, saying some of the changes would help protect battered women. <\/p>\n<p>The domestic-violence-prevention groups \u2014 in a letter to Senate Majority Leader Andrea Stewart-Cousins (D-Westchester) and Assembly Speaker Carl Heastie (D-The Bronx) \u2014 ripped the current tight deadlines that prosecutors face when turning over discovery, or evidence, to the other side.<\/p>\n<p>\u201cWe have seen domestic violence prosecutions dismissed in record numbers for mere technical violations of discovery rules, leaving vulnerable survivors without urgently needed orders of protection and dashed hopes of justice,\u201d said the letter, which was signed by representatives from more than a dozen groups, including Sanctuary for Families and the Met Council. <\/p>\n<p>\u201cJust as alarming, we are seeing prosecutors plead down or adjourn in contemplation of dismissal serious domestic violence cases because they are too overburdened with overwhelming discovery compliance to provide survivors at grave risk of danger with the protection they need.\u201d <\/p>\n<p>Hochul\u2019s proposal, leaked to The Post last week, would allow judges to decide whether prosecutors are in \u201csubstantial\u201d compliance on discovery, rather than only operate under the current regs, which require all evidence to be turned over in most cases within 20 days of arraignment.<\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/hochul-jail-reform-571.jpg?quality=90&amp;strip=all&amp;w=1024\" alt=\"Senate Majority Leader, Andrea Stewart-Cousins\" class=\"wp-image-21666520\" srcset=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/hochul-jail-reform-571.jpg?quality=90&amp;strip=all&amp;w=1535 1536w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/hochul-jail-reform-571.jpg?quality=90&amp;strip=all 1024w, https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/03\/hochul-jail-reform-571.jpg?quality=90&amp;strip=all&amp;w=512 512w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\"\/><figcaption>Senate Majority Leader, Andrea Stewart-Cousins has come out in opposition to Gov. Kathy Hochul\u2019s proposal. <\/figcaption><figcaption><span class=\"credit\">Hans Pennink<\/span><\/figcaption><\/figure>\n<p>The groups argued that the current situation is forcing prosecutors to cut plea deals or leads to charges being dropped altogether because of the restrictions. <\/p>\n<p>The state\u2019s district attorneys association for prosecutors \u2014 who include Bronx DA Darcel Clark, Queens DA Melinda Katz, Brooklyn DA Eric Gonzalez and Staten Island DA Michael McMahon \u2014 also authored a letter supporting the changes.
